The Apex Court was hearing an URGENT HEARING of AKRAMA – SAKRAMA, an application filed by the Government Of Karnataka – seeking to revoke/vacate the STAY on the scheme – but the SC relented to revoke the Stay.  The Stay continues.

NO RELIEF FOR THOSE, WHO HAVE COMMITTED AKRAMA, (Illegal layouts, revenue sites, farmhouses, farmlands in and around Bangalore, illegal buildings and unauthorized constructions)but have to live with the hope someday that they might get regularised.

ENCROACHMENTS IN BANGALORE SOUTH WILL BE CLEARED IN WAR FOOTING -CHIEF MINISTER


The Chief Minister has directed the district administration and the BBMP to clear the encroachment of Raja Kaluve, Secondary Channels and the lake bed buffer zone encroachments in Bangalore south and also in other zones without any mercy.  The illlegal and DC Converted layouts and Revenue lay outs will be affected.

It is to be noted that many notorious builders have downsized the raja kaluve and have put up structures and are using it as park and for parking.  The matter has also been looked into and all such constructions and structures must be removed and criminal action must be initiated against such builders.

The NGT order on the Buffer Zone will have a serious impact on the projects which had been completed and which are under construction, but now now.

The buyers must conduct due diligence, while buying properties which are close to lakes or which are within the periphery of the Raja Kaluve and Lakes as during the course of reconstruction ( as most of these structures cannot stand for more than 30 to 50 years) the UDS and the SBA goes down substantially and the occupiers of such flats will be severely affected.

Some builders, resellers, agents, marketing firms and brokers are marketing/selling such projects or properties stating that the properties/projects are approved by BANKS and they have registered many such properties.

Bank loan does not CONFER ANY RIGHT, TITLE AND INTEREST AND REGISTRATION OF SUCH PROPERTIES IN CONTRAVENTION TO THE ORDERS OF THE COURTS AND THE PREVAILING LAWS ARE NOT VALID.

Banks, hand in glove ( What else ?) approve the projects, if the buyer or the owner is dispossessed of his property due to defective title or discrepancy or violation or deviation, the BANKS will not waive the loan.  The Banks recover their monies from the borrower at any cost, either from the borrower or from the co-applicant or from the guarantor or by attaching the salaries of all the concerned or by attaching the bank accounts and other properties of the borrower, co – application and the guarantor.

POLICE STATION SOLD IN BANGALORE-FAKE DOCUMENTS-A NEWS REPORT


A NEWS REPORT:

A man in Bengaluru sold off a piece of land that housed a local police station, presenting it as a residential plot with forged documents.

A cheat in Bengaluru took the art of con to a whole new level by forging all property documents and trapping a clueless buyer and sold off a piece of land that houses a local police station! (The seller offered it at a throwaway price and the buyer might have been tempted at such a price) (This is the simplest trick)

The cheat created fake property documents and furnished them to the buyer and collected a good amount before decamping. The said property is a POLICE STATION.

It was when some construction workers KNOCKED at the doors of the Kamakshipalya traffic police station to build a shed in the compound, the policemen learned what has gone down.

The best part of this story is that a man claiming the land has always belonged to him – and he even produced fake documents in court claiming he currently resides on this land, meaning in the police station.

In a similar, but different case and property in Marathahally, a cheat created a fake document and even got the BBMP `A` katha in the name of the dead person and got it registered.  The buyer was not even aware of it till date.

A layout on sarjapur road, developed by a prominent builder has discrepancies in title and the builder is very well aware of it and had sold a big junk of the layout (10 years old) and the legal heir or the share holder does not even know that her signature had been forged.

Another layout on sarjapur road, approval of the layout has BBMP seal and signature but the original plan has a totally different XXXXXXXXXXXXXX.  The builder has happily sold it and none of the buyers are aware of it, till today.

There are too many such instances across the state.

THE BBMP TODAY DEMOLISHED THE COMPOUND WALL OF THE MANTRI TRANQUIL APARTMENTS AT GUBBALALA, KANAKAPURA ROAD, BANGALORE, CLEARING THE ENCROACHMENT OF RAJA KALUVE.

IT IS ALLEGED THAT THE PROMOTER HAD ENCROACHED THE RAJA KALUVE AND ALSO LOCATED THE GUEST PARKING IN THE GOVERNMENT LAND AND ON THE DIRECTIONS OF THE HIGH COURT ORDER, THE ILLEGAL STRUCTURES WERE REMOVED AMIDST OPPOSITION FROM SOME QUARTERS.

They squatted in front of the earth movers but could not stop a portion of the wall being brought down

All tranquillity was lost at the ‘Mantri Tranquil’ apartments off Kanakapura Main Road on Tuesday as BBMP’s earth movers demolished a part of the compound wall, catching residents unawares.

Bruhat Bangalore Mahanagara Palike workers, who arrived with at least 20 policemen, claimed that the apartment was encroaching on a storm water drain. Residents protested by squatting in front of the earth movers even as a portion of the compound wall was brought down.

President of the Residents’ Association, M.S. Raghuram, claimed that they had not been informed about the demolition. On July 30 this year, they got a notice stating that the building had encroached on a storm water drain. Residents filed a writ petition in the High Court questioning the notice.

“The hearing was scheduled for Tuesday. We requested BBMP workers to hold on until the court had ruled on our petition, but they did not listen to us,” he said.

Residents said there was no mention of the storm water drain in any document provided to them at the time of occupancy. “The apartment plan was approved by the Bangalore Development Authority and BBMP had issued a khata. Now, they are showing a map dated 1905 and claiming that there is a storm water drain,” said P.S. Kulkarni, Managing Committee member of the association.

The residents also alleged that there was no clear point of reference marking the location of the storm water drain. “There is a lot of land extending beyond our apartment complex. Why was our apartment land selectively chosen for the demolition?” a resident said.

Meanwhile, residents got temporary relief as the High Court stayed the BBMP’s actions.

Civic officials, however, said there was no stay order at the time of the demolition and they will now await the court’s decision. They claimed that they had conducted a survey of the storm water drain and denied issuing khata for the apartment.

It was a startling morning for the 1,131 flat owners of Mantri Tranquil Apartments in Gubbalala near Uttarahalli after they woke up to the sight and sound of BBMP officials and bulldozers arriving to demolish a alleged structure that allegedly encroached upon a storm water drain.

Residents claim that the civic agency was acting ilegally and without serving them any notices. Mantri Tranquil Apartments owner association president M S Raguram questioned the BBMP’s actions, terming it illegal. He asked how the BBMP could demolish the structure without even giving notices.

He claimed that the BBMP had served a notice on July 30, 2014 stating that we have encroached on a storm water drain. But the notice made no mention of any specific date for demolition nor any kind of action that would be taken. Following the notice the association had obtained stay orders from the High Court, he said.

Shashikant Joshi, another resident said that BBMP officials illegally demolished the compound wall and were about to demolish other structures “but it was the efforts of all the apartment residents that forced them to step back”, said Raguram.

When contacted, the BBMP commissioner said that the issue had come to his notice and he has asked officials not to initiate any further demolition. He said, “Now we have come to know that the matter related to Mantri Tranquil Apartments is subjudice we have stopped. We have asked the survey department to provide the report which claims that the apartment has encroached a storm water drain.”

He added, “Now we are not touching the building. Let the report come in and then we will take action. Before initiating action we will ensure that we have firm legal advice.”

Local corporator Ramesh Raju said he had demanded a re-survey of the storm water drain. If at all the drain is encroached then it’s not only Mantri’s property but other properties that will also have to demolished as well, he said.

In August the Bangalore Electricity Supply Company had cut the power supply to two blocks comprising about 400 flats following a letter from the BBMP stating that Block-C and Block-D of Mantri Tranquil have encroached upon a natural canal.

The action was taken based on a survey sketch prepared by the Deputy Director of Land Records (DDLR) of Bangalore Urban District last year and attested by revenue officials including Bangalore South Tahsildar on December 6, 2013.

 Have you registered a site or building on revenue land in Bangalore’s outskirts in the past year or so? Just ensure the documents are authentic. 

In a land-registration racket that has come to light, fraudulent transactions using fake assessment register extract (Form 9) and tax demand register extract (Form 11) to register properties have been going in many gram panchayats on Bangalore’s periphery. 

Sources point to an alleged nexus between real estate agents and revenue department officials. 

“We’ve written to sub-registrar offices to thoroughly verify Forms 9 and 11 before registering any property, after we received complaints,” said rural development and panchayat raj principal secretary TM Vijaya Bhaskar. 

Sources said at least 5,000 properties were registered in Bangalore with fake forms. This began after the rural development and panchayat raj (RDPR) department, in its January 4, 2013, circular directed gram panchayats to restrict distribution of Forms 9 and 11 to genuine property buyers. These two extracts are mandatorily sought by sub-registrars, among other documents, for registration of new and old residential sites. 

The circular was issued to prevent the mushrooming of illegal layouts and prohibit panchayats from sanctioning building and layout plans in violation of land revenue laws. The department found that fake tax extracts were submitted during this period by different panchayats under the same registered numbers. 

Smelling a rat, the RDPR department ordered criminal proceedings against those who submitted fake forms. 

“Lakhs of rupees have been wrung out of the exchequer through fraudulent transactions in which employees of revenue and panchayat raj offices were involved. The racket came to light after the RDPR was alerted about such deals,” said a senior official instrumental in unearthing the scam.

Flooding of residential areas during monsoon


It has been noticed that during this monsoon season some of the residential areas and even apartment blocks have been flooded.  It is to be noted that most of these residential areas affected are revenue and DC converted layouts, without any proper layout plan have encroached  water bodies, nalas, lakes, and Raja kaluve and are low lying areas or valleys where the water use to drain.

In one such apartment block, situated at kadugodi, the builder was warned about the encroachment of the raja kaluve and a part of the large water body, but, with the connivance of the politicians and the corrupt bureaucrats, built apartments and sold it. The apartment block was flooded during this monsoon.  The residents or the property owners are left to fend themselves. The builder, the banker, the bureaucrats and above all the buyers are to blame. (THIS APARTMENT DOES NOT HAVE CC AND OC)   Even the financial institutions/banks are also involved in these illegal activities by providing home loans and approving the projects.

LITTLE COMMON SENSE IS REQUIRED, WHILE CHOOSING A LOCATION.  NEED NOT HAVE ABNORMAL AND EXTRAORDINARY KNOWLEDGE OR INTELLIGENCE.

DO NOT CHOOSE ANY PROPERTY, VERY CLOSE TO ANY WATER BODY OR LOW LYING AREAS, VALLEYS, RAJA KALUVE OR AREAS WHERE THE SOIL IS LOOSE, WHERE THE ROADS ARE VERY CONGESTED OR THERE IS ANY DEVIATION OR VIOLATION OF THE ANY OF THE RULES AND REGULATIONS.

ILLEGAL AND UNAUTHORISED LAYOUTS WITHIN BDA LIMITS


THERE IS A NEWSPAPER REPORT REGARDING THE ILLEGAL AND UNAUTHORISED LAYOUTS WITHIN THE JURISDICTION OF BDA AND THE TOWN PLANNING AUTHORITIES HAVE STATED THAT THERE ARE OVER 1000 SUCH LAYOUTS.  THE OFFICIAL BDA WEBSITE STATES THAT THERE ARE 120 LAYOUTS BUT UNOFFICIALLY IT IS 1000. ALL THESE ILLEGAL LAYOUTS ARE WAITING FOR AKRAMA-SAKRAMA FOR REGULARISATION.

Gated Communities- Barricading the roads and civic amenity sites in layouts !!!!!!!!


Any citizen or an aggrieved community can lodge a police complaint against such groups or persons and can complain it to BDA/BMRDA/BBMP regarding such closures or barricading the roads and civic amenity sites.  All the roads and Civic Amenity sites belongs to the Government.  In case of illegal or unauthorized layouts claiming to be gated community, (without DC conversion and layout approval by BDA and BMRDA) the aggrieved citizens can complain about it to the BDA/BMRDA and to the local police.  Action will be initiated against such unauthorized layouts/illegal layouts under KTCP Act. The roads and CA sites in the approved(BDA/BMRDA/DTCP) layouts belongs to the Government.  The layouts which are not approved by the aforesaid authorities are illegal or unauthorised.  In such layouts, if the roads are barricaded or blocked by interest groups, the issue may be brought to the notice of the BDA/BMRDA/BBMP for appropriate action.

In May 2008, the BBMP issued a PUBLIC NOTICE with regard to barricading layouts and preventing use by general public. The notice says that there is no such concept as ‘Gated Community’ and that once such layouts are formed; they come under the jurisdiction of the respective municipal corporation.

By putting a barricade if the roads are closed, that closure is not permissible because what is recognised is only a layout. There is no special status to a gated community. In an approved layout, the roads and the civic amenity sites are relinquished in favour of the Governor of Karnataka or to the State Government.  As such, the roads and the CA sites becomes the property of the Government. So a gated community ultimately boils down to a layout, which is enclosed by a barricade or security. Nobody can be prevented from entering as such. Once the roads and the CA sites are relinquished in favour of the local authorities or the Govt or the Governor of karnataka, the right vests with the state and every citizen of the country can use such roads.

City Municipal Council Sites

There WERE 7 City Municipal Councils and one Town Municipal Council surrounding the Bangalore city. The sites in the limits of these authorities are mostly owned by private individuals, some of the sites are acquired by Government. Infrastructure is very poor. The process of tracing the title is very complicated. But some extra pre cautions need to be taken. Verify whether the betterment charges have been paid, if not purchaser may have to pay it in the future. Many lands in the area of these local bodies are agricultural lands and conversion to non-agricultural purpose must have to be done. Presently City Municipal Councils have stopped collecting betterment charges and issuing Khatas. If the owner doesn’t have a Khata, he cannot construct the house with the plan approved from CMC.

Site in private layouts

These are layout formed by private parties, other than statutory development authorities. Many reputed land developers have formed layouts around the city. Verify all the documents as required in case of private property for a period of 43 years. Apart, from the above check whether the land is converted for residential purpose, and the layouts are approved by BDA or BMRDA. Verify the records with respective offices. Many numbers of private layouts with D.C. conversion and panchayat approval are available. Purchase of these type of sites involves little risk.

Gramathana Sites

These are residential sites, which were originally available in village panchayat areas. They can be distinguished from Kaneshumari number, assigned to them. The agricultural lands have survey numbers. The sites of this nature are very few. Government has put restrictions on issue of license for construction by village panchayats beyond their approved Gramathana area, original Gramathana sites can be identified by examining old village survey maps available in survey department. Examine all the records as is done in case of private property. In addition verify the village records and form No. 9 and 10. Form No. 9 denotes Gramathana site and form No. 10 denotes the building, which confirm that the particular property is original Gramathana site or not. But many village panchayats issue from No. 9 & 10, though they are not Gramathana sites. Many such sites fall in green belt area, where construction of residential buildings is restricted. Extra caution is necessary while buying Gramathana Sites.
