B FORM OR B KATHA AND BUILDING PLAN SANCTION

THE BBMP IS NOT SANCTIONING ANY BUILDING PLAN FOR THE PROPERTIES WHICH HAVE `B` FORM OR KATHAS. EVEN THOSE, WHICH HAVE SOME KIND OF KATHA`S HAVE TO GET APPROPRIATE ORDERS FROM JURISDICTIONAL JOINT COMMISSIONERS TOWARDS THE IMPROVEMENT CHARGES TO GET THE SANCTION FOR THE BUILDING PLAN IN THE NEWLY AMALGAMATED 110 VILLAGES AND CMC.

    Does this imply that if a DC converted site with a B Khata, gets the appropriate orders from the jurisdictional joint commissioner. The site owner can then pay the improvement charges?

    Do note that I refer to 30 X 4 ft site

      The Joint Commissioner does not have power nor the appropriate orders on which he can direct the owner of such property to pay improvement charges and hence, this hypothetical question is irrelevant.

    I have bought a house in 2007.
    I wanted to apply for Khata and at that time, somebody told me that:
    1. Your house comes under a industrial layout (Notification of conversion of Agriculture to Industrial is there).
    2. So, the building plan itself should have got rejected.
    3. It is illegal to have residential house in an industrial layout.
    4. So, BBMP will not issue a khata and also it will be very difficult for me to sell this property in future.

    The area I am talking about is Jaraganahalli.
    The place I am living, all the surroundings is residential houses only.
    The notification was for silk industry and there is not a single such industry in the vicinity!

    So, is it an illegal layout? Is it not possible to get a Khata or PID for this property?
    Is it possible to get this property converted to residential now?

  4. I really get surprised by seeing so many agents selling buildings/houses with out proper documents/titles. For some of the areas, nearly 80-90% of the sites will have only B-khata and still they are able to sell it. And every agent(s) tell the same story, that once the govt starts collecting betterment charges, it would be all legal and fine. But does it make sense to purchase such sites/buildings? Still in confusion?

      It is the buyers decision. WHAT IS AKRAMA-SAKRAMA? It is being contested in the court since 2007 and the Governor has not given his assent to this amendment twice, the revenue site`s registration was banned in 2005, and the buyers were left in lurch by these agents. The market is good, there are buyers. As long as this trend continues, these kinds of properties can be bought and sold. Everyday is not Sunday. There will be a Monday, when markets open up to a black thunder. It is better to be prepared for such a rainy day. These kind of properties will not help the owners, instead complicate their problems.
      The It Industry is expecting another black day in 2013 and how can these properties be liquidated. The banks will recall the money and at that juncture there would not be any buyers. But let us be optimistic and wish the best for all the buyers.

  5. Another query as regard to betterment charges

    I am in process of buying an apartment on bannerghetta road..right opposite to Meenakshi temple. The bank insisted on having A khata and when the seller went back to its builder to have the A khata, the builder is insisted on paying the betterment charges in order to have the A khata.

    is the builder justified in asking betterment charges?
    with these charges paid, A khata can be issued?
    with A khata, can one live in peace?

      A katha is a declaratory document and your account in the municipal revenue records displaying your name and details of your property with boundaries and tax assessment. You can rest assured, that with A katha, your titles are clear. You would have consulted an advocate, before buying, hence, you are advised to contact your advocate regarding other issues.
