Any regularisation or conversion of B Khata to A Khata obtained on the basis of misleading statements, suppression of material facts, false declarations, untrue statements, fabricated records, forged documents, impersonation, or any other fraudulent act should be treated as liable for cancellation by the competent authority.  Reports relating to BBMP scrutiny indicate that where `A` Khata entries are found to have been obtained through fraud, error, or unsupported documentation, the authorities may review, revoke, or reclassify such entries after verification.

         Regularisation is not a vested right when it is procured by fraud. Any municipal benefit, khata entry, endorsement, certificate, extract, mutation, or consequential approval obtained through deception remains vulnerable to cancellation, recall, reversal, or correction in accordance with law.

         “If regularisation or conversion from `B` Khata to `A` Khata is obtained by means of any misleading statement, misrepresentation, suppression of material facts, fraud, forged or fabricated documents, false affidavits, untrue declarations, impersonation, or any other unlawful act, the competent authorities shall be at liberty to cancel, revoke, withdraw, or annul the `A` Khata so issued, without prejudice to any other action permissible in law. In such circumstances, the authorities may initiate appropriate civil proceedings, criminal prosecution, recovery proceedings, penalty action, and all other consequential measures against the persons responsible for such acts, including any beneficiary, deponent, applicant, intermediary, witness, or official found involved, in accordance with the applicable law.”

Legal rationale

         This Indian law recognises forgery, use of forged documents, and cheating-related conduct as punishable offences, and case-law databases summarising the statutory position identify provisions dealing with forgery, forgery for the purpose of cheating, and use of forged documents as genuine.  In addition, public reporting on BBMP’s scrutiny of questionable `A` Khata records indicates that the civic body has examined cases where `A` Khata status was allegedly obtained improperly and has contemplated cancellation where supporting documents are not legally sufficient.

         Where a person secures municipal regularisation by producing forged title documents, fake conversion orders, manipulated tax records, fabricated betterment receipts, false approvals, or other deceptive material, the matter may expose such person not only to administrative cancellation but also to civil consequences and criminal liability, depending on the nature of the act and the evidence available.  This is especially important because fraud on a public authority affects both the integrity of the municipal record and the rights of third parties who may later rely on the khata entry in transactions or litigation. 

“No person shall claim any equity or protection on the basis of an `A` Khata obtained by fraud, forgery, false declaration, suppression of facts, or submission of misleading documents. If at any stage it is found that the regularisation has been secured through such unlawful means, the competent authority reserves the absolute right to cancel the `A` Khata and to initiate appropriate civil and criminal action against all persons concerned, in addition to such further proceedings for recovery, prosecution, penalty, or correction of records as may be permissible under law.”
