`A`Katha – How did you get it ?


There is an investigation being conducted by the authorities regarding the register and transfer of A Katha in BBMP for the buildings which have violated the building by laws and deviated from the sanctioned building plans.  Furthermore, How A Katha was issued to properties on Raja kaluve and Lake bodies is being investigated.

75% of the buildings and houses have deviated from the sanctioned plan and violated the by laws and are legally ineligible to obtain A Katha, but many illegal apartments have A katha.

Before the purchase of the apartment or the site, check the A katha and how it was registered or transferred or issued?

Apartments without Occupancy Certificates have A katha, which is illegal and have obtained it through fraudulent manipulation and misrepresentation of facts, liable to be cancelled automatically.

There are only 36 Occupancy Certificates issued by the BBMP in the last few years and it is startling to know that majority of the apartment complex have A katha without proper documentation and compliance to the prevailing laws.

In Bommanahally Zone, It is said that one housing complex having violated more than 60% to 75% obtained A katha with the connivance of the BBMP Officials, which is under scrutiny.

AE, Many have A Katha and have built houses on the Raja Kaluve and on the periphery of the lake, have defective titles and discrepancy in the survey records.

BUYING A PROPERTY/APARTMENT IN ARKAVATHY LAYOUT ZONE – WATCH OUT


THERE ARE TOOOOOOOOO MANY COMPLEX ISSUES SURROUNDING THE ARKAVATHY LAYOUT SITES AND APARTMENTS.

BESCOM HAS GIVEN US CONNECTION.

BESCOM IS A MERCHANT ESTABLISHMENT, THOUGH OWNED BY THE GOVERNMENT, IS A SUPPLIER OF ELECTRICITY FOR A TARIFF(PRICE).  THE ELECTRICITY CONNECTION IS PROVIDED BASED ON THE ABOVE STATED KATHA, WHICH IS IRREGULAR OR ILLEGAL, CANNOT CONFER ANY RIGHT, TITLE AND INTEREST. HENCE THIS AVERMENT DOES NOT STAND THE LEGAL VALIDATION.

BWSSB- CAUVERY WATER CONNECTION – IS ALSO A PUBLIC UTILITY AND A PROVIDER OF WATER FOR A TARIFF AND ANY CONNECTION OR SUPPLY DOES NOT ENTITLE THE PRECIPITANT ANY RIGHT, TITLE AND INTEREST.

KATHA MUST HAVE BEEN OBTAINED ON AUTHENTIC AND GENUINE DOCUMENTS WITHOUT CONTRADICTING ANY PROVISIONS OF THE APPLICABLE LAW, LIKE KARNATAKA MUNICIPALITY ACT, KARNATAKA LAND REVENUE ACT, KTCP ACT, KARNATAKA LAND REFORMS ACT, RDPR ACT, BDA/BMRDA ACT AND OTHER APPLICABLE AND RELEVANT ACTS. 

HENCE, A THOROUGH EXAMINATION OF KATHA AND HOW IT IS OBTAINED AND THE BASIS ON WHICH IT IS OBTAINED IS ALSO CRUCIAL TO VALIDATE THE TITLES.

B Katha Sites (few) in Bangalore East is recovered by the Government


Some properties which are encroached by the land mafia and sold to innocent persons with B katha in Bangalore East Taluk had been recovered by the Authorities.

But not all B kathas comes under the purview of the encroached properties, very few sites and apartments built on such lands will be recovered by the Government today or tomorrow.

Khata faked to change status of hundreds of revenue sites

BANGALORE: In 2009, P Hanume Gowda who worked as a manager with a private company purchased a 1,250 sq ft revenue site for Rs 10 lakh from a realtor at Vidyaranyapuram, near Yelahanka, north Bangalore.

Post retirement, Gowda decided to pool in all his savings and build his dream home but fell short of Rs 5 lakh.

He desperately tried to raise loans from various banks. But his application was rejected on the ground that his revenue site didn’t have the required clearances. Gowda didn’t lose heart. Instead, with the help of a tout, he approached a BBMP officer in the revenue wing and sealed a murky deal.

The deal was to upgrade his ‘B’ Khata (certificate without title deeds and deviations) to ‘A’ Khata (certificate issued for no deviations and property ownership), provided he paid a betterment fee of Rs 2 lakh and service charge (read bribe) of Rs 3 lakh. An elated Gowda agreed to the deal but on the condition that he would pay the money only after raising the bank loan and after the BBMP issues him an ‘A’ Khata. Gowda’s decision was worth the money he spent as the value of the property has increased by about four times since.

In what’s being perceived as one of the biggest bribery scandals of recent times, hundreds of such instances of Khata manipulation are tumbling out of the BBMP’s closet . “It has not only caused significant losses to government coffers but also rendered the proposed Akrama-Sakrama scheme (regularization of building byelaw violations and land use in urban areas) redundant,” said a BBMP official.

Chief minister Siddaramaiah, who got a whiff of the scam at a recent meeting held to discuss the garbage crisis, has ordered an enquiry, which is to pull out more skeletons from the BBMP’s cupboard. “During preliminary investigations we found some 2,000 revenue sites being issued ‘A’ Khatas in one particular area. There could be several more,” said an RTI activist, who blew the lid off the scam.

How it all began

It all began earlier this year after a cash-strapped BBMP came out with a scheme to mobilize revenue of about Rs 200 crore. Corrupt officials, meanwhile, sparingly began issuing ‘A’ khata to revenue plot owners after fixing a sum for faking required clearances. The BBMP scheme though was intended to regularize revenue sites which had all the required documents such as the chain of title conveyance, sale agreement, tax receipts, and mutation extract but only awaiting the stamp of legitimacy from BBMP.

* Revenue sites are plots that lack clearances, particularly land use conversion and layout plan approval

* According to rules, an agricultural land can be used for residential or commercial purpose only after land use conversion is approved either by the panchayat or the deputy commissioner

* Layout plans are approved by civic agencies like the BDA or the jurisdictional local planning area authority. These agencies grant clearances only after certain portion of the land is earmarked for civic amenities

* An ‘A’ Khata may double the property’s value as it becomes legitimate and eligible for bank loans.

THE HIGH COURT OF KARNATAKA HAS QUASHED THE ORDER OF THE BBMP REGARDING THE COLLECTION OF IMPROVEMENT CHARGES AS UNFAIR AND DIRECTED THE BBMP TO DEVISE A MECHANISM TO LEVY IT SYSTEMATICALLY.  THE BBMP SUB COMMITTEE RESOLVED TO LEVY RS550/- A SQUARE METER AS IMPROVEMENT CHARGE BASED ON THE OBSERVATION MADE ON 28-09-2012 BY THE COURT, THE COURT HAS TERMED IT AS UNFAIR AND HAS DIRECTED THE BBMP TO REVISE IT SYSTEMATICALLY.

BMRDA

Bangalore Metropolitan Region Development Authority (BMRDA) is an    autonomous body created by the Government of Karnataka under the BMRDA Act 1985 for the purpose of planning, co-ordinating and supervising the proper and orderly development of the areas within the Bangalore Metropolitan Region (BMR) which comprises Bangalore urban district, Bangalore rural district and Ramanagara district.

As per the Structure Plan, apart from BMA (BDA jurisdiction), the rest of the Bangalore Metropolitan Region [BMR] is divided in to five Area Planning Zones (APZ’s) and six Interstitial Zones (IZ’s).  The APZ’s  are proposed along the corridors, which are (1) Bangalore-Bidadi (2) Bangalore-Nelamangala (3) Bangalore-Devanahalli (4) Bangalore- Whitefield, Hoskote (5) Bangalore-Anekal, Sarjapur-Hosur.

The Area Planning Zones (APZ’s) are areas  where urban development is permitted subject to certain regulations.  The Interstitial Zones are the areas lying between APZ’s where urban activities are restricted giving more emphasis to environmental – issues like conservation of forest area, agriculture etc.

For planned urban growth Local planning areas under Karnataka Town & Country Planning Act-1961 are declared in the five APZ’s and IZ’s 1 & 2.  The following are the Planning / Development Authorities functioning in the Bangalore Metropolitan Region (BMR).

 IT IS TO BE NOTED THAT THERE ARE OVER (ESTIMATED) 2000 ILLEGAL AND UNAUTHORISED LAYOUTS IN BMRDA/BDA JURIDICTION.  VILLAGE PANCHAYAT KATHAS HAD BEEN ISSUED TO SUCH PROPERTIES AS GRAMATHANA SITES.  EVEN, SITES IN GREEN BELTS HAVE KATHA.(VERY STRANGE) 424 LAYOUTS HAD BEEN NOTICED OR FOUND OUT, BUT THERE ARE OVER FEW THOUSAND LAYOUTS BEING FORMED/CARVED AND SOLD.  BANKS AND FINANCIAL INSTITUTIONS HAVE FINANCED MANY SUCH PROPERTIES.  ANOTHER STRANGE ILLEGALITY IS THAT THE VILLAGE PANCHAYATS HAVE APPROVED THE LAYOUTS IN BMRDA AND BDA JURISDICTION WITHOUT ANY AUTHORITY OR POWER DELEGATED TO IT.  AS LONG AS FOOLISH BUYERS ARE THERE, SUCH ILLEGALITIES WILL THRIVE AND THE BUYERS ARE LURED BY CHEAP/LOW/TEMPTING OFFERS BY THE LAND MAFIA.

PROPERTY BUYERS, WAY BACK IN 2005 AND EARLIER WERE BUYING REVENUE SITES AND ALL OF A SUDDEN, IN 2005, THE REGISTRATION AND TRANSFER OF REVENUE SITES WERE PROHIBITED BY THE COURT AND THE GOVERNMENT. REVENUE SITES OWNERS REALISED THEIR FOLLY, THEN. 

MANY OF THE ILLEGAL CONSTRUCTIONS/BUILDINGS/APARTMENTS DO NOT HAVE KATHA AND HAVE ONLY `B`FORMS OR KATHAS. INSPITE OF IT, THESE PROPERTIES ARE BEING TRADED IN THE MARKET.

IT HAS BEEN BROUGHT TO OUR NOTICE THAT THE KATHAS (INDIVIDUAL SITES WITH DETAILS IN SQUARE FEET)FOR THE PROPERTIES WHICH ARE DC CONVERTED AND HAD FORM NO.9 AND FORM NO.10, CMC KATHAS, IN DC CONVERTED AREAS AND OLD CMC AREAS (INDIVIDUAL SITES AND APARTMENTS,CMC/FORM NO.9 AND FORM NO.10.KATHA) MIGHT PAY THE IMPROVEMENT CHARGES (SITES ONLY)TO BBMP AND GET KATHA.

FORM NO.9, FORM NO.10 AND  PROPERTIES IN CMC AREAS MUST HAVE INDIVIDUAL KATHA AND KATHA EXTRACT (CLEARLY STATING THE EXTENT)AND NOT THE SURVEY NUMBERS.  THE SITE MEASUREMENT MUST BE MENTIONED IN SQUARE FEET.  SUCH PROPERTIES MIGHT PAY THE IMPROVEMENT CHARGES AND OBTAIN KATHA.

BUT MORE  DETAILS ARE NOT AVAILABLE AND ARE TRYING TO OBTAIN THE DETAILS FROM DC REVENUE IN FEW DAYS.

THE CABINET HAS PASSED A RESOLUTION TO BRING IN THE NECESSARY AMENDMENT TO KARNATKA LAND REVENUE ACT IN THE CURRENT PROCEEDINGS IN THE VIDANA SABHA TO REGULARISE THE REVENUE SITES WITHIN BBMP LIMITS AND COLLECT THE CONVERSION CHARGES AND IMPROVEMENT CHARGES.  THIS WILL PAVE WAY FOR THE ISSUE OF BBMP KATHA TO ALL THE REVENUE SITES AND THUS IT WILL GET REGULARISED.  THE GOVT NEED NOT WAIT FOR AKRAMA-SAKRAMA, WHICH IS YET TO COME OUT OF THE HIGH COURT.

BUT ILLEGAL BUILDINGS, BUILDINGS WITH VIOLATIONS AND DEVIATIONS TO BUILDING BYLAWS AND SANCTIONED PLANS HAVE TO WAIT FOR AKRAMA-SAKRAMA.  THE BBMP IS EXPECTED TO MOP UP AROUND RS1,500/- CRORES THROUGH THIS PROCESS.

B FORMS OR KATHA AND BUILDING PLAN SANCTION


BBMP is not sanctioning building plans for the properties which has `B` Forms or Kathas.  There were innumerable queries and requests to obtain sanction of building plan from our readers from BBMP.  We wish to state that BBMP IS NOT ISSUING OR SANCTIONING BUILDING PLANS BASED ON THE` B` FORMS as of now.

Some builders and agents might promise to get the Genuine Katha or get the plan sanctioned, to sell the properties.  Make sure, all the documents are thoroughly examined and have complied with statutory requirements as per KMC ACT, KLR ACT AND KTCP ACT.

The sale of revenue sites was banned in 2005 by the Government.  In 2010, the Government relaxed the norms due to various political compulsions and permitted the registration based on the issuance of prescribed forms directly sent to the Sub-Registrar by the Chief Executive Officers.  The Government eased the process with`B` forms in BBMP areas.  It could be used only to sell the properties.
