City Municipal Council Sites

There WERE 7 City Municipal Councils and one Town Municipal Council surrounding the Bangalore city. The sites in the limits of these authorities are mostly owned by private individuals, some of the sites are acquired by Government. Infrastructure is very poor. The process of tracing the title is very complicated. But some extra pre cautions need to be taken. Verify whether the betterment charges have been paid, if not purchaser may have to pay it in the future. Many lands in the area of these local bodies are agricultural lands and conversion to non-agricultural purpose must have to be done. Presently City Municipal Councils have stopped collecting betterment charges and issuing Khatas. If the owner doesn’t have a Khata, he cannot construct the house with the plan approved from CMC.

Site in private layouts

These are layout formed by private parties, other than statutory development authorities. Many reputed land developers have formed layouts around the city. Verify all the documents as required in case of private property for a period of 43 years. Apart, from the above check whether the land is converted for residential purpose, and the layouts are approved by BDA or BMRDA. Verify the records with respective offices. Many numbers of private layouts with D.C. conversion and panchayat approval are available. Purchase of these type of sites involves little risk.

Gramathana Sites

These are residential sites, which were originally available in village panchayat areas. They can be distinguished from Kaneshumari number, assigned to them. The agricultural lands have survey numbers. The sites of this nature are very few. Government has put restrictions on issue of license for construction by village panchayats beyond their approved Gramathana area, original Gramathana sites can be identified by examining old village survey maps available in survey department. Examine all the records as is done in case of private property. In addition verify the village records and form No. 9 and 10. Form No. 9 denotes Gramathana site and form No. 10 denotes the building, which confirm that the particular property is original Gramathana site or not. But many village panchayats issue from No. 9 & 10, though they are not Gramathana sites. Many such sites fall in green belt area, where construction of residential buildings is restricted. Extra caution is necessary while buying Gramathana Sites.

    I’m planning to buy a DC converted site under village panchayat. Our advocate scrutinized all the documents and he had informed me that all the documents are ok for registration except new form of kahata. I’ve Form 9 & Form 11.
    My question , is it really required to have new kahata Form 1 & 12 for registrations village land . Please reply me at the earliest.

        I have site in DC converted layout and recently got A khata.
        My question is:
        1)If one is not going for home loan, then is it really required to get the plan approval? Usually plan approval will be based on the set backs set by BBMP but our working plan will be usually far diffrent then sanctioned plan. In that scenario what is the use of plan approval?
        2) Are there any other reasons /difficulties for which one should get plan approval? Will there be any work stoppage from BBMP officers when some one start construction without any plan approval?
        3) Do we need to pay better ment charges in future even if we construct house with plan approval? Plan approval costs atleast around 30,000 Rs considering the area is around 30Square.
        4) Are there any concesion during akram /sakrama or while payig betterment charges (if any in future) for people who have constructed house with plan approval?

Now if the developer has given all basic eminities like tar road, water, electicity etc. Once we apply for BBMP khatha, If BBMP gives us ‘A’ Khatha my question to you is should we have to pay betterment charges in the later date.

  3. I want to buy a land in halayakanahalli village limits, Sy no 72. Seller is saying that the registration is currently stopped. I should do GPA and register the GPA. I want to know, why I can’t register. What is exact govt order stopping registration and what is the extract in it?
    What is risk in buying the propery on GPA. I know one risk that is owner should genuine. Is there is any other risk apart from this?

    I purchase one site in East bangalore. I got the GPA registered. I’m about to register it now. I visited the registrar office and they are asking for Khata. I went to the Punchayat office to get the Khata. The Khata was not there on my Landlord’s name as well. So, to get register my site i need to get the Khata on my landlord’s name. Can you suggest me the below things.
    1. Is it the reposible of my Landlord’s to provide the Khata on his name. So that i can transfer that to my name.
    2. I have enquired the guys over there in registrar office and they are asking around Rs30000 to get this Khata done on my Landlord’s name.
    3. Moreover the guys in registrat office are asking of (9) O (11). But in panchayat office they are saying they will give only form 11.
    Please suggest me, what should i do. I am very confused.

      We cannot suggest you any measure without proper verification and scrutiny. The titles may be good and without examining it, if we pass a remark, based on the remark, if you do not buy it, you might loose. Hence, it is advisable to scrutinise the documents in the light of KMC ACT, KLR ACT, LRF ACT and KTCP Acts,based on the reports and opinion, a decision may be arrived at.

    1) I have a house constructed in a layout near hegde nagar (Nagwara) since 2001
    2) The layout is DC Converted.
    3) All the years I paid tax to Panchayat….and with Panchayat getting dissolved I started paying it to BBMP for past 4 years.
    4) I have panchayat khata that was given to me from the initial days.
    5) EC for past 20 years which finally reflects my name.

    I need to know :

    1) What is this B-Khata of BBMP ?
    2) Do I need to avail this Khata , as I do not intend to sell my property?
    3) I am planning for a Gift Deed of my property…. hence I need to know if this B-Khata is mandatory ?

    I had purchased a flat at Hebala, Everthing Like Plan Approvals, Katha from BBMP, EC sctrinshed from 1985 to till date. And i got loan from IDBI Bank. After a year now BDA is telling the portion of the Land is already acquired by BDA. Now I am receiving a fake notice without signature or Seal of BDA.

    If it is in BDA Means, is the land will reflect in EC? Give a suggestion.

    Now what are action to be taken from my end

    All your statements are frivolous and irrelevant. Because some stupid banks financed the buyers and is not the duty of the BDA to inform all the ignorant buyers. You were dependent on the builders advocate and end up like this.
    It is up to you to find out. If you had not, this is the result. You must have availed the services of an expert for all your queries, even before your purchase. Misrepresentation of facts or wrong declaration or fake documents might have been produced to BBMP. Based on other things, the BBMP might have issued the katha.
    This is the beginning. There is a long way to go.

  9. How to Differciate between A Khatha or B khatha of BBMP. How to know weather the khatha that you have received from BBMP is really a A khatha or B khatha ?? do they have different form Nos ??

    I am planning buy a site in North Bangalore from a reputed developer. It come under BIAAPA. Developer has an agreement with landlord for development of layout and marketing of the sites. An advocate opinion is available stating the land is DC converted (in the year 2005), having gramthan khata and has right & marketable titles.
    However, the developer has not gone for BIAAPA layout approval. Landlord has paid upto date taxes on the converted land. We also enquired in BIAAPA that the land (village) is not presently fall under any acquisition / notification.

    How secure & safe is to buy such sites, in the absence of BIAAPA layout approval.

    I am planning to buy site which is DC converted at Sompura gate Sarjapura. The entire area has 80 plots on it. Owner has not obtained approval from govt authority like BDA, BMRDA etc..
    Will there be any problem in future since it’s not BMRDA approved? Please advise.

    I have selected a house for buying. The site on which house is constructed comes under BBMP limit and owner has a BBMP Khata. Problem is this property does not have DC Conversion paper. Owner of the property claims that once BBMP khata is obtained, DC conversion papers are not needed. Is this true? He has also got Endoresment from BDA (in 1990) that they don’t have notification.

    I am interested in buying an Independent House located in KR Puram under BBMP limits.

    This property has B Katha and No Building Plan available. So, No Nationalized bank is willing to give loan on this property.

    The owner says, he can help in getting a loan from a private bank and we can pay the betterment changes later to get A Katha.

    Is it good to buy such properties?
    Are there any chances that the owner might have sold the property to multiple peoples?
    If I go for lawyer verification would that really bring out any issues with such properties?

        I also have found one property in Kushal layout which also has only the B-Khata and mother deed only for 19years. The current owner has EC and other documents and says that we could get the A-khata once the government announces. I have given all the documents to an advocate for verification. Is it safe to go for such property & blindly drop out the plan???

  17. I am planning to buy “Telecom Aero Park Residency” is situated on Chapparkal Main Road. Last week, been to site visit, and found that it is from “BSNL Housing board”. As of now, the layout doesn’t have the BIAPPA approval. I guess, BIAPPA is totally different from BDA/BBMP. Since this is from society, is it safe to invest here?
    And there is no we can get the documents set from them for verification. We can only book for the plots.

  18. Hi Sir,

    Need help on the khata transfer fees to be paid. The property is under a Village Panchayat and the fees being demanded is Rs.5,000 for a 60×40 site in Mysore under Bhogadi Village Panchayat limits.
    The panchayat officials on being questioned advised that the village panchayats can change the khata transfer fees whenever they decide. I was shown a document of the last Village Panchayat meeting and the resolution being passed to increase the khata transfer fees.
    Have a couple of questions –
    1) Is it true that the Village Panchayats can fix the khata transfer fees as per their wish?
    2) Is there no governance or pre fixed rate on the fees that they can demand from the public for khata Transfer?

      NO. The village panchayth does not have powers to fix it.

    I read from the comments above that on B-Khata, nationalized banks such as SBI doesn’t give home loans. I’m interested in a BDA approved project, second sale, but as the owner is in a hurry and A Khata would take sometime(1 month –not sure??) and has B-Khata;
    1. Can you confirm if nationalized banks would be able to give home loans or is it mandatory to get A-Khata and only then apply for loan?
    2. If required, is it to be given during intial paper(for loan) submission or can be given at later point(3 weeks)?

      BDA approved sites will not have B katha. They will have A katha.
      You are being misled.
      Check the documents very carefully.
      Bank loan does not confer you the right, title and interest. The loan is sanctioned to you based on your credit rating, age, job, income, savings, salary and take home salary. It is a collateral security, in case of default. The bank loan is not free. You have sign 100 of pages and 100s conditions. You live there but the original owner is the banker.

      1. Ohh, I was under the impression that B Khata can be received in A Khata issuable region also, so its mutually exclusive that, either BBMP will issue A or a B Khata.

        B katha is not a katha. It is a form, issued for having paid the taxes under the taxation act of 2008 and the bbmp has maintanied a register and enter all the details of the taxes paid.
        Katha is declaratory document,stating that the property is situated within its administered jurisdiction with details regarding the ward and boundaries of the property.

  22. Dear Sir, I bought a site measuring around 4000 Sqft.@ Survey no.29, Attur Village, Yelahanka in Sept.1995, layout formed by a builder. Since it is a Revenue plot it is to be regularised by BDA (Akrama-Sakrama). Many of the allottees have built houses on these sites.I have been paying the tax regularly in BBMP till 2011-12, obtained B-khata and EC from June 1989 to Feb.2011 (21yrs).
    Kindly clarify for the foll. doubts:
    1.Is there any complication reg. ownership of the site? since it is not yet regularised. Is B-khata an authentic document for the ownership?
    2.I am worried, as somebody told that this plot has been denotified. whom shall i contact to verify this shocking news.can I get this information through Internet? Kindly help. Regards.

    I purchased a 30×40 site in a DC converted layout in Horamavu about one and half years back. The layout plan is approved by panchayath and it is not BDA approved. I got the titles verified by a lawyer and IDBI bank was funding this project and hence I went ahead with the purchase.
    Now I want to construct a house in the site and IDBI has stopped issuing loans for such layouts (dont know why the rules changed) and they are asking for building plan approval which I cannot get since I dont have A khata for this site (although the entire layout as one entity has A khata). I’m thinking of going for personal loan and use my savings to construct a house. What is risk involved ? Somebody suggested me to get a fake plan approval document (through agents) and submit it to the banks to get loan sanctioned. I heard that even some banks encourage applicants to get such fake building plan approvals, just to have a namesake plan approval document. First of all, I want your views on the risk involved in construcitng house in this site.

    Also, the layout has the basic facilities and houses have already come up in the layout and people are residing there. BESCOM has provided electricity also. I wonder what kind of approvals does bescom look for.

    we have recently bought an house in Bangalore ramurthy nagar. and is ready to occupy.
    we have taken a home loan in national bank. we have invested a huge money.
    the layout is DC converted but not layout is not approved.
    in 1990’s only the first owner has done GPA to some person and he has cancelled it also, but in 2005 he has sold it to 2nd owner, and 2nd owner has done DC conversion and sold it builder ans from him we have taken, the tree looks clean, no where in RTC, EC and all the GPA is reflected.
    but now few people has come and they r telling GPA holder has sold the sites to us in 1990 only and they r showing some documents, they r having different layout in which our house is coming on the road.

    what we have to do now, please tell me

      SANCTION OF HOME LOAN WILL NOT CONFER YOU THE TITLES.
      Just, because, you have availed the loan, how can the titles be clean? Then everybody would have borrowed from the banks on all properties.
      GPA Transaction is always dangerous.
      You have to consult an advocate specialising in property matters and take immediate action, before your opponent obtains any court orders or decree. The persons who have claims or purports to have bought have to be verified and their documents must be examined. This is the tragedy of the GPA Transactions. Many GPA documents either revoked or sold or entered into sale agreements with many buyers. Generally the GPA`s are notarised and not registered. A GPA, to be registered will attract stamp duty and registration fee, in order to avoid it, the fraudsters, notarise and sell the property to many unsuspecting foolish buyers. During the course of our investigations, we have found that majority of the GPA`s are fake. Due care and diligence is needed to buy a property on GPA.

    Layout Builder said it is having B form and all documents clear.
    Layout is having already 100 houses and 90% of the sites are purchased.

    He can also get some Bank Loan from XXX Bank(of-course not in legal way),if BBMP take Betterment charges in near future is it safe to purchase this type of property?

    A 50 x 50 land in Begur area is bought by me and my brother in law. We got it registered with dimensions 25 x 50 each. Both availed a loan from IDBI. We want to process khata transfer and the ARO indicated that bifurcation is not allowed now. However, he said, he can transfer it to one person’s name. What are the options in front of me to make sure I have all relevant legal rights on the land? Is getting a B khata good enough for me. I have no plan of constructing house on it in recent future. Also, is it ok for me to pay tax on previous owners name (khata shows his name).

      B form is helpful for the sale. If you can wait for some more time, Once the akrama-sakrama scheme is operational or BBMP or Govt comes up with conversion in BBMP limits, you can pay charges and get it regularised. HOME LOANS WILL NOT CONFER YOU ANY RIGHT, TITLE AND INTEREST. AS OF NOW, if the property does not have conversion orders and approval from the appropriate town planning authority, it is considered as illegal or unapproved layout. The RBI has given clear directions and instructions to all the banks not to finance revenue and unauthorised and unapproved layouts. Inspite of the warnings, these banks are acting illegally. Please complain it to the RBI and will initiate action against the BANK.

    We are planning to buy a site in a gated community near KR Puram. The site is not BBMP or BMRDA approved and still comes under Panchayat, so banks are not giving loans for this site. However people have got loans with panchayat approval and constructed the houses in the plots 5 years back, but now loans are not ebing given.Let me know if you see a risk in buying the plot in this layout. There is a layout right oppoiste to this layout which comes under BBMP, but this particluar layout is still not DC converted.

    for example, A has a 60* 50 site , out of which eastern portion of the site 30*50 has sold to B. In this case, B will only have the saledeed regarding the new eastern portion of the site??

    what are the actual documents will be given to B as part of this partition and what documents A will hold newly as he already sold half of his site.(i mean what A will have to show that he has sold half of the site he was holding earlier) in terms of this partition?

    Can you confirm any bank can offer loan for such houses which are in panchayat limits.

    I hope documents are clear as SBM is selling it.

      Dear Sir,
      We do not have details regarding the banks which offer loan for this kind of properties.
      Please check with an advocate regarding the titles and compliance to KLR, KMC, and KTCP Acts, before you bid for auction.
      Sanction of bank loan does not confer right, title and interest. Banks have sanctioned loans for 100% violation and DC converted sites and Gramathana sites, which are not eligible as per RBI directions.

  35. Hi all, we need some expert opinion at the earliest. We really appreciate any info that you can share on this matter….

    We have finalized one residential site which is approved by BMRDA and we are in the process of getting it registered in some time. Last time when we visited this site we thought we should measure it once to be confirmed. When I measured it, i was surprised that the site is less in dimension as said in the papers. The paper says that the dimension is 30X40 but the actual size is 30X35. Do you see any problems if we proceed? We are planning to go for Bank Loan. So will there be any problem with respect to size?

    If it creates a problem, can you think of some corrective steps or procedures?

    I am planning to buy a plot near Ramamurthynagar. Land Developer is having 30×40 sites with DC Conversion and BBMP Khata B.
    He is asking for Advance Ammount in order to book the land and then he give the papers for verification.

    I want to verify the documents through ECOPACK. Please clarify following Points:

    1. I can pay him the advance and get the papers for verification?
    2. Can I build the House on Khata-B Land?
    3. Can I get the Loan from Banks for Khata-B land?

    Hello Sir,

    I have purchased 30X40 site at Malathahalli Bangalore-560056. It is North Face site.

    The land was acquired by BDA. Owner of the land fought with BDA in court and took the land back. Now they made sites and sold to people.

    I took the plot in 2005 and paid tax up to date. However, I do not have Katha as Government stopped process katha.

    I have constructed house and couldn’t complete because of shortage of money. To complete the construction I may require 10 to 12 lacks.

    Now, i am looking for loan can you help me out how i can get the loan and where i should consult.

    I do not have:

    1). Katha Certificate.

    I am a salaried employee. My site dimension is 30X40, located at Malathahalli Bangalore-560056.

    We have constructed house with me and my father savings. Now we do not have enough money to complete the construction.

    I am looking for housing loan. Is there any possible way to get the loan?

    Do you have any idea when this akrama-sakrama will scheme will be in operational.

    What could be the amount that we need to pay?

    I have constructed 3 floors. Ground floor, 2nd and 3rd (Duplex). I have left setback around the building according to the government rules.

    I did not have building sanction from BBMP/BDA because i was not having Katha.

    Please help me if i can get loan to complete the house.

    I have purchased a residential land in kawdenahalli in rammurthy nagar area(30X40).

    i have got documents from the owner like sale dead,mother dead,EC from 1989 to till date, A-Khata certificate,Khata extract, up to date tax paid receipts,betterment changes paid receipts and water connection changes paid receipts for the land.
    I am having some confusion(doubts) here like

    1) do we really need DC conversion certificate and NOC
    from BBMP(BDA), even though betterment paid and
    having the A-Khata for the property?
    2) Let me know that do i need BBMP approval for
    constructing G + 1 residential house in that property?

    3) do I need to get RTC, IL, RR cirtificates ?

    4) is there any way to track if there are any legal issues
    going on with the above available documents.

        DC conversion is needed for the change of land use and Katha is a document issued by BBMP of your property details in their revenue records. You need both of them.

    Kindly help. We had purchased a plot of land measuring 60×40 in BCCHS layout which is a BDA approved layout. I have with me all the original documents except the Khatha. The BDA have issued Khathas to many members long ago and since there was a dispute between the promoters and BDA they stopped issuing Kathas. Now I am stuck. I bought this plot way back in 1987, still no Katha. Can anybody help me in getting the Katha? Or as to how to go about getting it. Thanks.

    We are purchasing a site in BMRDA/NPA approved layout on Nelamangala road. This layout was formed in the year 2005 and we will be purchasing this site from an first buyer. Documents seem to be okay and they have NPA approval letter, with BDA NoC and Pollution board clearance, but with Jilla Panchayat/Gram panchayat Khata as the taxes are paid to Gram panchayat.
    When I approached HDFC last week, they were doubtful about the Khata and they were asking when I have a Khata certificate like BDA or BBMP. But I didnt have anything as such. So, great if you can help me understand what type of Khata should one have when I am going for BMRDA site? Will there be any problems with loan processing if I dont have BDA/BBMP Khata?

    1. Dear Sir,
      The property is located in Gram Panchyat area and you will get the katha issued by the Grama Panchayat only. Please convince the bankers that there is no other katha available.
      BDA is a planning authority and if the property lies within the BBMP jurisdiction, BBMP issues the katha certificate.

    We are planning to buy an individual house in 30*40 site in Varanasi Mn road near Akshayanagar,it has B Khatha and upto date tax paid but does not have building plan approval and DC Conversion. it does not come into any layout, Land lord divided his land into sites and sold them. just a small drawing shows the entire land with partitions but has regd seal and signatures.
    Is it safe to go ahead with B khatha?
    Will we not have any issues in future?

    I am planning to buy a site (plot-30X40) in whitefiled.
    actually the owner is diving his large site to 3 equal 30X40s and selling.
    The site has only Mother Deed and sale deed, some other history docs.
    He says he will pay the required taxes and get the B-Khata certificate.
    This is not D.C converted. I am going for loan.
    I have the following queries.
    – How safe is to purchase the land? because it is not D.C converted.
    – Is there any docs required to get before he split the land and sell them
    – Can we get A-Khata instead of B-Khata without D.C Conversion.
    – For construction, do we need to get plan approval from BBMP.Can we
    get approval from BBMP for these sites.
    -Can we get loan (for site and construction) from banks for these sites.

    Reques you pls answer my queries as am in confused state.

    Currently we are planning to buy a flat in Roopena Agrahara, Bommanahalli on second sale from an apartment owner. If falls under BBMP area and has BDA NOC.

    From documentation perspective, We have collected all the mother deed docs,sale deed, floor plan, site plan, Uptodate EC (backing upto 15 years), uptodate tax paid receipts etc.

    Following are my queries:

    1. I am not sure if it is D.C converted (Can you please let me know how to check this?)
    2. No Katha on the owner’s name. ( He has just given us the B-Katha)
    The builder of the apartment has a katha certificate in his name. Also we have the receipt, where the builder has applied katha for all the apartment owners some 3 years back.
    Till date none of the apartments owners have got Katha in their names due to the existing issues in Katha issual.

    Is it safe to proceed in this deal with just the B-Katha. Or should we insist him to get the original Katha before entering into sale agreement?

    3. Also how easy is to get the Katha on our name after the sale, if at all we are proceeding with just the B-Katha?

    Your suggestions/ opinions for the above queries will be highly valuable.

      It is only issued once.
      All illegal property details are entered in B register and a Form is issued. It will not confer any right, title and interest. Bank loans are not sanctioned for these properties, some banks with fraudulent means are financing at higher rate of interest. Building plan will not be sanctioned for this kind of properties.
