BUT ILLEGAL BUILDINGS, BUILDINGS WITH VIOLATIONS AND DEVIATIONS TO BUILDING BYLAWS AND SANCTIONED PLANS HAVE TO WAIT FOR AKRAMA-SAKRAMA. THE BBMP IS EXPECTED TO MOP UP AROUND RS1,500/- CRORES THROUGH THIS PROCESS.

It is not the problem of common man, it is the question of illegality. The Govt is taking decision only to get money in any form and the major obstacle is the law of the land.
Buying a site with Rs10 to Rs20 lakhs, is not a poor man.
Anyway, there is no progress on this issue.

It is true that a person buying a site for Rs.10 to Rs.20 lakhs is not a poor man. But he buys such a site because he cannot afford to buy a BDA or KHB site by paying a crore rupee. If one were to avoid buying such sites then one is at the mercy of rented houses. The Government is also playing the double game. It allows the registration of revenue sites and that too by collecting huge amount as stamp fee and registration fee proportional to the area. This amounts to recognizing the development (otherwise who will pay rates of 2000 or more for a square feet of agricultural land) and also BBMP collects property tax by recognizing it as a site.
That is why it is necessary to bring out the unholiness of BDA and KHB sites. Sites allotted by BDA and KHB are to be occupied by constructing houses within 2 years of allotment. However, the Govt is not implementing this rule. Actually the Govt should mercilessly take back such sites and allot it to other needy and deserving persons. That will solve the problem of scarcity of sites and also prevent the need for acquisition of new land for formation of layouts and most importantly ENDS THE HOARDING of sites by monied big. Otherwise why should one still keep sites in many layouts empty even after 30 years of allotment. This is UNHOLY.

A major portion of these lands are with the Land Mafia.
We are in constant touch with the UD Ministry, are not divulging the details, moreover, there are some obstacles, the Government must overcome before the promulgation of the Ordinance.
May be by Oct, a Decision might be taken to regularize the revenue sites.

There is no update. But, there is a strong lobby, which is against illegal properties, which they want to be penalised to the maximum, before providing any water, electricity, road and other infrastructure.
B katha does not exist. The property owner, voluntarily pays the tax and declares the nature and type of the property by registering it in B register. B register is meant to register the illegal, unauthorised and properties which have violated the laws.
Illegality must wait.

But this is not the answer to common cititzens who are suffering due to the delay caused by govt / BBMP to issue A khata or collection of betterment charges. We cannot purchase / sell land without this certificate, Bank does not give loan without this certificate and we for whatever fancy reason are suffering.

If you have a clear titled property complied with all statutory requirements, you can get A katha.
Only properties which are not legal, cannot get the A katha. How can BBMP issue katha for the properties which have not followed or complied with necessary approvals? Will the citizens not question about it?

There is no way you can do anything about it. Only the regualrisation (or akrama-sakrama) will come to your rescue, if your property is legal.

I have seen a land near Ramamurthy Nagar Bangalore which the owner says is a BBMP ‘A’ Khata. It is a two 30×40 site which owner has purchased, but he has registered as only a single plot. I had seen the documents and everywhere it mentions plot no: 10 & 11 combined. Now out of this two sites he has constructed a house on one and has a empty plot which he is willing to sell. Specifically, he has constructed a house in plot no: 11 and plot 10 is for sale. In this case, if i am to purchase this land, would bifurcation and sale of the empty land (plot no: 10) possible?

If there are two kathas for the two sites, there is no issue. But, if there is a single katha for both the properties, which might have been amalgamated, can be bifurcated. A thorough enquiry is a must at Ramamurthy nagar, regarding Kathas.

Payment of taxes will not confer you the clear and marketable titles. If you pay taxes for Vidana Soudha, will you be the owner of it? NO.
Just, because some illegal and unauthorised constructions have come up, the entire area cannot be legally regularised. All are illegal. There is no concept of B katha in the KMC Act. It is a process used to collect the taxes for illegal properties. There are two registers maintained under KMC Act by the BBMP. A register- where all legal properties and the details are entered. B register- where illegal property details are entered. You have declared your property in the B register. Check the statement of the Commissioner BBMP on this issue.

I am planning to buy a house constructed on revenue/grampanchayat non dc converted layout in JP nagar 7 Phase. The owner has Khata A (way back in 2000) but the betterment charges are not paid.
1) So would I have to still regularise pay the betterment charges once akrama sakrama is implemented?

Some groups have made representation that they are willing to pay 10% of the guidance value as penalty for regularisation, even that is also under consideration.

There was a site in Sunkenahally BSK3rd stage, BDA had given Notification & Final Notification in years 1971-1980 & payment was deposited in treasury of BDA where site owners had to go and collect. After that its said Land Acquisition Officer transferred the papers to Engineering department. This is when a RTI was filed for said survey No. In year 1998 BBMP collected Betterment Charges & issued Khata and taxes are paid regularly since then. Even now there is “A” Khatha & any bank would be ready to give Loan to construct. Even though there is Proper BBMP “A” Khatha the lady at BDA says this is BDA Property. Are houses in this area liable for demolition in future. The property is in heart of the city with more than 100 sites covering over 4 Acres and all well developed Houses. Kindly Clarify

We have detected three such small layouts with 15 to 25 houses,(HBR AND HRBR)( all 11 houses were financed by banks, one property had 61 lakhs loan)(it is under recovery from the bank) which had been financed by banks and BBMP Katha Certificate and Extract. The Govt has notified the land and the compensation had been awarded. The culprits changed the nature of ownership by misrepresentation of facts and the BBMP katha stands cancelled automatically, if a plaint or application is made with documentary evidence or PIL lodged in the High Court.
If it is Government property(BDA) it belongs to everybody and the properties are located in highly valued area. We know the details but as it does not concern us, does not wish to comment on it.
Someday and definitely somebody will ?????????????? and naturally the offenders or those who have illegally occupied or in illegal possession have to ?????????????
This subject matter was dealt by the JLC and STF headed by V.Balasubramanian.,I.A.S.(Rtd) and the same is said to have been reported to the Government for stern action. We have overread this and it is valued around Rs50 to Rs100crores and the price of the sites in the surrounding areas are quoted to be around Rs5,000/- to Rs6,000/- a square feet and action might be initiated SOON.
The STF reports that around 2878 acres of land out of 19,613 acres of land notified were encroached and the BDA officials are still recovering it in small bits. 15% of the BDA lands will be recovered and it is worth 28,780 crores and more.
Secondly, you have said, that taxes is being paid. Payment of taxes will not confer any right, title and interest and BBMP kathas issued on misrepresentation of facts or otherwise, will stand automatically cancelled. Banks which have lent money will go to docks.

By the payment of Betterment charges, they cannot become the absolute owners.
Just because, you have illegally occupied somebody`s land and stayed there, you cannot claim the rights over the property. There is no case or litigation. It is BDA property, why should anybody claim it except BDA. The BDA is inactive, that is all.
Everybody in Bangalore wants a piece of land and will sqat on every available land and pay betterment charges, will they become legal owners?

While submitting the application for the registration of katha, all the documents pertaining to the sites have to be presented(generally certified copies or notarised copies of the originals) and the so called owners would have submitted documents which are not genuine or fake or fabricated without their knowledge. When it is noticed, the concerned authority, may issue a showcause notice or conduct an enquiry and initiate appropriate proceedings and thus the katha may be cancelled. Due to vested interests, the revenue department in BBMP has not taken such action, as there was no compulsion on them.
Hence, the issue of katha based on such documents is not valid and legally binding.

The said site was purchased by my father in year 1972 and since then we are in possession. No illegal documents. I have up to date EC from 1962 till date. While i was going through some old papers i found a BDA acquisition Notice of 1980 which says owners can come and submit their documents and collect the money. My Dad & Mom are no more, so i cant ask them the significance of that notice. From what i see a Regd Housing society was formed which was collectively fighting for the benefit if its members. Now that society mostly doesnt exist or doesnt have office bearers. When i ask my neighbours who have been there for years since my Dad purchased they say now its BBMP, havent u paid betterment. If i apply for RTI in BDA they say in 1980 money has been awarded and said survey no transferred to Engineering Department. If i consult my Lawyer he says go to taluk office and take RTC for said survey No. I sometimes wonder whether i am just wondering about a problem that doesnt exist. The layout is fully developed with Tar roads, Drainage, Cauvery water,etc etc with all good houses. I am just wondering whether i need to get any document from BDA, such as reconveyed Sale deed,etc. Why i am worrying is because i dont want BDA to come one day and say this property belongs to us. Now that problem if at all it comes up should come for the entire 100 odd sites in the 4 acres odd fully developed Land. Demolishing all the houses and taking possession is a very difficult proposition as all have Building Plan sanction from BBMP, BBMP “A” Khatha. What i wanted to say was this land is not encroached by us. Just wanted some good opinion as i felt my lawyer whom i consulted was not able to guide me properly. IGNORANCE IS BLISS. You wanted an opinion which suits your views. When the land is notified and acquired by the BDA, it is the property of the state. It is not only in this case, that BDA has turned blind eye, it is so in many cases, but, some day, the law of the land must and will prevail.
Come to terms with reality. RTC entry will not give you the titles. It is the Gazette notification, which has taken away the land and handed it to the BDA. But, there are legal ways to get it regularised and you have to pay for it and live happily and peacefully forever. You must not be made a scapegoat for the fault of others and at the same time, the state government and the statutes of the state must not be taken for a ride.
YOur statement that roads, drainage etc with good houses have been constructed will not confer any right, title and interest. you can satisfy yourself with such thinking.
The land had been acquired by the BDA and is the property of the Government, means the property of all the citizens and you cannot extinguish the rights. When the property is acquired,how did you get the titles. The katha, road, building plans based on some erronous documents will not legitimize the illegal act.
The second point is that the subject matter is discussed and dealt by Joint Legislative Committee appointed to recover the Government properties and even the subject is dealt by the STF and the report is submitted to the Government.
Please make an application to BBMP with the notification details and see the result.
It is better that you take some preventive and legal measure to safeguard the property than arguing that the property is legitimate.

We know very well that neither your parents nor you have fabricated the documents. The origin is from some other source.
You have to take a legal recourse to set it right. None of the other occupants are willing to co-operate or even contribute towards expenses. We also stay very close to this place and we deal exclusively on property issues with BDA.
Do not post more details as it is a public domain.
There is solution for every problem. It is time consuming and expensive. Any one of the resident must take active interest and run around get the thing done for the rest 99 lucky fellows.
Forget about the BBMP A katha. If the said notification is sent to the Revenue Section of BBMP, will conduct an enquiry and show cause notices will be issued. The officers will absolve all their mistakes and you will be put in trouble.
So, be cautious, in every step you take to regain and set right the title.

I have A khatha & betterment paid in the year 2003 to CMC. I also obtained plan saction for G + 1st floor in the year 2005 from CMC. I also built G floor in my 1200sqft DC converted Site at Kodigehalli, Bangalore North.
Now iam planning for my first floor house construction, As my sister got transferred to bangalore. Now Since BBMP is in force instead CMC, Now i have been told to get BBMP khatha & a new BBMP plan saction.
Kindly advice me the following points.
1) To obtain BBMP khatha what documents i should submit & what is the government fees.
2) To obtain BBMP plan saction for 1st floor, what amount should i pay legally.
3) I also paid Kaveri drinking water fees in 2005 itself.

You must obtain the katha of BBMP and then make an application with statutory fee for the sanction of building plan.
If the property does not have a sanctioned layout plan approved by BDA, it is unauthorised or illegal layout.

Any updates on khata for smaller sites in a dc converted layout. Some people of such sites have obtained “a khata” from bommanahalli zone for a 2400sq feet site not approved but converted. Can u pls let us know if they are accepting betterment charges?

The BBMP is accepting betterment charges for DC converted land(not for individual sites). Form a group and pay it and it will be easy to get it regularised.

I am looking for home loan, I my property is located near KSRP Police qtrs, Choodsaandra village, Sarjapur Main road, and my site comes under Gramtana and I tried with HDFC, DHFL, and various other banks, however all refused my request, since the plot comes under Gramtana.
Kindly advice me, if I can get a loan or not, there is no way that people like me can get any home loan. is the home loan only for the rich people in Bangalore, so that they can save there tax’s.

Yes. You can pay and get Katha for the entire land, but you might not get katha for the bifurcated land, as you have to get the layout plan approved by the appropriate town planning authority.

Generally it’s not possible to get proper BBMP khata. Please file an RTI in BBMP to validate whether it’s valid khata or not. It works easy and you get more information once you get the copy from BBMP office.
