THE BMTF CHIEF HAS CLARIFIED THAT, UNDER THE POWERS DELEGATED TO IT, CAN TAKE UP ALL CASES OF ENCROACHMENT AND VIOLATIONS AND ARE CONTINUING THEIR ACT OF RECOVERING THE GOVERNMENT LANDS AND THE WITHDRAWAL OF SOME OF THE NOTIFICATIONS WILL NOT HAVE RETROSPECTIVE EFFECT on THE CASES WHICH HAD ALREADY BEEN BOOKED, WILL BE INVESTIGATED AND WILL BE DEALT AS PER THE PREVAILING LAWS.

I have already given a complaint to BBMP commissoner about an illegal structure being constructed behind my house and the encroacher has got a STAY on the BBMP’s order to be released and he is about to finish the moulding of the said illegal structure. We did complain to the local MLA, Corporator and the corporation…Everybody is helpless as he has a blessings from the BJP Vidhana Sabha leader. Tell me is their any honesty and way for getting justice

    1. Dear Sir,
      If the building has deviated from the sanctioned plan, if the XX has obtained a stay order or interim injunction from demolition, it means, that the BBMP has taken action and the XX has obtained the TI not to demolish or remove the structure, is what we have understood. In such a case, you may have to file an impleading petition and contest the suit. You may approach the BMTF and Lokayukta with the help of your advocate. XX may have the local political support and vidana sabaha leader support, but ultimately, if you give a tough fight, you will win.
      You may also submit a detailed memorandum with the sanctioned plan and other relevant official documents to the BESCOM and BWSSB not to supply power and water respectively. But, We suspect, XX might have already obtained the supply. You may also approach the electronic media with complete details. At this age, can you take this forward? are your neighbours are supporting you? Consider all the facts, then proceed accordingly. If you receive any threat(generally this kind of violaters are always have the tendency to issue threats) do not hesitate or delay, lodge a complaint with the local police station with copies to the AC and DCP.

Through RTI i have got all the docs from BBMP, but all the papers are bogus and the town planning team has been fed with good bribe…dont know whom to approach for the justice..And I submitted a complaint to the Commissioner of Police and local police..they advised me that this not a law and order case and took side. None of the neighbours are ready to face them as they have political power and the moment they open the mouth its just slang and slang…

        We even tried to reach Bangalore Mirror, TV9, Suvarna 24X7 etc..them ignored to take this case as their is no masala in this. This is Journalism in India

        GOD ONLY HAS TO GIVE US JUSTICE 🙁

        The GOD will help only those who have very strong determination and such determination must be put into action.

        If you have documentary evidence, you may approach the loakyukta court and even BMTF chief. You may prefer an appeal in the high court against the lower court`s order. It is not a law and order situation, wherein the police can take action.
        Money power coupled with political influence might be playing the tantrum, but you can definitely contest it with grit and determination, but must be ready to face ANY EVENTUALITY ARISING OUT OF SUCH SITUATION.
