THIS WILL PAVE WAY FOR THE ISSUE OF BBMP KATHA TO ALL THE REVENUE SITES AND THUS IT WILL GET REGULARISED. THE GOVT NEED NOT WAIT FOR AKRAMA-SAKRAMA, WHICH IS YET TO COME OUT OF THE HIGH COURT.
BUT ILLEGAL BUILDINGS, BUILDINGS WITH VIOLATIONS AND DEVIATIONS TO BUILDING BYLAWS AND SANCTIONED PLANS HAVE TO WAIT FOR AKRAMA-SAKRAMA. THE BBMP IS EXPECTED TO MOP UP AROUND RS1,500/- CRORES THROUGH THIS PROCESS.

Revenue sites are formed/carved/bifurcated in agricultural lands and is an illegal creation. The land use must be changed from Agriculture to Residential. The Deputy Commissioner`s of the districts are vested with powers under KLR Act to change the use of land, it is called DC conversions.
We cannot predict the issuance of katha. You cannot sell any property without katha within city limit.

anyways, not DC converted site means, you cannot get Akhata. there is no Akhata/Bkhata as such, Khata will be given to only those lands which have DC conversion by paying better ment charges now BBMP is accepting for that , not to individual plots but for the entire layout. if you want individual khatas for each site, the layout khata has be bifurcated.

I have seen a site in Kanakapura Road. I am informed that this land(on which layout was formed) was notified by BDA for formation of BSK 6th Stage in late 90s. Subsequently, this area was released/denotified by BDA. However, the BDA has collected betterment charges. After this, a layout was formed.
Also, A khatha has been issued by BBMP now.
1. Since BDA has collected betterment charges, does this mean that this layout does not require any DC conversion ?

BBMP issues katha even for BDA notified property and that does not confer clear titles.
Please examine the whole issue(subject) with an expert and also an advocate who specialises in property related matters and check for compliance to land acquisition act, BDA and KTCP acts.

Hi, I had been to BBMP to understand if they are issuing A Khata for my DC converted site from Gram Panchayat. Thank you sir for the response. I went to BBMP office and was able to meet a revenue officer who has confirmed that they can do A-khata registration and issue a certificate if I am ready to pay the betterment charges.

I have a site no 7 in Belathur lakshmaiah layout Kadugodi Bangalore 560067. The site was purchased in 1979. It is DC converted. Its measurement is 30×48′ as per regd deed and up to date tax paid. But the site measures only 30×40′ as it is encroached on one side for about the whole length, Almost all sites have undermeasurement. In the meanwhile I was able to get a khatha from BBMP Mahadevpura. I am told by the BBMP officials that it is an A khatha and no betterment fee payable on it. Now I have put the site for sale at Rs 3000 per sq ft. But the mediators are seeing that nobody purchases the site and they are propagating it as B khatha. How to know whether it is A orB khatha? What is the present rate per sq ft in the area?

We do not know what kind of katha you have and hence cannot comment. Go to BBMP and Check with ARO. The price in belathur is around Rs1000/- to Rs3,000/- per square feet depending upon the location.
The buyers will pay for the actual or physical size and not for the extent on the documents.
Do not worry about agents. They are the same worldwide.

No betterment fee is payable if there is no building construction and that I can apply for a plan sanction if I am going to construct. Also since there is variation with reference to the extent of site is there any way to confirm whether I am eligible for the extent of land transferred to me in the sale deed. How to get the encroachment cleared and to get the land transferred to me in the sale deed. Is there any govt action that can be invoked?
My mother inlaw having a property at 4356/8,3rd cross.Subramanyanagar Rajajinagar II stage Bangalore560021 died on 04-05-1998. Up to date tax was paid in her name under PID no9-20-8. Her only daughter that is my wife has applied for khatha transfer with ARO Malleshwaram with his no1487/2005. pending for over 6 years. In reply to RTI the ARO has refused to collect the improvement charges payable at Rs50 per sq yard but is asking a reconveyance deed and a PC from BDA. This was applied on 25-07-2011 moved by an RTI on 29-09-2011 for which a reply from BDA recd as its registers are blank no information could be supplied. Unconvinced I have moved an RTI appeal to BDA commissioner dtd 17-11-2011 which is yet to be replied. Meanwhile emails to BDA commissioner are unanswered those to CM are promptly forwarded to BDA for action without followup or time stipulation to settle the case. It is already 7 months and no action. Meanwhile the case worker at BDA when contacted on 24th of february2012 is of the view that our property number has to be reconveyed as 4354 whereas 4354 has already reconveyed to my neighbour. Actually that property should have been reconveyed under no 4353 which is missing. It is not known how BDA reconveyed the property under no 4354 without spot verification or reference to its own map of the area. I am planning to purchase a property near Ramamurthy Nagar. From sale deed i came to know that this was an ancestral property of Mr. X who sold it in 1988. I don’t have the family tree of Mr. X’s father. It is being nearly 23 years now and it is a vacant land. My question is whether is it possible for any of Mr. X’s siblings to claim this property now? Is it safe to buy this property? I have RTC and EC from 1966 till date. From 1966 to 1988 RTC and EC records Mr. X being the property owner.
Also i have a generic question apart from the above. Is there any ways one can know if there are any court cases (which is not stand) going on the property? Does any property document record such things?

Please check your documents. If you find DC Conversion order in your preamble or recital in the sale deed or a copy of the DC Conversion order, in which your site is located or in which this layout is formed, then it is a DC Converted site, otherwise it is revenue site. Please check with your neighbours about the katha.

all revenue site holders in bangalore should form an association and put up a joint fight.
If the fate of the bangalore city cooperative housing society ltd., is any indication to the fate of the BDA approved layouts ( http://www.advocatekhoj.com/library/judgments/announcement.php?WID=1784 ), which made the owners of this BDA approved layout to go and beg the original land owner for negotiation of site purchase at current market price. The tragic part is that these are sites which they already own and houses constructed.

The moral of the story is that BDA approval is not everything. This is the fate of private layouts with BDA approval. Now examine the fate of sites directly allotted by BDA. We can recall the story of sites alloted which later turned out to be Turahalli forest land and so Forest Dept was given back that land. The news story told that the allottees were given alternate sites elsewhere. However we heard nothing about the money spent for constructing the houses there and compensation if any for the loss of the same by BDA. Ofcourse the dislocation and the mental agony is something for which the individuals have to fight separately. I think the sufferers should come forward and post their stories.

Thank you very much for the above reply. In the larger interest of public the Govt. should strictly implement this rule and take back the site if the allottee does not construct and self occupy within this time. This way a large number of sites will become available to the needy public and this will bring sanity into the otherwise insane price of sites in cities like bangalore. One can see large number of empty sites of size like 4000 sq.ft. in places like Yelahanka New Town,bangalore that were allotted some 30 years ago. The owners (allottes or later buyers) are now sitting on super gold mines because such a plot can now fetch nearly 2 crores. Most of the present owners of such plots are not the real needy persons. Similarly one can see nearly 90 % of sites are still vacant in layouts like Anjanapura that were formed more than 8 years back. Instead of setting right this anamoly Govt. goes on notifying the other land to form new layouts. Once an area is notitied, the persons who already has constructed houses live a long period in terrible fear of their land being taken away by BDA. Also others can not sell land once notified. To add to this Govt. has added surrounding villages into BBMP. The sites that were formed previously are now castigated as revenue sites because Govt. is unable to collect conversion and development fee. In contrast the BDA and KHB sites glitter as though they are holy whereas they are also equally unholy except that the Govt. has FAILED to act strictly. If the vacant BDA and KHB sites are taken back, Govt. need not form any new layout and needy persons will get sites at affordable rates.
The strict implementation of the rule that houses should be constructed and self occupied within 2 years of allotment will prevent persons applying for allotment for investment purposes. A large number of applicants are investment oriented. Land should be a commodity of investment. Land is like mother.
sorry, the last but one sentence in the previous post should read as ‘ Land should not be a commodity of investment’.
some good Samaritan must think of filing a PIL in the court to direct the govt. to take back sites that are not self occupied within the stipulated period.
