VIOLATION, DEVIATION, BWSSB DEPOSIT AND THE DISPUTE BETWEEN THE BUILDER AND THE BUYER
The residents of AN Whitefield Apartment complex have come up with a unique way to protest against their builder who failed to deliver amenities — Dissuading people from buying flats, the residents have put out posters that read: “Come, be a loser. Promised a temple, look what we have ended up in.”
One of the residents, xxxxxxx, said, “The builder had collected `1 lakh from each flat promising Cauvery water. However, there is no water connection because the builder has not deposited any amount with the BWSSB. Now, but the builder claims that he has not collected any money from them. He has built additional floors, while there were supposed to be only three. It has four floors which he owns. For the flats owned by him, he never paid any maintenance until recently. There are lots of defects in each flat, like seepage and fungus in most of the walls.”
The apartment complex has xx flats, out of which xx are yet to be occupied, and the builder is planning to construct another apartment complex adjacent to it. Another aggrieved resident, said, “Till now, we have not got the occupancy certificate, which the builder had assured to give us after we moved in. Even the car parking was allocated based on his own wish. It is not as per approved plan. He threatens us whenever we ask him about his promises.”
A complaint was lodged with the concerned BBMP office regarding violations, but the officers did not turn up.
The Occupancy Certificate will not be issued to this apartment complex due to violation and deviation.
The BBMP engineers might inspect the property and issue notice to the builder or the owners to remove or demolish the unauthorised structure or portions and ultimately the owners who have bought the property will be severely impacted. If this violation and deviation is brought to the notice of the Banks or the RBI, as per the MC of the RBI and the Orders of the Delhi High Court, the banks might be compelled to recall the home loans sanctioned and the buyers will be put into inconvenience.
BUYING AN ILLEGAL & UNAUTHORISED APARTMENTS WILL HAVE ADDITIONAL PROBLEMS LIKE THE ONES SAID ABOVE, AS THE BUYERS CANNOT TAKE ACTION ON THE SELLER/OWNER/BUILDER, DUE TO THE VIOLATION AND DEVIATION, AS THEY HAVE ALREADY BOUGHT IT KNOWINGLY WELL THAT THERE IS VIOLATION.
