ARKAVATHY LAYOUT – CIVIL WORKS BEGINS


After a lull of over 15 years, The much debated Arkavathy layout civil works have begun and hope that it will be completed as scheduled.

The Government has decided to develop 3000 sites in Nadaprabhu Kempegowda Layout for those who have lost their sites in Arkavathy layout, additionally, there are no charges or revision of prices.

BUYING A PROPERTY/APARTMENT IN ARKAVATHY LAYOUT ZONE – WATCH OUT


THERE ARE TOOOOOOOOO MANY COMPLEX ISSUES SURROUNDING THE ARKAVATHY LAYOUT SITES AND APARTMENTS.

SOME HAVE BDA APPROVED BUILDING PLANS FOR APARTMENTS AND SOME ARE BDA APPROVED LAYOUTS AND SOME ARE TECH ZONES BY DEVELOPERS, BUT, ALL OF THESE HAVE TO BE COMPULSORILY SCRUTINIZED.

BDA IS A TECHNICAL BODY, PROVIDES/SANCTION/APPROVE LAYOUTS AND BUILDINGS AS PER THE GUIDELINES AND THE MASTERPLAN BASED ON THE DOCUMENTS SUBMITTED BY THE DEVELOPER/OWNER.  IN MANY CASES, THE DEVELOPER/OWNERS HAVE MISREPRESENTED THE FACTS AND CONCEALED THE TRUTH AND OBTAINED THE APPROVALS.  IF FOUND OUT OR DETECTED, THE APPROVALS AUTOMATICALLY STANDS CANCELLED.

SANCTION/APPROVAL OF LAYOUTS OR BUILDING PLAN BY BDA DOES NOT CONFER ANY RIGHT, TITLE AND INTEREST.  ONE OF THE CONDITIONS OF THE APPROVAL FROM BDA IS THAT, IF THERE ARE ANY LITIGATIONS/CLAIMS/RUNNING SUITS, THE APPROVAL IS SUBJECT TO THE OUTCOME OF THE COURT ORDER OR DECREE.

FACTSHEET ON ARKAVATHY LAYOUT – BDA


The Government has ordered the one-man commission inquiry headed by retired high court judge HS Kempanna will go into the entire Arkavathy Layout Denotification allegations or scam, since February 2004 when the BDA issued the final land notification for 2,750 acres spread across 16 villages, till April 2014, when the present government gazetted the final notification for the remodified scheme. 

a). Kumaraswamy had ordered for 78 acres 28 guntas denotification from February 2006 to October 2007 after the final land acquisition notification. 

b). Yeddyurappa , is alleged to have denotified 72 acres 12 guntas land from May 2008 to July 2011. In between,

c). Governor’s rule after the fall of JDS-BJP coalition government, 46 acres and 35 guntas land was denotified from November 2007 to May 2008.

d). D V Sadananda Gowda had directed negligible land denotifications, 25 guntas, in his 11-month tenure. 

Unexplained   lands to be deleted by the BDA from 140 acres in 2006 to 707 acres in 2014.  

The lands denotified by the earlier governments under section 48(1) of Land Acquisition Act is 198 acres.

Majority of these denotifications are arbitrary and has been done prior to 2013.

The Layout plan which started off with 2,750 acres, has shrunk to just 1,766 acres and has seen exclusions over the years.

CM Siddaramaiah had denotified 541 acres in June this year violating high court order. After the inquiry commission was announced, the BDA has worked on the report in which there is a point-to-point reply with facts.

The lands denotified /excluded because of court orders/re-do orders as per court orders is as follows: 

– Total extent of land excluded in the final notification of 2,750 acres due to various writ appeals – 83.08 acres. 2,666.32 acres left behind. 

– Denotification as per KLA Act, as per government orders by Kumaraswamy, President’s rule, Yeddyurappa and Sadananda Gowda – 198.2 acres. What remains is 2,468.12 acres. 

– Denotification as per Karnataka High Court’s division bench orders — 157.04 acre; what is left is 2,311.08 acres. (this denotification is under litigation in the Supreme Court). 

– Citing various orders of state high court and Apex Court, following the report submitted by the land acquisition officer and subsequent orders, the BDA has excluded some areas from the notification. 

– In February 2013, 422.25 acres + 119.09 acres (including 26 acres of Tata Housing); on March 20, 02 guntas, in all – 544.31 acres. 

– Finally the land remaining for the proposed Arkavathy layout is 1,766.07 acres.

ARKAVATHY LAYOUT DENOTIFICATION – ANOTHER CURIOUS TURN


THE BANGALORE DEVELOPMENT AUTHORITY, WHICH IS ALWAYS IN NEWS FOR ITS BAD ACTIVITIES IS IN AGAIN WITH DENOTIFICATION OF LANDS IN ARKAVATHY LAYOUT BY MISREADING THE SUPREME COURT AND HIGH COURT GUIDELINES, MAY LAND IN SOUP.

ANOTHER CHIEF MINISTER MAY BE IN TROUBLE AND HEADING TOWARDS ???????????????

THE AFFECTED ARE THOSE WHO HAVE PURCHASED THE LANDS IN THE DENOTIFIED AREAS, THOUGH, THEY WOULD HAVE GOT THE DC CONVERSION ORDERS, BBMP KATHA, BDA LAYOUT OR BUILDING SANCTION, BUT, ANY ILLEGALITY OR VIOLATION OF SUPREME COURT GUIDELINES IN DENOTIFICATION MEANS THAT THESE PROPERTY BUYERS ARE GOING TO LOSE.

ANOTHER GIFT FROM BDA!

The housing society forms a layout (without approval from the planning authority-Illegal and unauthorized layout) and allots it to its members, in the meanwhile, the notorious BDA notifies the 19 acre land in Jakkur Village for Arkavathy Layout and as per the SC direction and under the re-do scheme the BDA denotifies or leaves the land and the land revert to the farmers in whose name the revenue record stands.

      The allottees had paid Rs50,000/- to Rs60,000/- (plus etc) and the sale deeds, it is learnt, had been registered by GPA holders and without the consent and confirmation from the sale agreement holders and the land lords, now these allottees are in serious trouble.

A civil suit in the making and may run for years.

BDA TAKES POSSESSION OF NOTIFIED PROPERTIES IN BHOOPASANDRA


BDA HAD NOTIFIED SEVERAL SURVEY NUMBER XX PROPERTIES IN BHOOPASANDRA AND THE ISSUE WAS PENDING FOR A LONG TIME, THE OFFICIALS TOOK POSSESSION OF THE ACQUIRED PROPERTY WORTH AROUND RS70 CRORES.  IT IS ALSO SAID THAT MANY PROPERTIES WHICH HAD BEEN NOTIFIED IN AREAS LIKE HBR LAYOUT, HRBR, ARKAVATHY AND OTHER LAYOUTS, WHERE THE LANDS WERE ENCROACHED BY CRIMINAL ELEMENTS AND LAND MAFIA, WILL BE CLEARED VERY SOON. IN THESE AREAS, BASED ON WRONG DECLARATIONS AND MISREPRESENTATION OF FACTS, THE BBMP HAS ISSUED KATHAS AND MANY BANKS HAVE ALSO SANCTIONED HOME LOANS, WITHOUT EVEN VERIFYING THE DETAILS, SUCH PROPERTIES, EVEN THOUGH WITH BBMP KATHA AND BANK LOANS IS THE PROPERTY OF BDA AND IN SOME CASES BELONGS TO GOVERNMENT AND KHB.

THERE ARE PROPERTIES WORTH OVER FEW HUNDRED CRORES WHICH HAD BEEN NOTIFIED AND REWARD HAD BEEN AWARDED TO THE ORIGINAL LAND LORDS, WHICH ARE STILL IN THE POSSESSION OF ILLEGAL OCCUPANTS CLAIMING TO HAVE SALE DEEDS, FORM NO-9, FORM NO.10, BUILDING PLANS, PANCHAYAT APPROVAL AND WORSE-DC CONVERSION COPIES IN BDA AREAS AROUND BANGALORE.
