CONVERSION OF `B` KATHA TO `A` KATHA IN BANGALORE


The BBMP has proposed to regularise or legitimise the B katha by collecting FEE and issuing the regular A Katha and the subject is before the Government for its approval.

There are some complications in this process.  As the subject is before the Hon`ble Supreme Court, the Government may attract serious rebuttal from the Apex Court and All the B katha sites cannot be converted into A Katha due to various other issues and even, if the BBMP regularises it, it may be difficult to sanction building plans.

Hence, it is advised to be careful before the purchase of B katha and the converted A Katha.

`A`Katha – How did you get it ?


There is an investigation being conducted by the authorities regarding the register and transfer of A Katha in BBMP for the buildings which have violated the building by laws and deviated from the sanctioned building plans.  Furthermore, How A Katha was issued to properties on Raja kaluve and Lake bodies is being investigated.

75% of the buildings and houses have deviated from the sanctioned plan and violated the by laws and are legally ineligible to obtain A Katha, but many illegal apartments have A katha.

Before the purchase of the apartment or the site, check the A katha and how it was registered or transferred or issued?

Apartments without Occupancy Certificates have A katha, which is illegal and have obtained it through fraudulent manipulation and misrepresentation of facts, liable to be cancelled automatically.

There are only 36 Occupancy Certificates issued by the BBMP in the last few years and it is startling to know that majority of the apartment complex have A katha without proper documentation and compliance to the prevailing laws.

In Bommanahally Zone, It is said that one housing complex having violated more than 60% to 75% obtained A katha with the connivance of the BBMP Officials, which is under scrutiny.

AE, Many have A Katha and have built houses on the Raja Kaluve and on the periphery of the lake, have defective titles and discrepancy in the survey records.

BBMP HAS ISSUED PUBLIC NOTIFICATION TO THE ENCROACHERS TO LEAVE AND VACATE THE RAJAKALUVE, SECONDARY CHANNEL AND LINKING CHANNELS.

IF THE OWNERS DOES NOT VACATE THE ENCROACHMENT, THE BBMP WILL DEMOLISH THE STRUCTURES AND COLLECT THE CHARGES FROM THE OWNERS.

Koliwad Committe has recommended action against the BBMP officials who had issued A katha

                    Karnataka Legislative Assembly Speaker K.B. Koliwad, who chairs the Joint Committee on Tank Encroachment in Bengaluru, said the committee will recommend dismissal of officials of the Bruhat Bengaluru Mahanagara Palike (BBMP) or other departments who sanctioned building plans and issued “A” khatas for structures that encroached storm water drains (SWDs) and lake beds.

                   The Speaker, who inspected illegal constructions in the city last week, told presspersons that the committee would submit its final report by October end.

                    The panel would recommend filing of criminal cases against realty developers and seizure of their properties if they found constructed houses/buildings/apartments encroaching SWDs and lake beds. An 8,000 page document with information on city’s lakes from surveyors and officials had been put together, he said on Monday.

                A drafting committee has been constituted to prepare a final report, which is expected to be voluminous. The report would recommend demolition of all illegal buildings/houses constructed on SWDs and lake beds, he said.

              The committee would recommend stringent action against officials and developers and it would be the responsibility of the government to execute it, he added.

MANY BUYERS ARE UNDER THE CONCEPT AND IMPRESSION THAT A KATHA DELIVERS THEM GOOD AND MARKETABLE TITLES. IT IS NOT SO. IT HAS TO BE EXAMINED- HOW THE KATHA IS OBTAINED? IN A CASE, AT BELLANDUR(CLOSE TO RING ROAD), IN A TOP END APARTMENT OF A FAMOUS BUILDER, THE RESIDENTS OR THE OWNERS(PRESENT), NOW, ARE PAYING BETTERMENT CHARGES TO GET THE KATHA OF THE PROPERTIES, AS SOME OF THE BANKS ARE DEMANDING THE KATHA AND SOME ARE IN THE PROCESS OF SALES.  THEY CANNOT WAIT FOR THE BUILDER TO PAY –  ARE IN A HURRTY – FORCED TO SHELL DOWN THEIR MONEY TO GET THE KATHA.

`A` KATHA, EC, BANK LOAN, BESCOM CONNECTION, BWSSB CONNECTION,PAYMENT OF TAXES AND TOP BUILDER`S NAME OR GOODWILL DOES NOT CONFER ANY RIGHT, TITLE AND INTEREST.

SOME OF OUR READERS WERE VERY ANGRY AND VENT OUT THEIR FEELINGS AND VIEWS STATING THAT THEY HAVE REGISTERED SALE DEED, THE TITLES WERE GOOD AND  LEGAL 15 YEARS BACK AND HOW IT IS NOT LEGAL TODAY. IT WAS NEVER LEGAL. EVEN THE SUB-REGISTRAR CANNOT REGISTER SUCH PROPERTIES, WHICH ARE IN REVENUE LANDS. IT IS CRYSTAL CLEAR THAT AGRICULTURE LAND CANNOT BE BIFURCATED AND SOLD AND IT IS ILLEGAL.  EVEN THE DC CONVERTED SITE DOES NOT CONFER ANY RIGHT, TITLE AND INTEREST WITHOUT PROPER APPROVALS FROM THE CONCERNED TOWN PLANNING AUTHORITY.  THE DC CONVERSION ORDERS ISSUED WAY BACK IN 1970`S AND 1980`S HAD CONDITIONS LAID IN ITS ORDERS THAT THE PROPERTIES WHICH ARE CONVERTED MUST OBTAIN CLEARANCE AND APPROVALS FROM THE APPROPRIATE AUTHORITIES AND ONLY AFTER OBTAINING SUCH CLEARANCE AND APPROVALS, THE MARKETABLE TITLES ARE CONFERRED.  THE MOST IMPORTANT CONDITION IN EVERY ORDER IS THAT IN THE EVENT OF “NON-COMPLIANCE” OF ANY OF THE CONDITIONS WILL RESULT IN THE AUTOMATIC CANCELLATION OF DC CONVERSION ORDER AND ACTION WILL BE INITIATED TO DEMOLISH ANY BUILDINGS OR STRUCTURES WHICH HAVE COME UP ON SUCH PROPERTIES AND THE EXPENDITURE INCURRED TOWARDS SUCH DEMOLITION WILL BE RECOVERED FROM THE OWNER AS REVENUE ARREARS.  THE USE OF SUCH LAND REVERT TO THE ORIGINAL USE, IN CASE OF NON-COMPLIANCE OF ANY OF THE CONDITIONS.  THE GOVERNMENT HAS THE POWERS TO DEMOLISH SUCH STRUCTURES WITHOUT INTIMATION.

BUT, THE BUYERS IN A BID TO ACQUIRE THE PROPERTY, HAS MISREPRESENTED THE FACTS BEFORE THE SUB-REGISTRAR AND GET THE DOCUMENTS REGISTERED.  IN THE SAME MANNER, THE KATHA IS ALSO OBTAINED.

NOW THE BUYERS ASK THE QUESTION? HOW DID SUB-REGISTRAR REGISTERED THE DOCUMENT? FACTS ARE TWISTED AND MISREPRESENTED AND THE BUYER/SELLER PAID XXXXX TO THE TOUT/AGENT TO GET THE SALE DEED REGISTERED AND AGAIN GETS THE KATHA IN THE SAME MANNER, GET THE POWER AND WATER CONNECTION AND PAY THE TAXES, FINALLY, WHEN IT IS DEMOLISHED, THE PROPERTY OWNER GRUMBLES AND CRIES.  

TITLES MUST BE CLEAR WITH MARKETABLE TITLES, ALONG WITH AUTHENTIC KATHA AND ALL STATUTORY APPROVALS, LICENSES, CC,OC AND POSSESSION.

IT IS SAD TO NOTE THAT MANY POOR PEOPLE LOST THEIR HOUSES IN THE RECENT DEMOLITION, WERE COMPLAINING THAT THEY HAVE `A` OR `B` KATHA, TAX PAID RECEIPTS, BESCOM CONNECTION, BWSSB CONNECTION AND REGISTERED SALE DEED. 

IT IS VERY SAD THAT THE HOUSES OF POOR ARE DEMOLISHED AND THE RICH GO SCOT FREE WITH LITIGATION FOR COUPLE OF YEARS AND THE NOTORIOUS BUILDER WHO STOLE THE GOVERNMENT LAND AND ROAD IS HAPPILY ROAMING AROUND AND SELLING HIS PROPERTIES.

THE COMMON STATEMENT MADE BY THE TOUTS, AGENTS AND THE BUILDERS IS THAT “THERE IS 90% DEVIATION EVERYWHERE, HAS THE GOVERNMENT GOT THE GUTS TO DEMOLISH? NO CHANCE” YOU CAN HAPPILY BUY AND IF SOMETHING GOES WRONG, WE WILL BE THERE- BUT THE TRUTH IS THAT YOU(THE BUYERS) WILL NOT BE THERE.

HENCE, CONDUCT DUE DILIGENT ENQUIRY AND EXAMINATION INTO ALL THE ASPECTS AND THEN PROCEED TO BUY. NO HURRY. IF YOU HURRY, WORRY WILL TAKE OVER.

BESCOM IS A MERCHANT ESTABLISHMENT, THOUGH OWNED BY THE GOVERNMENT, IS A SUPPLIER OF ELECTRICITY FOR A TARIFF(PRICE).  THE ELECTRICITY CONNECTION IS PROVIDED BASED ON THE ABOVE STATED KATHA, WHICH IS IRREGULAR OR ILLEGAL, CANNOT CONFER ANY RIGHT, TITLE AND INTEREST. HENCE THIS AVERMENT DOES NOT STAND THE LEGAL VALIDATION.

BWSSB- CAUVERY WATER CONNECTION – IS ALSO A PUBLIC UTILITY AND A PROVIDER OF WATER FOR A TARIFF AND ANY CONNECTION OR SUPPLY DOES NOT ENTITLE THE PRECIPITANT ANY RIGHT, TITLE AND INTEREST.

KATHA MUST HAVE BEEN OBTAINED ON AUTHENTIC AND GENUINE DOCUMENTS WITHOUT CONTRADICTING ANY PROVISIONS OF THE APPLICABLE LAW, LIKE KARNATAKA MUNICIPALITY ACT, KARNATAKA LAND REVENUE ACT, KTCP ACT, KARNATAKA LAND REFORMS ACT, RDPR ACT, BDA/BMRDA ACT AND OTHER APPLICABLE AND RELEVANT ACTS. 

HENCE, A THOROUGH EXAMINATION OF KATHA AND HOW IT IS OBTAINED AND THE BASIS ON WHICH IT IS OBTAINED IS ALSO CRUCIAL TO VALIDATE THE TITLES.

IN SOME CASES, THESE CHARGES AMOUNTED TO OVER 25% AND 75% OF THE CASES, THE BUYERS DO NOT HAVE KATHA FROM BBMP, STILL HAVE TO REMIT THE BETTERMENT CHARGES AND PAY THE KATHA FEE, WHICH WORKS OUT AT APPROXIMATELY AT 1%.

Many of the buyers are under the wrong impression and notion that the approval or sanction of BANK LOAN will confer the best right, title and interest of the property.  IT IS WRONG.

ಬಿಬಿಎಂಪಿ ಸಾಮಾನ್ಯ ಸಭೆಯಲ್ಲಿ ಸೋಮವಾರ ಅಭಿವೃದ್ಧಿ ಶುಲ್ಕ ಸಂಗ್ರಹಣೆಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಸುದೀರ್ಘ ಚರ್ಚೆ ನಡೆದ ಬಳಿಕ ಅವರು ಈ ಸ್ಪಷ್ಟನೆ ನೀಡಿದರು. ‘ಭೂಪರಿವರ್ತನೆಯಾದ ನಿವೇಶನ ವಿಂಗಡಣೆಯಾಗಿದ್ದರೆ ಅಥವಾ ಅದ­ರಲ್ಲಿ ಕಟ್ಟಡ ನಿರ್ಮಿಸಿದ್ದರೆ ಅಂತಹ ನಿವೇಶನದಾರರು ಅಧಿಕೃತ ಖಾತೆ ಮಾಡಿಸಿಕೊಳ್ಳಲು ಅಕ್ರಮ–ಸಕ್ರಮ ಯೋಜನೆ ಜಾರಿಗೆ ಬರುವ­ವರೆಗೆ ಕಾಯಬೇಕು’ ಎಂದು ಹೇಳಿದರು.

‘ರಾಜ್ಯ ಸರ್ಕಾರ ಅಕ್ರಮ–ಸಕ್ರಮ ಯೋಜನೆಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಈಗಾಗಲೇ ಅಧಿಸೂಚನೆ ಹೊರಡಿಸಿದ್ದರೂ ಹೈಕೋರ್ಟ್‌ನಲ್ಲಿ ಎರಡು ಪ್ರಕರಣಗಳು ದಾಖಲಾಗಿವೆ. ಈ ಸಂಬಂಧ ವಿಚಾರಣೆ ನಡೆಯು­ತ್ತಿ­ರುವ ಕಾರಣ ಯೋಜನೆ ಅನುಷ್ಠಾನದಲ್ಲಿ ವಿಳಂಬವಾಗಿದೆ’ ಎಂದು ವಿವರಿಸಿದರು.

‘ಭೂಪರಿವರ್ತನೆಯಾದ ಏಕ ನಿವೇಶನಗಳಿಗಲ್ಲದೆ ಬೇರೆ ನಿವೇಶ­ನ­ಗಳಿಗೂ ಖಾತೆ ನೀಡಲು ಮುಂದಾದರೆ ಸರ್ಕಾರದ ಯೋಜನೆಗೆ ವಿರುದ್ಧ­­ವಾಗಿ ಬಿಬಿಎಂಪಿ ಕ್ರಮ ಕೈಗೊಂಡಂತೆ ಆಗುತ್ತದೆ. ಹೀಗಾಗಿ ಉಳಿದ ನಿವೇಶನಗಳಿಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಈ ಹಂತದಲ್ಲಿ ಅಭಿವೃದ್ಧಿ ಶುಲ್ಕ ಪಡೆಯಲು ಸಾಧ್ಯವಿಲ್ಲ’ ಎಂದು ಸ್ಪಷ್ಟಪಡಿಸಿದರು.

ಮಧ್ಯ ಪ್ರವೇಶಿಸಿ ಮಾತನಾಡಿದ ಮೇಯರ್‌ ಬಿ.ಎಸ್‌. ಸತ್ಯ­ನಾರಾ­­­ಯಣ, ‘ಭೂಪರಿವರ್ತನೆಯಾದ ಭೂಮಿಯಲ್ಲಿ ಹಂಚಿಕೆ ಮಾಡ­ಲಾದ ವೈಯಕ್ತಿಕ ನಿವೇಶನಗಳಿಗೂ ಖಾತೆ ನೀಡಲು ಅನುಮತಿ ನೀಡು­ವಂತೆ ಒತ್ತಾಯಿಸಲು ಮುಖ್ಯಮಂತ್ರಿಗಳ ಬಳಿಗೆ ನಿಯೋಗ ಕರೆದೊಯ್ಯ­ಲಾ­ಗುವುದು’ ಎಂದು ಪ್ರಕಟಿಸಿದರು.

ಚರ್ಚೆಗೆ ನಾಂದಿ ಹಾಡಿದ ಬಿಬಿಎಂಪಿ ಆಡಳಿತ ಪಕ್ಷದ ನಾಯಕ ಅಶ್ವತ್ಥನಾರಾಯಣಗೌಡ, ‘ಮುಖ್ಯಮಂತ್ರಿಗಳು ಬಿಬಿಎಂಪಿಯಿಂದ ₨ 4,000 ಕೋಟಿ ತೆರಿಗೆ ಸಂಗ್ರಹಿಸಲು ಸಾಧ್ಯವಿದೆ ಎಂದು ಬಾರಿ, ಬಾರಿ ಹೇಳುತ್ತಿದ್ದಾರೆ. ಕೌನ್ಸಿಲ್‌ ಸಭೆಯಲ್ಲಿ ನಾಲ್ಕು ತಿಂಗಳ ಹಿಂದೆಯೇ ಅಭಿವೃದ್ಧಿ ಶುಲ್ಕ ಸಂಗ್ರಹಿಸಲು ನಿರ್ಣಯ ಕೈಗೊಂಡಿದ್ದೇವೆ. ಅಧಿಕಾ­ರಿ­ಗಳು ಇದುವರೆಗೆ ಯಾವುದೇ ಕ್ರಮ ಕೈಗೊಂಡಿಲ್ಲ. ಹೀಗಾದರೆ ವರ­ಮಾನ ಸಂಗ್ರಹಣೆ ಹೇಗೆ ಸಾಧ್ಯ’ ಎಂದು ಪ್ರಶ್ನಿಸಿದರು.

‘ಕೌನ್ಸಿಲ್‌ ಸಭೆಯಲ್ಲಿ ನಿರ್ಣಯ ಕೈಗೊಳ್ಳುತ್ತಲೇ ಇದ್ದೇವೆ. ಕಂದಾಯ ವಿಭಾಗ ಮಾತ್ರ ಅದಕ್ಕೆ ತಕ್ಕಂತೆ ಕ್ರಮ ಕೈಗೊಳ್ಳುತ್ತಿಲ್ಲ. ಅಧಿಕಾರಿ­ಗಳ ಜಡತ್ವದಿಂದ ಪಾಲಿಕೆಗೆ ದುಡ್ಡೇ ಬರುತ್ತಿಲ್ಲ. ಹಿಡಿದಿರುವ ಜಡ ಬಿಡಿಸಲು ಅವರನ್ನೆಲ್ಲ ಪ್ರಕೃತಿ ಚಿಕಿತ್ಸಾಲಯಕ್ಕೆ ಕಳುಹಿಸಬೇಕು’ ಎಂದು ವ್ಯಂಗ್ಯವಾಡಿದರು. ಬಿಜೆಪಿಯ ಎನ್‌. ನಾಗರಾಜ್‌, ‘ಪ್ರತಿ ವಿಭಾಗದಲ್ಲೂ ಒಂದೊಂದು ವಾರ ವಿಶೇಷ ತೆರಿಗೆ ಸಂಗ್ರಹ ಮೇಳ ಮಾಡಬೇಕು. ಅಭಿವೃದ್ಧಿ ಶುಲ್ಕ ಸೇರಿ­ದಂತೆ ಎಲ್ಲ ತೆರಿಗೆಯನ್ನೂ ಈ ಮೇಳದಲ್ಲಿ ಸಂಗ್ರಹ ಮಾಡಬೇಕು.

ಇದರಿಂದ ಬಂದ ವರಮಾನವನ್ನು ಗುತ್ತಿಗೆದಾರರ ಬಾಕಿ ತೀರಿಸುವ ಜತೆಗೆ ಅಭಿವೃದ್ಧಿ ಕಾರ್ಯ ಕೈಗೊಳ್ಳಲು ಬಳಸಬೇಕು’ ಎಂದು ಸಲಹೆ ನೀಡಿದರು. ವಿರೋಧ ಪಕ್ಷದ ನಾಯಕ ಮಂಜುನಾಥ ರೆಡ್ಡಿ, ‘ಸರ್ಕಾರದ ಮಾರ್ಗಸೂಚಿ ದರದಂತೆ ಅಭಿವೃದ್ಧಿ ಶುಲ್ಕ ಭರಿಸಲಾಗುವುದು ಎಂಬ ಪ್ರಮಾಣ ಪತ್ರ ಪಡೆದು ನೂರಾರು ನಿವೇಶನಗಳಿಗೆ ಖಾತೆ ನೀಡಲಾಗಿದೆ.

ಅಂತಹ ನಿವೇಶನಗಳಲ್ಲಿ ಕಟ್ಟಡ ನಿರ್ಮಿಸಿದ ಬಿಲ್ಡರ್‌ಗಳು ಮನೆಗಳನ್ನು ಮಾರಾಟ ಮಾಡಿ ಜಾಗ ಖಾಲಿ ಮಾಡಿದ್ದಾರೆ. ಆ ನಿವೇಶನಗಳ ಅಭಿವೃದ್ಧಿ ಶುಲ್ಕವನ್ನು ಯಾರಿಂದ ಭರಿಸಲಾಗುತ್ತದೆ’ ಎಂದು ಪ್ರಶ್ನಿಸಿದರು. ‘ಕಟ್ಟಡಗಳಲ್ಲಿ ವಾಸವಾದ ವ್ಯಕ್ತಿಗಳಿಂದಲೇ ಅಭಿವೃದ್ಧಿ ಶುಲ್ಕ ಸಂಗ್ರಹ ಮಾಡಲಾಗುವುದು’ ಎಂದು ಕಂದಾಯ ವಿಭಾಗದ ಉಪ ಆಯುಕ್ತ ಐ.ರಮಾಕಾಂತ್‌ ತಿಳಿಸಿದರು.

ಮೂರು ತಿಂಗಳಲ್ಲಿ ಪಿಐಡಿ:‘ಆಸ್ತಿ ತೆರಿಗೆ ಸಂಗ್ರಹಕ್ಕಾಗಿ ಭೌಗೋಳಿಕ ಮಾಹಿತಿ ವ್ಯವಸ್ಥೆ (ಜಿಐಎಸ್‌) ಮೂಲಕ ನಗರದ ಪ್ರತಿಯೊಂದು ಆಸ್ತಿಗೂ  ಗುರುತಿನ ಸಂಖ್ಯೆ (ಪಿಐಡಿ) ನೀಡುವ ಪ್ರಕ್ರಿಯೆಯನ್ನು ಇನ್ನು ಮೂರು ತಿಂಗಳಲ್ಲಿ ಪೂರ್ಣಗೊಳಿಸಲಾಗುವುದು’ ಎಂದು ಆಯುಕ್ತರು ಭರವಸೆ ನೀಡಿದರು. ‘ಪ್ರತಿ ತಿಂಗಳು ಸಾಧಿಸಲಾದ ಪ್ರಗತಿಯ ವರದಿಯನ್ನು ಅಧಿಕಾರಿಗಳಿಂದ ಪಡೆಯಲಿದ್ದೇನೆ’ ಎಂದು ಹೇಳಿದರು.

ಬಿಜೆಪಿಯ ಮಂಜುನಾಥ್‌ರಾಜು ಕೇಳಿದ ಪ್ರಶ್ನೆಗೆ ಅವರು ಉತ್ತರಿಸಿದರು. ಪಿಐಡಿ ನೀಡುವ ಪ್ರಕ್ರಿಯೆಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಪೂರಕ ಮಾಹಿತಿ ನೀಡಿದ ರಮಾಕಾಂತ್‌, ‘ಬಿಬಿಎಂಪಿ ವ್ಯಾಪ್ತಿಯಲ್ಲಿ ಇದುವರೆಗೆ 16,19,363 ಆಸ್ತಿಗಳನ್ನು ಗುರುತಿಸಲಾಗಿದ್ದು, 13,85,552 ಆಸ್ತಿಗಳಿಗೆ ಪಿಐಡಿ ನೀಡಲಾಗಿದೆ’ ಎಂದು ವಿವರಿಸಿದರು.

‘ಹಳೆಯ 75 ವಾರ್ಡ್‌ಗಳಲ್ಲಿ ಪಿಐಡಿ ನೀಡುವ ಪ್ರಕ್ರಿಯೆ ಈಗಾಗಲೇ ಶೇ 100ರಷ್ಟು ಪೂರ್ಣಗೊಂಡಿದೆ. ಹೊಸ ವಾರ್ಡ್‌ಗಳಲ್ಲಿ ಕೆಲಸ ಬಾಕಿ ಇದೆ. ಮಹದೇವಪುರ, ರಾಜರಾಜೇಶ್ವರಿನಗರ ಮತ್ತು ಬೊಮ್ಮನಹಳ್ಳಿ ವಲಯದಲ್ಲಿ ಬಹುತೇಕ ಆಸ್ತಿಗಳಿಗೆ ಇನ್ನೂ ಪಿಐಡಿ ನೀಡಬೇಕಿದೆ. ಗ್ರಾಮಗಳ ದಾಖಲೆ ಸರಿಯಾಗಿ ಇಲ್ಲದೆ ಇರುವುದು ಮತ್ತು ಕೌಶಲಪೂರ್ಣ ಅಧಿಕಾರಿಗಳ ಕೊರತೆಯಿಂದ ಕೆಲಸ ಕುಂಟುತ್ತಾ ಸಾಗಿದೆ’ ಎಂದು ಮಾಹಿತಿ ನೀಡಿದರು.

‘ಪ್ರತಿ ತಿಂಗಳು 2000 ಕಟ್ಟಡಗಳಿಗೆ ಕಡ್ಡಾಯವಾಗಿ ಭೇಟಿ ನೀಡಿ, ಕಟ್ಟಡದ ವಿಸ್ತೀರ್ಣಕ್ಕೂ, ಮಾಲೀಕರು ಕೊಟ್ಟ ಮಾಹಿತಿಗೂ ಇರುವ ವ್ಯತ್ಯಾಸವನ್ನು ಪತ್ತೆ ಹಚ್ಚಲು ಸಹಾಯಕ ಕಂದಾಯ ಅಧಿಕಾರಿಗಳಿಗೆ ಸೂಚನೆ ನೀಡಲಾಗಿದೆ’ ಎಂದು ಮುಖ್ಯ ಎಂಜಿನಿಯರ್‌ (ರಸ್ತೆಗಳು ಮತ್ತು ಮೂಲಸೌಕರ್ಯ) ಎಸ್‌.ಸೋಮಶೇಖರ್‌ ಹೇಳಿದರು.

‘ನಗರದ 1,049 ಕಿ.ಮೀ. ಉದ್ದದ ಮುಖ್ಯ ರಸ್ತೆಗಳ ಇತಿಹಾಸದ ನಿರ್ವಹಣೆ ವ್ಯವಸ್ಥೆಯನ್ನು ಇನ್ನು ಎರಡು ತಿಂಗಳಲ್ಲಿ ಸಂಪೂರ್ಣವಾಗಿ ಸನ್ನದ್ಧಗೊಳಿಸಲಾಗುವುದು. ಉಪರಸ್ತೆಗಳ ಇತಿಹಾಸ ನಿರ್ವಹಣೆಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ವಲಯ ಅಧಿಕಾರಿಗಳ ಸಭೆ ಕರೆಯಲಾಗುವುದು’ ಎಂದು ತಿಳಿಸಿದರು.

Khata faked to change status of hundreds of revenue sites

BANGALORE: In 2009, P Hanume Gowda who worked as a manager with a private company purchased a 1,250 sq ft revenue site for Rs 10 lakh from a realtor at Vidyaranyapuram, near Yelahanka, north Bangalore.

Post retirement, Gowda decided to pool in all his savings and build his dream home but fell short of Rs 5 lakh.

He desperately tried to raise loans from various banks. But his application was rejected on the ground that his revenue site didn’t have the required clearances. Gowda didn’t lose heart. Instead, with the help of a tout, he approached a BBMP officer in the revenue wing and sealed a murky deal.

The deal was to upgrade his ‘B’ Khata (certificate without title deeds and deviations) to ‘A’ Khata (certificate issued for no deviations and property ownership), provided he paid a betterment fee of Rs 2 lakh and service charge (read bribe) of Rs 3 lakh. An elated Gowda agreed to the deal but on the condition that he would pay the money only after raising the bank loan and after the BBMP issues him an ‘A’ Khata. Gowda’s decision was worth the money he spent as the value of the property has increased by about four times since.

In what’s being perceived as one of the biggest bribery scandals of recent times, hundreds of such instances of Khata manipulation are tumbling out of the BBMP’s closet . “It has not only caused significant losses to government coffers but also rendered the proposed Akrama-Sakrama scheme (regularization of building byelaw violations and land use in urban areas) redundant,” said a BBMP official.

Chief minister Siddaramaiah, who got a whiff of the scam at a recent meeting held to discuss the garbage crisis, has ordered an enquiry, which is to pull out more skeletons from the BBMP’s cupboard. “During preliminary investigations we found some 2,000 revenue sites being issued ‘A’ Khatas in one particular area. There could be several more,” said an RTI activist, who blew the lid off the scam.

How it all began

It all began earlier this year after a cash-strapped BBMP came out with a scheme to mobilize revenue of about Rs 200 crore. Corrupt officials, meanwhile, sparingly began issuing ‘A’ khata to revenue plot owners after fixing a sum for faking required clearances. The BBMP scheme though was intended to regularize revenue sites which had all the required documents such as the chain of title conveyance, sale agreement, tax receipts, and mutation extract but only awaiting the stamp of legitimacy from BBMP.

* Revenue sites are plots that lack clearances, particularly land use conversion and layout plan approval

* According to rules, an agricultural land can be used for residential or commercial purpose only after land use conversion is approved either by the panchayat or the deputy commissioner

* Layout plans are approved by civic agencies like the BDA or the jurisdictional local planning area authority. These agencies grant clearances only after certain portion of the land is earmarked for civic amenities

* An ‘A’ Khata may double the property’s value as it becomes legitimate and eligible for bank loans.

THE SAME POSITION AND STATUS MAY HAPPEN TO ALL ILLEGAL BUILDINGS SOONER OR LATER IN BANGALORE.

THOSE WHO HAVE OBTAINED KATHA FROM BBMP BY MISREPRESENTATION AND THOSE WHO HAVE PURCHASED THE PROPERTIES ON THE ASSURANCES OF TOUTS/AGENTS/SELLERS THAT THEY CAN GET THEIR ILLEGALITIES REGUALRISED UNDER AKRAMA SAKRAMA SCHEME MAY BE IN TROUBLE, AS THIS AKRAMA CANNOT GO FOR EVER, EVEN THE SUPREME COURT WILL NEVER ALLOW THIS SCHEME.

There are over 3600 cases of violation pending at various courts, bbmp and kat.  Many of these were awaiting the outcome of the case.

IT IS CONFIRMED THAT THE GOVERNOR HAS GIVEN HIS ASSENT TO THE AMENDMENT BILL TO REGUALARISE THE ILLEGAL/UNAUTHORISED CONSTRUCTIONS IN KARNATAKA.

LAYOUTS/SITES IN GREEN BELT, SITES UNDER HIGH TENSION LINES, LAYOUTS/SITES ON RAJAKALUVE/NALA AND ENCROACHMENT OF PUBLIC PROPERTIES WILL NOT BE REGULARISED.
