Apartments and sites in and around lakes, raja kalve, secondary and territory channel are being put on SALE by the builders and owners through agents and internet marketing portals at attractive or lesser prices.
Few apartment complexes, which is incomplete and still being constructed are under the ambit of the directives of the NGT and the builders and owners are fleecing the buyers to enter into sale agreement and suck the money from these eccentric buyers.
When the question of NGT directives are raised, they have a standby answer. “We have challenged it and will get relief soon”. THIS IS FREE BALAJI DARSHAN GIFT FROM THEM. The buyers money is GONE and additional benefit offered by these sellers/owners/agents/builders is the LIFE LONG LITIGATION.
One such builder has stated that the plan has been approved by BDA and so everything, BDA has sanctioned or approved is right.

The builder will never get the Occupancy Certificate and if the sanction is questioned, all the approvals from KSPCB, BESCOM, AAI, Fire and Emergency Services might be withdrawn or gets automatically cancelled. BEWARE AND BE ALERT.
The NGT had issued a BAILABLE WARRANT to the senior executive of one of the leading builders in Bangalore to appear before it for the Non-Compliance of its orders and the builder did not present himself before the court. The NGT took serious note of it and sought his appearance, if not, inevitably the tribunal might exercise its powers to bring him to book.
If the treatment for encroachment/deviation/violation/irregularity for such a leading builder sends strong signals and further the Supreme Court of India had recently directed the Town Planner in Himachal Pradesh, Kasauli to remove the encroachments and demolish the illegal and unauthorized constructions.
An innumerable number of revenue buildings, DC Converted sites, and illegal buildings have come up in and around and on the raja kaluve and many such owners/agents/brokers are trying to sell their properties by concealing the facts or hiding the details about the illegality or irregularity and some notorious financial institutions are financing such illegal activities.

A cheat in Bengaluru took the art of con to a whole new level by forging all property documents and trapping a clueless buyer and sold off a piece of land that houses a local police station! (The seller offered it at a throwaway price and the buyer might have been tempted at such a price) (This is the simplest trick)
The cheat created fake property documents and furnished them to the buyer and collected a good amount before decamping. The said property is a POLICE STATION.
It was when some construction workers KNOCKED at the doors of the Kamakshipalya traffic police station to build a shed in the compound, the policemen learned what has gone down.
The best part of this story is that a man claiming the land has always belonged to him – and he even produced fake documents in court claiming he currently resides on this land, meaning in the police station.
In a similar, but different case and property in Marathahally, a cheat created a fake document and even got the BBMP `A` katha in the name of the dead person and got it registered. The buyer was not even aware of it till date.
A layout on sarjapur road, developed by a prominent builder has discrepancies in title and the builder is very well aware of it and had sold a big junk of the layout (10 years old) and the legal heir or the share holder does not even know that her signature had been forged.
Another layout on sarjapur road, approval of the layout has BBMP seal and signature but the original plan has a totally different XXXXXXXXXXXXXX. The builder has happily sold it and none of the buyers are aware of it, till today.
There are too many such instances across the state.
THE RESIDENTIALLY CONVERTED LAND BY THE ORDER OF THE DEPUTY COMMISSIONER OF THE DISTRICT IS USUALLY MENTIONED AS DC CONVERTED OR CONVERTED SITES IN KARNATAKA, THE USE OF SUCH LANDS IS CHANGED FROM AGRICULTURE TO NON AGRICULTURE PURPOSE AND APPROPRIATE FINE IS PAID, BUT THIS ORDER CARRIES WITH IT, NUMBER OF CONDITIONS, WITHOUT THE COMPLIANCE OF THE CONDITIONS, THE ORDER IS INVALID OR NON ENFORCEABLE AND THE NON COMPLIANCE OF DC CONVERSION ORDER RESULTS IN THE CANCELLATION OF THE DC CONVERSION ORDER WITHOUT NOTICE AND THE GOVERNMENT RESERVES THE RIGHT TO DEMOLISH THE STRUCTURES BUILT ON IT WITHOUT NOTICE AND COLLECT THE DEMOLITION CHARGES AS REVENUE ARREARS. HENCE, A CAREFUL, STUDY AND EXAMINATION OF THE ORDER IS IMPORTANT, BEFORE BUYING SUCH PROPERTIES.
THESE PROPERTIES MAY HAVE KHARAB LANDS, WHICH CANNOT BE SOLD OR RAJA KALUVE OR BANDI DAARI OR KAALU DAARI AND BAANI, WHICH CANNOT BE ALIENATED AT ALL.
PROPERTY OWNERS (DC CONVERTED) ARE WAITING ANXIOUSLY FOR THE ANNOUNCEMENT REGARDING THE COLLECTION OF BETTERMENT CHARGES FOR THEIR PROPERTIES, BUT TILL LATE EVENING(02-06-2014) CIRCULAR HAS NOT BEEN ISSUED BY THE BBMP.
BUT, THE PROPERTY OWNERS NEED NOT WORRY AT ALL. THEIR (BBMP) HANDS ARE IN YOUR POCKETS AND WILL DEFINITELY ROLL OUT SOMETHING AND YOU WILL DOLE OUT SOMETHING TO GET KATHA.
IT HAS BEEN RELIABLY LEARNT THAT IT WILL BE ISSUED BY THIS WEEK.
PROPERTY BUYERS MUST THOROUGHLY EXAMINE AND INVESTIGATE THE KATHA ISSUED TO DC CONVERTED SITES AND REVENUE SITES, OVER FEW THOUSAND KATHAS ISSUED ARE ON MISREPRESENTATION OF FACTS AND FABRICATED DOCUMENTS, WHICH, IF FOUND OUT AT ANY POINT OF TIME, WILL AUTOMATICALLY GETS CANCELLED DUE TO FRAUD.
City Municipal Council Sites
There WERE 7 City Municipal Councils and one Town Municipal Council surrounding the Bangalore city. The sites in the limits of these authorities are mostly owned by private individuals, some of the sites are acquired by Government. Infrastructure is very poor. The process of tracing the title is very complicated. But some extra pre cautions need to be taken. Verify whether the betterment charges have been paid, if not purchaser may have to pay it in the future. Many lands in the area of these local bodies are agricultural lands and conversion to non-agricultural purpose must have to be done. Presently City Municipal Councils have stopped collecting betterment charges and issuing Khatas. If the owner doesn’t have a Khata, he cannot construct the house with the plan approved from CMC.
Site in private layouts
These are layout formed by private parties, other than statutory development authorities. Many reputed land developers have formed layouts around the city. Verify all the documents as required in case of private property for a period of 43 years. Apart, from the above check whether the land is converted for residential purpose, and the layouts are approved by BDA or BMRDA. Verify the records with respective offices. Many numbers of private layouts with D.C. conversion and panchayat approval are available. Purchase of these type of sites involves little risk.
These are residential sites, which were originally available in village panchayat areas. They can be distinguished from Kaneshumari number, assigned to them. The agricultural lands have survey numbers. The sites of this nature are very few. Government has put restrictions on issue of license for construction by village panchayats beyond their approved Gramathana area, original Gramathana sites can be identified by examining old village survey maps available in survey department. Examine all the records as is done in case of private property. In addition verify the village records and form No. 9 and 10. Form No. 9 denotes Gramathana site and form No. 10 denotes the building, which confirm that the particular property is original Gramathana site or not. But many village panchayats issue from No. 9 & 10, though they are not Gramathana sites. Many such sites fall in green belt area, where construction of residential buildings is restricted. Extra caution is necessary while buying Gramathana Sites.
