City Municipal Council Sites

There WERE 7 City Municipal Councils and one Town Municipal Council surrounding the Bangalore city. The sites in the limits of these authorities are mostly owned by private individuals, some of the sites are acquired by Government. Infrastructure is very poor. The process of tracing the title is very complicated. But some extra pre cautions need to be taken. Verify whether the betterment charges have been paid, if not purchaser may have to pay it in the future. Many lands in the area of these local bodies are agricultural lands and conversion to non-agricultural purpose must have to be done. Presently City Municipal Councils have stopped collecting betterment charges and issuing Khatas. If the owner doesn’t have a Khata, he cannot construct the house with the plan approved from CMC.

Site in private layouts

These are layout formed by private parties, other than statutory development authorities. Many reputed land developers have formed layouts around the city. Verify all the documents as required in case of private property for a period of 43 years. Apart, from the above check whether the land is converted for residential purpose, and the layouts are approved by BDA or BMRDA. Verify the records with respective offices. Many numbers of private layouts with D.C. conversion and panchayat approval are available. Purchase of these type of sites involves little risk.

Gramathana Sites

These are residential sites, which were originally available in village panchayat areas. They can be distinguished from Kaneshumari number, assigned to them. The agricultural lands have survey numbers. The sites of this nature are very few. Government has put restrictions on issue of license for construction by village panchayats beyond their approved Gramathana area, original Gramathana sites can be identified by examining old village survey maps available in survey department. Examine all the records as is done in case of private property. In addition verify the village records and form No. 9 and 10. Form No. 9 denotes Gramathana site and form No. 10 denotes the building, which confirm that the particular property is original Gramathana site or not. But many village panchayats issue from No. 9 & 10, though they are not Gramathana sites. Many such sites fall in green belt area, where construction of residential buildings is restricted. Extra caution is necessary while buying Gramathana Sites.

  1. hi.. need help.. i and my wife are wanting to invest in a site that has all the docs ready but there is no BDA noc or DC conversion done..There is how ever, BBMP KATHA and uptodate tax paid reciepts.. can i buy this prop and also most importantly it is within the arakavathy layout…the bda does not clearly give me the ans i want to hear. ..they said that there is 1 acre that is not under BDA aqusition and if this site is within that area i can buy it… PLEASEEEEEE let me know how i can find that out…

      Dear Mr.Madhoo,
      The documents must be scrutinised and details regarding notification and de notifications(if any) should be examined before the purchase.
      Tax payment does not entitle or ensure the proper conveyance.
      The mother deed should be thoroughly examined and all the relevevant sketches, drawings or maps should be scrutinised to arrive at an opinion.
      It is difficult to advise you without proper study and is not wise. The property might have clear titles, without proper examination, if a report is placed to you, would be wrong.

      1. we are planning to buy an house in akshaya nagar… we have paid advance and taken the documents for review.as per our lawyer some of the documents are made fake.
        our loan agent is tell Bkatha and plan is made only for loan approval purpose and these are not original.
        we will be getting loan from some unrecognised bank….

    I am looking out for a gramathana site (so claimed by the seller) and seek clarification on the following aspects. I would be grateful to you if I get this information.

    1. For a gramathana site, what are the documents to be verified?

    2. How to know whether the site comes under yellow belt or green belt?

    3. How to know who is the current owner of the site. Will Panchayat Khata reveal this information?

    4. tax paid receipts – whether the owner of a gramathana site has to pay any tax? and if yes, to which body he/she has to pay that tax. Will i have to get these tax paid receipts from the seller?

    5. If it is a gramathana site, then is it mandatory that it should be within 200 meters from the village panchayat? Otherwise, Panchayat has no right to issue any khata or any other approval (like house plan)?

    6. Can the owner of a gramathana site take home loan with panchayat khata and Panchayat sanctioned house plan? If Panchayat Khata transfer is not enough, what are the documents that will needed to get a housing loan from a bank for a house to be constructed on that site in future? Who has to sanction the house plan?

    7. Is it required to trace history of the site for past 43 years if it is a gramathana site?

    8. Is it possible to verify whether a gramathana site is registered in the land survey department to check the real owner of the site and the real survey number that will be included in my sale deed?

    10. The land owner is actually having a big piece of land out of which he is selling sites of various dimensions to various people. However, individual site dimension is not marked before selling. Once I tell him how much dimension I need, he accordingly specifies it in the sale deed. Then, how do I get my site partitioned from the entire piece of land. Do I need to apply for partition deed in the land survey department after it is registered at the sub-register office and sale deed is obtained?

    11. If this site comes under BBMP limits later, what documents will BBMP look for to obtain BBMP Khata transfer? (so that I can ask these documents from the seller now itself)

    I agree that these are too many questions. However, answers to these questions will help me decide whether constructing my dream home on this gramathana site is a wise decision.

    my client has identified a property and has decided to proceed with the conversion of the said property. the property is situated in Ramagudinalli limits (near Varthur,whitefield) and has form 9 and 10.

    the conversion process has been stalled by the DC because of no Podi bieng done how do we overcome this as the layout has other properties on it and all of whom are not ready to convert.

    please advise as to how do i overcome this.

      I regret to state that we are not aware of conversion laws in the state of Maharastra. But, generally, green belt in rural areas can be converted, provided they do not fall under valley or stream or any sensitive zones. You have to check with your district administration and town planning department.

    I have purchased a site at Yelenahalli, Bannerughatta Road and registered the sale deed in 2005. Now I want to construct a residential house. The site earlier was in Gram panchyat and now it is under BBMP. The village panchayat has given endosement that the sites are meant for residential use. BDA has also issued notification stating that these sites are not earmarked for any developmenal activity. Now, if I apply for plan approval to BBMP. whether I will get plan approval from BBMP? I have paid up to date tax regularly. Please advise me how to move?

      The property must be converted for residential use by the DC and not by the panchyat. Their endorsement might not be valid. The layout plan has to be approved by the BDA to give proper effect to the order.
      Do you have proper katha from BBMP?
      Tax payment does not mean that all the aforesaid statutory requirement waived.
      If you have regular katha from BBMP, the plan will be sanctioned.

    I’m interested in purchasing one site near K R Puram, I got the documents pertaining to the site and it is having CMC Khata. Owner said site earlier comes under CMC and now under BBMP. They dont have BBMP khata and approval plan.

    Is it safe to purchase this site? I’m not sure whether banks provide loan if there is no BBMP Khata?

    We chose to buy a constructed house from builder in akshaya nagar in ramamurthi nagar.
    The layout has not been approved and not DC converted.
    we went for legal opinion from a lawer regarding the proeprty documents(mother doc, sale deed, B katha, katha etract, building plan, EC,..). Got the feedback that the title is clear and we can go ahead but we should be aware of the fact that since its non converted we can get it regularised only after akrama sakrama.

    Regarding loan builder/broker were telling that we can get the loan from IDBI since the neighbouring house at same stage got loan through same bank recently.

    So we went ahead with a sale agreemnt paying 5 lakhs.

    After that we went to th bank IDBI for loan and came to know that they have stopped processing loan for non-converted land from august 1st onwards.

    Builder is suggesting that he can arrange loan in same bank through agent provided we are ready to pay 1% commisson.

    Now we are in complete confusion whther to go ahead or back off and if there is any possibility of getting loan in any other bank directly, when akrama sakrama might come and so on…

    Can you PLEASE provide your valuable suggestion .Thanks in advance.

    i’m purchasing a porperty at halanayakanahalli varthur hobli in BBMP limits about 3 acres 24 guntas which has been converted duly way back in 2005 and has a BDA NOC through single window scheme at the same time it also states that the proposed land in in hi-tech zone, i would like to know if this comes under BBMP limits as the owner has no records of BBMP taxes paid but only gramtana taxes where as people in the area claim it is now under BBMP limits

Now when i try to get a B-khata for the portion for which I purchased they are saying they will no issue another B-khata since it is already issued once. Can you guide me on this ?     I am planning to buy a site in attur layout and it is a vacant site(plot) and size is 30×40. For this site there is bank(IDBI) loan available and as per my enquiry this bank has provided loans for few sites in the same area. They have certified as clear titles and hassle free property. I have two queries ie., if the bank approves can we take it that this is hassel free and clear title properties and the second query is does this muneshwara layout of attur falls under BBMP limits also can i get list of documents that i should look during the sale deal of this property.

      Please examine and scrutinise the documents, which you have. Check whether they are genuine or fake. Check whether the sale deed executed in your favour is subsisting or valid or not.
      Consult an advocate and then initiate or reply to the notice. If it is a government land, though, you might have built the house, will be taken away. You can make a request to the government to allot the same site and agree to pay the price for it. There is no other recourse to this kind of activities.

        None of it will ever confer you the right, title and interest. If paying KEB bills, would ever give the right, then, everybody would have been the owners. Tax is paid for the service provided(road, sewage, street lights etc) and will not confer you any titles.

    I am planing to purchase site, Site is DC converted. Documents verified with advo he told title is clear and told me to check other litigation.

    Earlier Idbi bank was funding for the sites in this layout, but now they stoped. And they giving reason Conversation is not proper seems.

    My question how to verify the DC conversation is proper or not?

    And if it is not Dc converted then it will br revenue site ? This is come under akram skaram?

  20. A developer is offering Gramathana Land as sites in Maranahalli, Hennur Road, in Bagalur 5 kms before the Int Airport from Bangalore and about 3 kms from DPS School. He says that since there are 2 villages sourriunding the 41 acres of land it will not be acquired. What he is saying is it right or is he misleading the general public.

      Gramthana means any property within periphery of 200 meters from the village boundary. We do not know the location, boundary and cannot make out anything out of the details provided by you.

      Please read the Government Order:
      It reads thus:
      Rural Development and Panchayat Raj Secretariat

      CIRCULAR No. RDP 124 BAC 90, Bangalore, dated 19th April, 1990

      Sub: Comprehensive Development Plan of Bangalore—Re-vised Green Belt—Maintenance of—Revised instructions.

      1. In Government Circular No. RDC 31 MIS 84, dated 20th August, 1984, it has been directed that the Village Panchayats located within the areas in the revised ‘Green Belt’ around Bangalore shall not issue licenses for any constructions or any building activities beyond their present ‘Gramathanas’ and 200 meters from the limits of these Gramathanas.

      2. It has been decided by the Government that in order to avoid hapazard growth of village limits the village panchayats should be stopped from issuing licenses for construction in areas beyond the present Gramathana limits.

      3. Now therefore in exercise of powers conferred by sub-section (3) of Section 54 of the Karnataka Village Panchayat and Local Board Act, 1959 and in supersession of the instructions issued earlier the Government of Karnataka, hereby direct that all the Village Panchayts concerned within the areas coming under the revised Green Belt as shown in the annexure appended hereto shall not issue licenses for construction of any building beyond their approved Gramathana limits and to hereafter restricted the exercise of such powers by the Village Panchayts/Mandal Panchayats to the licensing of construction of building only within the respective Gramathana limits and not upto 200 meters beyond these limits.

      4. Suitable instructions may be issued to all concerned. A compliance report on the action taken in this behalf should be sent to Government by the Deputy Commissioner, Bangalore (Urban) District, Bangalore immediately.

    Builder has provided form 9 and 11 as Khata for the site but My lawyer is asking for form 1 and 12 as Khata from previous owner. When I contacted builder, he says forms 1 and 12 have been discontinued by Govt and he can only provide form 9 and 11. Who is correct here lawyer or builder?

    We bought a plot recently about 2 months back in Bukkasagar village near Jignani (gate community, property registration was done in Bannergatta Sub registered office), Now our borker is telling Khata will be issued in form of 9 & 11 and it takes some more time but nothing to worry as the layout has been approved by BMRDA and all the betterment charges has been paid with proper conversion (LOA), the LOA information is availabe in BMRDA Approved layout section on their official website… we are little concerned about Khata… pl..let us kn0w incase of any problem.. around 10 – 15 houses have already been constructed.. if we now take the EC.. will it reflect our name in the extract.. or do we need to wait till KHATA is done on our name

      The EC will reflect that there is a transaction in the said property and will stand in your name.
      The property is not within the periphery of BBMP and is still under panchayat jurisdiction. There is no katha extract or katha certificate issued. It is Form No.9 and Form No.11.
      BMRDA issual is also subject to many important conditions and is not concerned with any litigation on the titles of the property.

    i m planning to buy a site+home(newly constructed) in shantilayout/TC palya mainroad.Its not having DC conversion/no NOC from BDA. But it has khata and the latest tax paid,there are other homes already built in the same survey.I tried EC for 22 years and its on buyer name only.

  27. Sir,

    I am planning to take a site at Mandur, East Bangalore,all titles are ready with DC converson of land except layout approval fom Hoskote palnning authoity (HPA) but it is apprroved from panchayat, Mandur.
    But when HPA given preliminary approval for 33 Guntha should be for residential and 5 guntha for park and gaden.

    But developer has left 2 gunthas for park and play ground and layout is not approved by HPA. But approved by Panchayat.

    How to proceed and tackel the developer to get such approval?

    Kindly guide and suggest.

      The HPA will not approve the layout, unless the builder complies and conform with the conditions laid down. Do not buy it.

      It is B form and not B katha.
      We do not understand the fee paid by you.
      Payment of taxes does not confer you the ownership. You pay the taxes to avail the facilities.
      It is a form issued based on the sale deed copy containing the schedule.

      If the property is registered so recently, the taxes would have been paid up to date. Check your receipt of the tax. The payment of improvement charges depend upon the nature of the property.

    I have identified one layout to purchase one plot(1400sqft),but it has panchayat approval,The layout is converted for resindential type by local tahasidar. But there is no BBMP or BMRDA approval and no noc from BDA and it dod not comes under CMS also, Please advise can i go further to purchase the site or not.

  32. Hi I am planning to purchase a site (with house being built by the builder). The builder has BBMP A khatha and all betterment charges paid till date. When I approached SBI for bank loan, they denied saying they can’t process as they don’t have the DC conversion document. When checked with builder, he is telling is it safe as the A-Khata and betterment charges are there.Also the plan for the layout is approved by BBMP. The site is in Ramamurthy nagar.
    I am in dilemma, should i proceed or not? (Any help in this regard would be helpful.

    my father has bought a site from his own money in 1987, a site mesuring 3250 sqft, gramtana, my father passed away in 2005 , my brother got gift deed from my mother for this 3250 sqft site in 2006 and he has paid the tax for the vacant land, and now he is building house, since the site belong to my father , i have equall rights in the sites, but how can i clam the site now, what is the procudure to claim the site , my brother is now willing to share the site with me , i consider your suggest is very valuable to me .

    I have visited a site in halanayakanhalli (Sarjapur road –> WIpro corporate office –> First right after wipro corp office ) which is a revenue site which is in the centre of halanayakanahalli after green villas. Its next to a temple in the village.

    The broker was informing that it will be soon DC converted. Can i go ahead and buy the site.

    1) what are the chances that BDA might acquire these sites because it is revenue site.
    2) Is it possible to get loans.

      We cannot comment on BDA acquisition proceedings. Most of the state owned banks might not finance such properties.

  35. Dear Sir

    We are in the final stage of registering a site in a BDA approved private layout in Doddabetahalli Village Yelahanka. The land where the layout was formed is DC converted but was notified for acquisition by BDA. However later a denotification was issued for these select survey numbers where this layout falls through an order by Under Secretary Govt of Kar. The same though was approved by SBI and Deutsche Bank for loan purposes, by merely seeing this blog I was informed enough to personally go to BDA and check the authenticity of the documents produced by the developer. Even the site release order by BDA also was checked. The EC for the particular site offered were also checked till date and the name of the developer who is holding a registered GPA for the same is appearing. Can you kindly guide before going for registration of the site any other details needs to be checked. Also what all things needs to be done after the registration proceedings are over.

      First of all, Many thanks for your action. The procedures followed by you is very specific, clear and legal. If every buyer follows it religiously, then the cheats would not get an opportunity.
      Every aspect appear to be fine and check the schedule and the boundaries. If possible, measure the extent of the site, which is being bought. You can apply for the transfer of katha, after one week with all necessary documents and get it transferred. That completes the entire process of documentation and purchase.

    Just today, I got the B-Khata(it says Form-B property register) issued by the BBMP (official charges of Rs 100) for my site. I plan to start the construction on my site. For that I am getting confusing information from various sources and I request your kind clarifications on the same.

    1) I read in many forums including this one that some banks(like LICHFL, IDBI and
    Axis) provide loan for building construction on sites with B-Khata. However I heard from BBMP people that plan sanction can not be obtained using B-Khata. Does that mean that these banks issue construction loans without approved plan?. Could you please clarify this?

    2) My site was part of Bommanahalli CMC and now part of BBMP. My site is DC converted site with BDA NOC and now I have the B-Khata. I also have the sale deed,
    EC, have paid all property taxes till date. Given this,
    a) will BBMP approve the plan
    b) Will any bank approve construction loan
    c) What are the alternatives for me to get a loan if a) or b) is not possible.

    1. Dear Selva,
      The Improvement charges had to be paid, as and when it is announced within two months. Once, it is paid, katha will be issued. Based on that you can get your building plan sanctioned. All the banks must sanction the home loan, if you are eligible with good credit rating with katha.
      There is no other short cut. There are no alternatives. But there are illegal ways to get loans by misrepresentation.

During this period all my neighbors have built their houses by bribing the BBMP guys. But I didn’t want to take risks and hence still waiting. Do you know when BBMP is likely to start the collection of betterment charges as I really want to begin the house construction?.

    I explored to buy a flat being built by a private builder near C.V. Raman Nagar. The builder has acquired land in two adjacent pieces with clear titles, as far as I could make out. Upon examning land documents, I found that there is a road (width not mentioned in BBMP map attached to land papers) mentioned which comes in the middle of these two pieces of land. The builder said, this road is ‘kalibata’ meaning walkway. He also says that this walkway is not known to anyone and can not be used by public. He plans to construct some amenities on this ‘road’. There will not be any wall between this road and flats bing constructed in the compound. Can you please give your opinion on whether such ‘kalibata’ roads can be claimed by public or by civic authoities for public use, either now or later?

A leading builder(politically powerful), built a portion of residential and commercial complex on raja kaluve, which might be demilished soon or the court will initiate action or the lokayukta will take action.

  40. I paid my property tax in July ’10 and I was given the manual bill with seal (from BBMP office). The amount is not yet debited from my account nor did they give me the printed bill yet. Is there something fishy here?

You say that you have got temporary plan sanctioned using B form khata and also got the loan using this.     I have a question. My site which was under panchayat now is under BBMP. I have a khatha issued by panchayat and i want a BBMP Khatha. My site is DC converted and all developments like Tar Road, Water connection to each plot, Sanitary connection to each plot and Steet electricity has been done by the developer. My question is should i pay betterment charges to BBMP ? Is yes where should i pay ??
