I am trying search information on Service Tax on the Apartments in your blog, however not able to find any information on the same.
Request you to share the link or let me know how to calculate service tax. I read somewhere that there is no service tax on the amounts paid to builder before 1st july 2010, Is it True?
It is not so. There are various other conditions associated with it.
Please check with your CA for the actual calculation or visit CBEC.GOV.IN and click on service tax for more updated amendments.
my name is rizwan. i have purchased d plot in bellary in rameshwari nagar. it size is 40×50
i have taken d plot at 8lac.While i was taking the plot .The owner of plot doesnt have the title deed. He told that he misplaced d title deed. & v r interested to take d plot so v have enquired in sub registrar and check EC and other doc like Khata,tax paid,order copy etc… it was clear in his name.He was having all this doc’s with him & owner of plot took d duplicate copy of document from sub registrar. by this document the plot was registered in my name now property is in my name and i have done all other doc in my name like Khata , order copy. etc….
after 18 months i.e 1 and half yr compltion of register.I have came to knw that previous owner of plot has taken loan from LICHFL but in plot ther is no house constructed i have came to knw that previous owner of the plot have done fraud for LIC .
i have cme to knw dat d original title deed is with LICHFL .
please tel me ownership belong to me r others like Lic or previous owner. what step i must take in against this case…….plz go through this case and plz tel d valuabel sujestion …plz do rply
The LICHFC has the first charge on the property. The loan amount along with other charges had to be cleared. You may initiate legal proceedings against the seller, but would take its own due course. You are not the absolute owner, till the loan is cleared and katha is transferred to your name.
Please check with LICHFC.
but katha is in my name and all other documents has been transferred to my name. except loan…..every document is perfect from my side…
When you have every document perfect, why are you posing queries?
i’m worried abt loan and i dont have title deed of previous owner(seller).

This site has been a good source of knoweledge about the basic issues that an ordinay person encounters for purchasing a property in bangalore. You guys are doing a good job. On my part, I do visit this site regularly to get an idea about various issues like sakrama/regularisation which I need badly for my property. The information I get here is better or faster than some of the leading newspapers. Congrats and hope this site does all the needful for everyone.
If you have a site within BBMP limits,(except green belt) will be regularised, if everything goes as expected.

Need your help on following two points:
1) Few days back there was a news on reduction in the stamp duty for the property registration, needed to know if you have any update on the same.
2) Lot of people are registering the properties at the guideline values, so sale deed contain only the guideline value, what do you recommend?

How to find if the site is in green belt or not?
It is not available on the net. You have to visit the concerned planning authorities to find out the zone and areas.
Based on various instances of fraud thats happening while purchasing a site, I have the following queries
I have a copy of sale deed of a site(i.e.,BDA approved) which I am considering to purchase.
a) Is it possible that a owner can sell the same site to two parties? How do I ensure that the owner is not cheating me? what are the ground work that I need to do before going for registration in addition to legal verification?
b) Owner is ready to show the original document after legal verification(of the copies). how can we make sure that the documents are not forged?

a). NO. It is difficult.Generally, all the documents executed the SR offices will be shown in the EC. If there is any pending litigation without an injunction order or an interim order or a stay order, is difficult to find out. Even if there is a stay order, it will not be displayed in the EC. Sometimes, we have detected that stay order is not for a particular site and for the entire layout or survey number. The unsuspecting buyer goes ahead and register the property.
ADDITIONAL SAFEGUARDS: PUBLISH OR INVITE OBJECTIONS THROUGH A PUBLIC NOTIFICATION IN THE LEADING NEWSPAPERS. VERIFY THE LITIGATION AT THE JURISDICTIONAL COURTS.
b). Ask your advocate to check it and cross verify it with the certified copy obtained from the SR Office.
Conduct investigation on the certified copies obtained from SR office,BBMP and BDA.
Verification of application, allotment,possession,katha, family tree(re seller) and tax payment at BDA is also important.
