SEVERE DROUGHT IN KARNATAKA


Harsh summer, Power and Water shortages in Bangalore and Karnataka in 2016

Karnataka and Bangalore is staring at a critical water shortage and a harsh summer, this as experts feel is worst in 40 years.

The state government has already declared drought in 136 talukas, this in itself considered the worst in 40 years.

Bangalore`s Whitefield, Electronic City, Sarjapur Road, Hebbal surrounding newly developed areas in Bangalore north is badly affected by the dwindling ground water levels.  Many bore wells are dry and water tankers are the only hope for the commercial and residential establishments.

6,000 to 7,000 liters of untreated raw water is sold at Rs.300/- per tanker to Rs.900/- a tanker in February, 2016 and due to severe shortage of water, the tariff is on the rise, it might reach Rs.1,500/- a tanker by May, 2016, if there are no rains.

Due to the fire at linganamuki/sharavathi hydro project, the power situation is equally grim.

The entire state is facing a severe drought and shortage of drinking water is of serious concern.

 

 

NATIONAL GREEN TRIBUNAL VACATES THE INTERIM STAY ON KEMPEGOWDA LAYOUT


The Bangalore Development Authority submitted the NOC from the Clearance from the Pollution Control Board and the NGT (Southern Zone) vacated the interim stay granted on the development of Nadaprabhu Kempegowda Layout.

The NGT has stayed the development of Kempegowda layout as the BDA has not obtained the Environment Clearance from the KSPCB and it is alleged to have been being developed on the lake.

NATIONAL GREEN TRIBUNAL (SOUTHERN ZONE) ISSUES NOTICE TO BANGALORE DEVELOPMENT AUTHORITY – SANCTION OF HIGH RISE BUILDING PLAN ON THE LAKE BEDS


The NGT(SZ) has issued notice to BDA to appear before it on 28-01-2016 regarding the sanction of building plans to several builders on the lake beds, valleys and buffer zone.  Sriram Chirping woods and another builder is coming up with thousands of apartments across Kasavanahally lake, haralur lake, kaikondarahally lake, agara lake and few more water bodies in Bangalore East taluk, in Varthur Hobli, Bangalore Urban District.

Several public interest organisation have been submitting their objections to BDA/BBMP/KSPCB and to all the sundry departments regarding the ADVERSE ENVIRONMENTAL IMPACT and the BDA/BBMP have been sanctioning the plans without bothering about it.  Finally, the NGT AND THE SUPREME COURT OF INDIA stepped in and stopped the construction.  

Few more builders are also fighting the suits in Begur Hobli, Bangalore South Taluk, might have to shelve the projects, which began in 2009.  These builders are fighting various criminal and civil suits.  These projects have destroyed the delicate environment cover to the entire area of Bannergatta road and the surrounding areas.  In these zones, 75% of the buildings have violated even the dangerous building plans sanctioned by over 200%.  The culprits are the builders, officials, owners, local bodies (panchayats). BDA, BBMP, politicians and other government bodies like KSPCB, BESCOM, BWSSB who have deliberately ignored the nature`s law.  Finally, the Banks and the most important are the BUYERS.  Had the buyers, rejected or refused to buy illegal, unauthorised, irregular and dangerous buildings, these builders or developers WOULD NOT HAVE BUILT THESE ILLEGAL BUILDINGS AT ALL.

The buyers blame the Government, but ultimately, they are the sufferers and expect sympathy and regularisation at the cost of the honest tax payer. 

BDA PROPOSE TO COME UP WITH 13100 APARTMENTS AT VARIOUS PARTS OF BANGALORE


The Bangalore Development Authority has plans to come up with 13,100 apartments at economically reasonable prices at various locations in Bangalore to cater to the needs of the society and the plans are afloat. The present allotment of 3280 apartments has already created ripples among the builders community.

This proposal may hit the builders hard as the location and construction MIGHT be on part with the builders and the prices are naturally much lesser.  The only concern is that the construction QUALITY must be competitively good.

This is a major blow to all the mid sized apartment builders as they are reeling under severe financial crunch due to unsold inventory.

The titles of the apartments might be better off than the private builders and the compliance to the statutory norms will be followed by the BDA. 

We, hope that the quality of  construction will be good and it will be delivered on time to the midsegment of the society at reasonable prices.

The BDA has notified the availability of 3280 apartments in Bangalore and has invited the applications for the allotment for the eligible applicants.

It is said that the construction quality and the location is comparatively be better than many private builders as there is no violation and deviation.  The price at which it is offered is also competitive.  

 

BDA MAY EXTEND THE DATE FOR SUBMITTING THE APPLICATION FOR THE ALLOTMENT OF SITES IN NADAPRABHU KEMPEGOWDA LAYOUT


The State Government is contemplating to extend the date to submit the applications by a fortnight for the allotment of sites in the newly developed layout in Bangalore South and Bangalore North taluks under the name of Nadaprabhu Kempegowda Layout.

It is said that over 40,000 to 50,000 applications have been submitted till yesterday for the sites, even at such exorbitant prices. Most of the applicants have been waiting for years with 4,5 and 6 attempts, since 1980`s and 1990`s.

It is widely believed that this might be the last layout.  But, there is life in the proposed Dr.Shivarama Karanth Layout tooooooooooo.

BDA SITES – Kempegowda Layout


The BDA is allotting 5000 sites in Nadaprabhu Kempegowda Layout, which is located amidst Bangalore South and North Taluk, of which 2,500 sites are for special category and 2,500 sites are for the common man or general category.

The BDA has already sold over 40,000 applications and expecting around 1,00,000 applications.

The allotment will be done on the seniority basis. (Number of attempts).

Many touts are promising that they will help them/get a site allotted to them and are collecting money.  It is not possible.

There are other few conditions that the applicants must comply with, which the applicants are not aware.  Due to non compliance or violation or misrepresentation of facts or fake annexures, the amount paid may be forfeited or frozen by the BDA.

ವರದಿ ಬಂದ ನಂತರ, ರಾಜ್ಯದ ಇತರ ಭಾಗಗಳಲ್ಲಿಯೂ ನಡೆದಿರಬಹುದಾದ ಇಂತಹ ಪ್ರಕರಣಗಳ ತನಿಖೆ ಬಗ್ಗೆ ಗ್ರಾಮೀಣಾಭಿವೃದ್ಧಿ ಮತ್ತು ಪಂಚಾಯತ್‌ರಾಜ್‌ ಇಲಾಖೆ ತೀರ್ಮಾನಿಸಲಿದೆ.

ಏನಿದು ಹಗರಣ?: ರಾಜ್ಯ ಸರ್ಕಾರ 2 ವರ್ಷಗಳ ಹಿಂದೆ ಕಂದಾಯ ನಿವೇಶನಗಳ ನೋಂದಣಿಯನ್ನು ರದ್ದು ಮಾಡಿದೆ. ಆದರೆ  ಗ್ರಾಮ ಪಂಚಾಯಿತಿ ಅಭಿವೃದ್ಧಿ ಅಧಿಕಾರಿಗಳು ಅಕ್ರಮವಾಗಿ ನಮೂನೆ–9 ಮತ್ತು ನಮೂನೆ–11ಬಿ ವಿತರಣೆ ಮಾಡುವುದರ ಮೂಲಕ ಕಂದಾಯ ಭೂಮಿಯಲ್ಲಿನ ಸ್ವತ್ತುಗಳ ನೋಂದಣಿಗೆ ಅವಕಾಶ ಮಾಡಿಕೊಡುತ್ತಿದ್ದಾರೆ.  ನೋಂದಣಿಯಾದ ಮರುದಿನವೇ ತಾಲ್ಲೂಕು ಪಂಚಾಯ್ತಿ ಕಾರ್ಯನಿರ್ವಾಹಕ ಅಧಿಕಾರಿ ನಮೂನೆ–9 ಮತ್ತು ನಮೂನೆ–11ಬಿ ಪ್ರಮಾಣ ಪತ್ರವನ್ನು ರದ್ದು ಮಾಡುತ್ತಿದ್ದಾರೆ.

ಇಷ್ಟರೊಳಗೆ ಸ್ವತ್ತುಗಳು ನೋಂದಣಿಯಾಗುತ್ತಿವೆ. ಕಂದಾಯ, ಕೃಷಿ ಮತ್ತು ಹಸಿರು ವಲಯಗಳಲ್ಲಿರುವ ಭೂಮಿಯನ್ನು ಬಳಸಿಕೊಂಡು ಅಕ್ರಮವಾಗಿ ಬಡಾವಣೆ ನಿರ್ಮಿಸಲೂ ಇದರಿಂದ ಅನುಕೂಲವಾಗುತ್ತಿದೆ. ಹೀಗಾಗಿ ಸರ್ಕಾರಕ್ಕೆ ಬರಬೇಕಾದ ಆದಾಯ ಕಡಿಮೆಯಾಗುತ್ತಿದೆ ಎಂಬ ಆರೋಪ ಇದೆ.

ಬೆಂಗಳೂರು ಉತ್ತರ ತಾಲ್ಲೂಕು ಪಂಚಾಯಿತಿ ಕಾರ್ಯನಿರ್ವಹಣಾಧಿಕಾರಿ ಮತ್ತು ವಿವಿಧ ಗ್ರಾಮ ಪಂಚಾಯ್ತಿ ಅಭಿವೃದ್ಧಿ ಅಧಿಕಾರಿಗಳು ಈ ರೀತಿ 6510 ಸ್ವತ್ತುಗಳಿಗೆ ನಮೂನೆ–9 ಮತ್ತು ನಮೂನೆ–11ಬಿ ವಿತರಿಸಿ ನಂತರ ಅವುಗಳನ್ನು ರದ್ದು ಮಾಡಿದ್ದಾರೆ. ಈ ಮೂಲಕ ಸಾವಿರಾರು ಎಕರೆಯಷ್ಟು ಭೂಮಿ ನೋಂದಣಿಯಾಗಿದೆ ಎನ್ನಲಾಗಿದೆ. ಖಾಸಗಿ ಬಿಲ್ಡರ್‌ಗಳೂ ಈ ತಂತ್ರದ ಮೂಲಕ ಬಡಾವಣೆಗಳನ್ನೂ ನಿರ್ಮಿಸಿದ್ದಾರೆ ಎನ್ನಲಾಗಿದೆ. ಬೆಂಗಳೂರು ಉತ್ತರ ತಾಲ್ಲೂಕಿನ ಅರಕೆರೆ, ಬಾಗಲೂರು, ಮಾರೇನಹಳ್ಳಿ, ಹೆಸರಘಟ್ಟ, ಹುರುಳಿಚಿಕ್ಕನಹಳ್ಳಿ ಮುಂತಾದ ಗ್ರಾಮ ಪಂಚಾಯಿತಿ ವ್ಯಾಪ್ತಿಯ ಗ್ರಾಮಗಳಲ್ಲಿ ಇಂತಹ ಪ್ರಕರಣಗಳು ನಡೆದಿವೆ.

ಗ್ರಾಮ ಪಂಚಾಯಿತಿ ವಿತರಣೆ ಮಾಡಿದ ನಮೂನೆ–9 ಮತ್ತು 11ಬಿಗಳನ್ನು ಗ್ರಾಮೀಣಾಭಿವೃದ್ಧಿ ಮತ್ತು ಪಂಚಾಯತ್‌ರಾಜ್‌ ಇಲಾಖೆಯ ಪಂಚತಂತ್ರ ತಂತ್ರಾಂಶದಲ್ಲಿ ಪರಿಶೀಲಿಸಿದಾಗ ಈ ಹಗರಣ ಬಯಲಿಗೆ ಬಂದಿದೆ.

ಅರಕೆರೆ ಗ್ರಾಮ ಪಂಚಾಯಿತಿಯ ಕಡತನಮಲೆ ಗ್ರಾಮದಲ್ಲಿ ಒಟ್ಟು 1369 ಸ್ವತ್ತುಗಳನ್ನು ಈ ರೀತಿ ನೋಂದಣಿ ಮಾಡಲಾಗಿದೆ. ಇವುಗಳಿಗೆ ನೀಡಲಾದ ನಮೂನೆ–9ರಲ್ಲಿ ನಿವೇಶನಗಳ ಸರ್ವೆ ನಂಬರ್‌ ಇಲ್ಲ. ಸ್ವತ್ತಿನ ಭಾವಚಿತ್ರ ಇಲ್ಲ. ಭೂಸ್ವಾಧೀನಕ್ಕೆ ಪೂರಕವಾದ ದಾಖಲೆಗಳಿಲ್ಲ. ನಗರ ಮತ್ತು ಗ್ರಾಮಾಂತರ ಯೋಜನಾ ಇಲಾಖೆಯ ಅನುಮೋದಿತ ಬಡಾವಣೆ ಆದೇಶ, ಅನುಮೋದಿತ ಬಡಾವಣೆಯ ನಕ್ಷೆ ಇಲ್ಲದಿರುವುದೂ ಪತ್ತೆಯಾಗಿದೆ.

ಏನಿದು ನಮೂನೆ–9, 11–ಬಿ?
ನಿರ್ದಿಷ್ಟ ಸ್ವತ್ತಿಗೆ ಗ್ರಾಮ ಪಂಚಾಯಿತಿ ಪಡೆಯುತ್ತಿರುವ ತೆರಿಗೆಯ ವಿವರಗಳುಳ್ಳ ಪ್ರಮಾಣ ಪತ್ರ. ಇದರಲ್ಲಿ  ಮಾಲಿಕನ ಹೆಸರು, ಸರ್ವೆ ನಂಬರ್, ತೆರಿಗೆ ವಿವರಗಳಿರುತ್ತವೆ. ಇವುಗಳನ್ನು ನೀಡಿ ಸ್ವತ್ತುಗಳನ್ನು ನೋಂದಣಿ ಮಾಡಿಸಲಾಗುತ್ತಿದೆ.

Revision of Guidance Value/Registration Value of Properties put on HOLD


The Government of Karnataka has not enforced the revised Property Guidance Value, which was proposed to be implemented, has decided to PUT IT ON HOLD, till further orders.

AKRAMA – SAKRAMA – STILL IN THE COURT


The Akrama Sakrama scheme has not reached its finality in the High Court and the Government has not been able to properly find solutions for the issues raised.

Many readers have sent queries regarding the status of the WP in the High Court and the processing of application had been STAYED.  Till date, it has not been vacated.

 

Bangalore District Administration recovers encroached lands


Continuing its drive to recover the Government Lands, the District Administration has recovered lands worth over Rs.1,600 Crores in Bangalore District, which includes an apartment complex at Hulimavu.

On the otherhand the BDA has also initiated the recovery proceedings and issued notices in several parts of Bangalore.

Contempt of court proceedings initiated against the BDA due to its failure to safeguard the recovered govt lands  and preventing the construction and rebuilding of the demolished and recovered lands at Sarakki-Puttenahally lake, in Bangalore South.

The suit regarding the industrial land in survey no.42, pattandur Agrahara, allotted to Joy Ice Cream for industrial purpose at a very cheaper rate by the Government with a condition that the allotted land MUST ONLY BE USED FOR INDUSTRIAL PURPOSE, the said property was sold to prestige group, and the builder obtained the sanction of building plan and began the construction.  In the meanwhile, the STF discovered the discrepancy and recommended that the land be vested with the state as it had violated the conditions of sale.  The Deputy Commissioner, Bangalore District, resumed the said property.

The builder approached the court and as usual obtained a stay order ( the simple strategy of the builders to hoodwink the investors and buyers)  to the said resumption.  Mr.Hiremutt, a social activist, fighting many such cases, is said to have issued a paper statement, which the high court felt it as derogatory and summoned Mr.Hiremutt.

This subject will reach the apex court soon.

But, the investors and the buyers have to be satisfied that there is a STAY ORDER and there are no answers for:

1). Whether the property allotted by the state specifically for the industrial activity be used for other purposes?

a). The land acquired from poor farmers at throwaway prices and allotted to the industries with all facilities, so that the industries generate employment, use the locally available natural resources, consume the electricity, generate revenue to the Government in the form of VAT, Excise, Service Tax, Professional Tax and Income Tax.  The intention of the state to provide land and infrastructure is for the development and not for the profit of a group by selling the land thus allotted.

b). The builder MUST have obtained NOC for the change of land use from KIADB, but might have not obtained the same.

c). The change of land use condition need not be specified at all as it is implied.

d). It is crystal clear that the builder has violated and also obtained the building plan without obtaining the NOC from KIADB and BDA`s role in the sanction of the plan must be investigated.

2). Filing of Writ Petition will not entitle or grant the right, title and interest to the plaintiff.  It will be conferred only by the decree of the court.  Hence, the consoling words like, the subject matter is in the court, does not have any validity at all.

The affected investors and buyers are sitting in the corner of their home, cribbing and crying, watching the episode without a murmur.

There are some more like this.  The skeletons will tumble out one by one.

BOUGHT A PROPERTY WITH DEFECTIVE TITLES OR DISCREPANCY OR VIOLATION OR DEVIATION OR FAKE DOCUMENTS ? DO NOT WORRY


Many properties with title defects and discrepancy, building plan violation, zonal violation, fake or manipulated licenses or approvals had been sold to innocent buyers.

Buyers, who had been cheated, can substantiate their case in the court of law and seek relief from the court and initiate appropriate proceedings against the offenders.  But, in our system, this process takes its own sweet time, due to such delays, the buyers are unwillingly compelled not to take or initiate any action against the cheats and frauds.  But, the buyers must take appropriate action at the right time, if not, legal relief might not be available.

Legal remedy is available to the affected and the buyers need to take swift and stern action against the seller.

APARTMENTS – APARTMENT COMPLEXES – ADDITIONAL DEVELOPMENT OR STRUCTURES OR MODIFICATION OR ALTERATION DONE AFTER OBTAINING OCCUPANCY CERTIFICATE !!!!


IT HAS COME TO LIGHT THAT SOME OF THE APARTMENTS/APARTMENT COMPLEX/VILLAS/PROJECTS HAVE ILLEGALLY, WITHOUT PROPER SANCTION OR APPROVAL HAVE MADE OR CONSTRUCTED ADDITIONAL STRUCTURES OR BUILDINGS, MODIFIED THE EXISTING STRUCTURES, ALTERED THEM BEYOND RECOGNITION, SHIFTED SOME OF THE INFRASTRUCTURE FACILITY OR REMOVED SOME OF THE STRUCTURES,  AFTER OBTAINING THE OCCUPANCY CERTIFICATE FROM THE APPROPRIATE PLANNING OR MUNICIPAL AUTHORITY.

SUCH CHANGES/MODIFICATIONS/ADDITIONS/ALTERNATIONS/RENOVATION/SHIFTING WILL RESULT IN THE AUTOMATIC CANCELLATION OF THE OCCUPANCY CERTIFICATE, WITHOUT ISSUING A NOTICE.
