– High court cites “larger public good”
August 16, 2013, was the day, HAL revoked the NOC issued to K Raheja group for the construction of high rise residential complex, stating that it had been provided with wrong information(misrepresentation of facts and falsification) about the elevation of the land on which the apartment complex was being built.
M/S. Chalet Hotels Private Limited, the company executing the project, promoted by K Raheja Corp Group, had applied and got the NOC from from HAL in 2012. HAL claimed that it had been informed earlier that the final height of the buildings will not go beyond 870 meters above mean sea level. But it turned out that it would be 932 meters.
The builder approached the court.
The High Court on 27th Feb 2014 gave a shocker to the people who have bought flats at the Raheja Vivarea apartment complex in Koramangala Industrial Layout.The court said that if a case was made out for the larger public good, these people would have to make sacrifices.
The court gave buyers an option
The court said, “I understand your pain. But this issue concerns larger public issues and public safety. You may have to sacrifice for the larger public good. Your rights have to yield to larger public interest. If you lose, you may go ahead and file suit for damages from the builder and HAL.“
The matter is still pending and the final judgment is awaited.
