REVENUE SITES WITHIN BBMP LIMITS WILL GET KATHA SOON-GOVT

THE CABINET HAS PASSED A RESOLUTION TO BRING IN THE NECESSARY AMENDMENT TO KARNATKA LAND REVENUE ACT IN THE CURRENT PROCEEDINGS IN THE VIDANA SABHA TO REGULARISE THE REVENUE SITES WITHIN BBMP LIMITS AND COLLECT THE CONVERSION CHARGES AND IMPROVEMENT CHARGES.  THIS WILL PAVE WAY FOR THE ISSUE OF BBMP KATHA TO ALL THE REVENUE SITES AND THUS IT WILL GET REGULARISED.  THE GOVT NEED NOT WAIT FOR AKRAMA-SAKRAMA, WHICH IS YET TO COME OUT OF THE HIGH COURT.

BUT ILLEGAL BUILDINGS, BUILDINGS WITH VIOLATIONS AND DEVIATIONS TO BUILDING BYLAWS AND SANCTIONED PLANS HAVE TO WAIT FOR AKRAMA-SAKRAMA.  THE BBMP IS EXPECTED TO MOP UP AROUND RS1,500/- CRORES THROUGH THIS PROCESS.

    But the question is – will it help the bifurcated sites on DC converted land? Since the sites are already on converted land will they get “regularised under section 94c”. And will they become eligible to pay betterment charges.

    When small revenue site itself becomes eligible to “paying convertion fees” and in turn becomes eligible “to pay betterment charges”, I hope the small sites on converted land shall also become eligible “to pay betterment charges”.

      The Amendment bill has to be placed before the house and discussed before approving it in the assembly. The details will be known only by then.

    Is it just agricultural land or all properties such as industrial sites which fetch revenue are considered revenue sites?

    It looks really funny whats going on land related rules and regulations:
    First BBMP passed order for collecting betterment charges from DC converted sites and issue Khata. But a divided piece of this land is not eligible. If apartment is constructed on this land people gets khata..Rule is made to help the real estate biggies to construct big apartments..
    Secondly, those who bought revenue sites for cheap, will get khata with this new order. This is also to help the big shots who have large parcels of revenue land..

    Still nothing is mentioned about the divided /bifurcated piece of land from a DC converted big land..Really funny and strange are the ways of Law makers..

      The earlier order for the collection of improvement charges is enacted to benefit a particular section(for the entire extent of DC converted property) and this revenue regularisation will definitely benefit revenue site owners.
      Please note that the DC converted properties can still pay the improvement charges and get katha. It is not possible to collect the IC for a single property, it has to be paid for the entire area. All the residents or the owners can join together and pay it. The order is clear.

      1. This is news to me! I did not know that all owners can join and pay and then they will get individual khata?! To me the BBMp guys have always told that for layouts that are not approved by competent bodies, they are not giving a A khata for bifurcated sites. Basically there was no provision in the 7 categories for bifurcated sites on Dc converted land. Has there been any change in BBMP’s stance on this issue?

    Thanks for the info. This is news to me too.
    In my dc converted layout, the developer had already paid betterment charges and had the A-Khata for the entire land. But when we approached the BBMP for bifurcation, they say that there is no rule/option as of now to give khata for individual sites (bifurcation) because it is not BDA approved.
    There is the confusion.
    Are you sure that khata bifurcation is possible as of now? . In that case we would contact you for legal help for doing this .

      The developer has to pay IC to BBMP for the entire extent of DC converted land or else, wait for the akrama-sakrama.
      Any layout within BDA limits, if not approved, which had been amalgamated into BBMP will not get katha.

        You can pay the betterment charges for the entire and total extent of land marked in the DC Conversion order but getting A katha is difficult, as the said conditions of the DC order stands clearly violated, have to wait for modification order of the Government.
        Even if the charges are paid for the entire land A katha might not be issued.

    Whether revenue sites purchased in 2005 is eligible under this scheme. In my case there are around 22 residential houses and mine is vacant site. The BBMP is not issuing plan approval for construction of house. They said it is revenue site. If I pay the requisite amount of CC/IC, whether BBMP will issue proper khata and house building plan will be approved?

      What type of property is it? revenue? DC converted? Gramathana? Village panchayat approved? is it in green belt?
      None of the above are eligible to get A katha and if you do not have A katha, the building plan will not be sanctioned.

    It says that bbmp conversion charges will be levied upon revenue plots. After that Betterment charges will be applied. “Sources said that it is the betterment charges which will fetch the BBMP the much-needed revenue “as they can be levied only on DC-converted revenue sites”.” So am wondering if the DC converted individual sites can avail betterment charge facility when the amendment is passed?

    1.Land is in the name of owner.
    2. Whole land has BBMP A khata,taxes paid up to date
    3. Is DC converted
    4. Has BDA NOC
    5. Layout plan is approved by Gram panchat
    6. No approval letter from BBMP or BDA
    7. Land levelling is made,electric poles & cable are available partially as of now
    8. They have laid the pipe line for Cauvery water but they are telling that BBMP technical guys are testing the water pressure & will get water shortly.
    9. Tar road…they told they will do it
    10. Underground drainage is being done..can see many man holes in the layout
    11. Developers told that they are paying the betterment charges as per the recent circular issued by BBMP & hence they told they will issue A khata for all individual sites

    I would like to share this piece of information with you. Recently the govt of Tamil Nadu has enacted a criminal proceeding and immediate arrest of individuals involved in Swallowing, encroaching or making fictitios documents on somebodys land. This i heard gives absolute right to the ownership to the first title registered on any land. The police on receiving a complaint immediately arrests a culprits under non bailable offence. GREAT, against the land of karnataka which says civil proceedings running for eternity has to be initiated.What is your opinion of NILA UDAMAI CHATTAM.

    There is a land mafia operating in choodasandra area and has got hands on the revenue sites. pls go thru web article LAND MAFIA IN BANGALORE published by HINDU.You will know the names of people. Most of the lands have multiple owners. The documents will not reveal to you.Long litigations are fought in courts.Know well before you buy. There are very few sites absolutely safe ones. Wait for some time , do not hurry, i will suggest some for you. Take them to xxx xxxx and get their advice.
    Mean while also think of investing in safe and next boom places like Hosur. There are lands 3 kms from proposed IT park Nallur area being sold for Rs. 300 and 500 per SFT which are expected to double in 3 years time.

      Though the Karnataka Land Revenue (Second Amendment) Bill, 2009 was passed in both the Houses of Legislature last year, the Government has not framed the necessary rules, including quantum of penalty, to implement the scheme.

But till now the BBMP employees did not get a circular on this. Any updates on if when is this going to start.     I was planning to buy a land in Amrutnagar, Hebbal. I got a good offer from one of the owner, with all good papers of the land like BBMP A Katha (Betterment charges paid receipt), EC up to date, all tax paid receipts up to date. However this property is very near to BDA Arkavathy layout, hence i enquired in BDA if this layout falls under BDA limits. The answer i got from BDA was Yes. (SY No:93/2 falls under BDA and it is a goverment land). My question is if this land falls under BDA how can the BBMP issue A katha for this property and they are collecting taxes regularly for this land and this land was purchased by the owner in 1981 who had got loan also from canara bank. Kindly provide me details on this.

      The katha is obtained by submitting fake/bogus/declarations/ old records and misrepresentation of facts. The sanction of bank loan does not confer any right, title and interest.

    I have few general questions in regard to land related documents. Can you kindly clarify them.

    In order to Sell plot in a Layout, developers usually get the Approval from concerned authority. we will stick to BBMP for as a case of our discussion.

    Now, If the land has been DC converted and it falls with in BBMP limits. Developper should approach BBMP for layout approval
    am i correct?

    Only after approval of the Layout plan BBMP will issue a Land khata — am i right? ( developer shud clear charges levied on the land such as betterment charges) Is there a way to get Khata other than this?

    Once the land khata is issued then people can buy and get individual khatas — am i right .

    Also please let me know whether BBMP has collected Betterment charges in recent times. (I know BBMP stopped collecting betterment charges after 2006)

      Yes. It is for the entire extent of land converted and not for individual sites. If you have bought a site with A katha which is DC converted and go in for a sanctioned building plan in Mahadevpura ward, upon an application to JC, the betterment charges will be collected. Otherwise betterment charges cannot be collected. If akrama-sakrama is implemented, you can get your property regularised.

      1. Can you provide more clarification please? For example –
        1. Bigger property has A Khata (based on a affidavit and IC not yet paid).
        2. Smaller Individual site under that needs a A khata and building plan approval.
        Is this possible upon an application to JC and approval from him?
        In which case, are we saying that we need to pay IC only for the smaller site?

        Eagerly waiting for a response to know if I hve understood it correctly.

      3. The example stated was only an attempt to paraphrase your earlier reply about “application to JC”. It was only an attempt to know if there is a known accepted method to get A khata for a bifurcated site on DC converted site that has A khata.

        Hope it was not misinterpreted in any other way.

        If there is an `A` katha issued to the existing DC Converted and bifurcated site, you can get A katha by paying the IC and get the building plan sanctioned. But check, whether all the statutory requirements are adhered to, before the issuance of A katha.

      5. A khata was issued to the bigger DC converted site in 2007 without IC being paid. The A khata was issued under an affidavit that IC will be paid whenever the IC is finalised. [Now IC was finalised in beginning of 2011] We are looking for A khata for a smaller site cut out of this bigger DC converted site. For the smaller site we want to pay IC and get A khata and building plan approval. And I was trying to understand that an application to JC can help resolve his case? Does he have power to allow IC to be collected for such cases…

      6. Dear Sir,

        Who is the owner of the roads? Why should BBMP take care of private property? How can they issue A katha for properties for which they have to provide facilities at the cost of other tax payers to a private land? When it is regularised the land rights will be handed over to the Government and then the government can provide the facility. Even if you pay betterment or IC, who is the owner of the road?
        Hope you understand the reasons for not giving A katha.
