A PRESS REPORT ON THE RECOVERY OF GOVERNMENT LANDS


ಬೆಂಗಳೂರು ದಕ್ಷಿಣ ತಾಲ್ಲೂಕಿನ ಕೆಂಗೇರಿ ಗ್ರಾಮದ ಸರ್ವೆ ಸಂಖ್ಯೆ 122ರಲ್ಲಿರುವ 18 ಎಕರೆ ಜಾಗವನ್ನು ಕಂದಾಯ ಇಲಾಖೆಯ ವಶಕ್ಕೆ ಪಡೆಯಲು ನಗರ ಜಿಲ್ಲಾಧಿಕಾರಿ ಅವರ ನ್ಯಾಯಾಲಯ ಆದೇಶಿಸಿದೆ.

ಸರ್ವೆ ಸಂಖ್ಯೆ 122/1ರಲ್ಲಿ 4 ಎಕರೆ, ಸರ್ವೆ ಸಂಖ್ಯೆ 122/12ರಲ್ಲಿ 4 ಎಕರೆ, 122/13ರಲ್ಲಿ 4 ಎಕರೆ, 122/14ರಲ್ಲಿ  5 ಎಕರೆಯಲ್ಲಿ ನಕಲಿ ದಾಖಲೆ ಸೃಷ್ಟಿಸಿ ಭೂ ಕಬಳಿಕೆ ಮಾಡಿರುವುದನ್ನು ಜಿಲ್ಲಾಡಳಿತ ಪತ್ತೆ ಹಚ್ಚಿದೆ.

‘ವಿಶ್ವ ಒಕ್ಕಲಿಗರ ಮಹಾಸಂಸ್ಥಾನದ ಪಕ್ಕದಲ್ಲಿರುವ ಈ ಜಾಗದಲ್ಲಿ ಪ್ರಭಾವಿ  ವ್ಯಕ್ತಿಗಳ ಶಿಕ್ಷಣ ಸಂಸ್ಥೆಗಳು ಹಾಗೂ ಬಹುಮಹಡಿ ಕಟ್ಟಡಗಳು ಇವೆ. ರಾಜರಾಜೇಶ್ವರಿ ವೈದ್ಯಕೀಯ ಕಾಲೇಜು ಹಾಗೂ ಆಸ್ಪತ್ರೆ, ಐಬಿಎಸ್‌ ಬ್ಯುಸಿನೆಸ್‌ ಸ್ಕೂಲ್‌ ಸೇರಿದಂತೆ ಹಲವು ಪ್ರತಿಷ್ಠಿತ ಸಂಸ್ಥೆಗಳ ಕಟ್ಟಡಗಳು ಇಲ್ಲಿವೆ’ ಎಂದು ಜಿಲ್ಲಾಡಳಿತ ತಿಳಿಸಿದೆ.

ಈ ಎಲ್ಲ ಆಸ್ತಿಗಳನ್ನು ಶನಿವಾರ ವಶಕ್ಕೆ ಪಡೆಯಲು ಜಿಲ್ಲಾಡಳಿತ ನಿರ್ಧರಿಸಿದೆ. ಮೈಸೂರು ರಸ್ತೆಯ ಪಕ್ಕದಲ್ಲೇ ಇರುವುದರಿಂದ ಇಲ್ಲಿ ಚದರ ಅಡಿ ಜಾಗಕ್ಕೆ ₹10 ಸಾವಿರ ಮೌಲ್ಯವಿದೆ. ವಶಪಡಿಸಿಕೊಳ್ಳಲಿರುವ ಈ ಜಾಗದ ಮೌಲ್ಯ ₹100 ಕೋಟಿ ಎಂದು ಅಂದಾಜಿಸಲಾಗಿದೆ.

ಕೆಂಗೇರಿಯಲ್ಲಿ 18 ಎಕರೆ, ಹೊಸಕೆರೆಹಳ್ಳಿ ಕೆರೆಯ ಬಳಿ 5 ಎಕರೆ, ಎಚ್ಎಸ್‌ಆರ್‌ ಬಡಾವಣೆಯ 5 ಎಕರೆ ಸೇರಿದಂತೆ ವಿವಿಧೆಡೆ 40 ಎಕರೆಯನ್ನು ವಶಕ್ಕೆ ಪಡೆಯಲಿದೆ ಎಂದು ಮೂಲಗಳು ತಿಳಿಸಿವೆ.

‘ಸುಮಾರು 50 ವರ್ಷಗಳ ಹಿಂದೆಯೇ ನಕಲಿ ದಾಖಲೆಗಳನ್ನು ಸೃಷ್ಟಿಸಿ ಜಾಗವನ್ನು ಪರಭಾರೆ ಮಾಡಲಾಗಿತ್ತು. ಭೂಗಳ್ಳರು ನಕಲಿ ಪಹಣಿ, ಕ್ರಯಪತ್ರ (ಸೇಲ್‌ಡೀಡ್‌) ಸೃಷ್ಟಿಸಿ ಜಾಗ ಮಾರಾಟ ಮಾಡಿದ್ದರು.  ನಕಲಿ ದಾಖಲೆ ಪತ್ರಗಳ  ಆಧಾರದಲ್ಲೇ ಭೂಪರಿವರ್ತನೆಯೂ ಆಗಿತ್ತು. ಹಲವು ಮಂದಿಯ ಕೈಬದಲಾಗಿತ್ತು. ಕೆಲವು ವರ್ಷಗಳ ಹಿಂದೆ ಭೂಮಂಜೂರಾತಿ ಬಗ್ಗೆ  ಅನುಮಾನ ಮೂಡಿತ್ತು. ಈ ಬಗ್ಗೆ ಎಲ್ಲ ದಾಖಲೆಗಳನ್ನು ಪರಿಶೀಲಿಸಲಾಯಿತು. ಪ್ರತಿವಾದಿಗಳು  ಮೂಲ ದಾಖಲೆಗಳನ್ನು ಹಾಜರುಪಡಿಸಲು ವಿಫಲರಾದರು.  1964ರ ಭೂ ಕಂದಾಯ ಕಾಯ್ದೆ ಕಲಂ 136 (3) (ಭೂಸ್ವಾಮಿತ್ವದ ನೈಜತೆ) ಅಡಿ ವಿಚಾರಣೆ ನಡೆಸಲಾಗಿದ್ದು, ಅದರ ಪ್ರಕಾರ ಕ್ರಮ ಕೈಗೊಳ್ಳಲಾಗಿದೆ’ ಎಂದು ಆದೇಶದಲ್ಲಿ ತಿಳಿಸಲಾಗಿದೆ. ಆದೇಶ ಪ್ರತಿ ‘ಪ್ರಜಾವಾಣಿ’ಗೆ ಲಭ್ಯವಾಗಿದೆ.

ಈ ಪ್ರಕರಣದಲ್ಲಿ ಬಿ.ಸಿ. ತಿಮ್ಮರಾಯಪ್ಪ, ಜಿ.ವೆಂಕಟೇಶ್‌, ಗೌತಮ್‌ ಕೃಷ್ಣನ್‌ ಎಂಬವರು ಪ್ರತಿವಾದಿಗಳಾಗಿದ್ದರು. ‘18 ಎಕರೆಯಲ್ಲಿ 10ಕ್ಕೂ ಅಧಿಕ ಕಟ್ಟಡಗಳು ಇವೆ. ಭೂ ದಾಖಲೆಗಳನ್ನು ಸರಿಯಾಗಿ ಪರಿಶೀಲನೆ ನಡೆಸದೆ ಈ ಕಟ್ಟಡಗಳ ಮಾಲೀಕರು ಜಾಗ ಖರೀದಿ ಮಾಡಿದ್ದಾರೆ. ಸರ್ಕಾರಿ ಜಾಗವಾಗಿರುವ ಕಾರಣ ಅವರೆಲ್ಲರೂ ಬೆಲೆ ತೆರಬೇಕಿದೆ’ ಎಂದು ಹಿರಿಯ ಅಧಿಕಾರಿಯೊಬ್ಬರು ತಿಳಿಸಿದರು.

‘ಇಲ್ಲಿರುವ ಕಟ್ಟಡಗಳನ್ನು ನೆಲಸಮ ಮಾಡುವ ಬದಲು ಸಾರ್ವಜನಿಕ ಉದ್ದೇಶಕ್ಕೆ ಬಳಸಿಕೊಳ್ಳಲು ಉದ್ದೇಶಿಸಲಾಗಿದೆ’ ಎಂದೂ ತಿಳಿಸಿದರು.

ಏನಿದು ಪ್ರಕರಣ?: ಈ ಜಾಗದ ವಿವಾದ ದಶಕಗಳ ಹಿಂದೆಯೇ ಉಪವಿಭಾಗಾಧಿಕಾರಿ ನ್ಯಾಯಾಲಯದ ಮೆಟ್ಟಿಲೇರಿತ್ತು.  2009ರಲ್ಲಿ ವಿಶೇಷ ಜಿಲ್ಲಾಧಿಕಾರಿ ನ್ಯಾಯಾಲಯ ಈ ಪ್ರಕರಣದ ವಿಚಾರಣೆ ನಡೆಸಿತ್ತು. ಈ ಜಾಗ ತಮಗೆ ಸೇರಿದ್ದು ಎಂದು ಬಿ.ಸಿ. ಗುಳ್ಳಪ್ಪ, ಬಿ.ಸಿ. ತಿಮ್ಮರಾಯಪ್ಪ, ಬಿ.ಸಿ. ಗುಂಡಪ್ಪ, ಸುದರ್ಶನ್‌ ಜುನೇಜಾ, ಶಾರದಾದೇವಿ ಎಂಬವರು ವಾದಿಸಿದ್ದರು. ಈ ಬಗ್ಗೆ ಯಾವುದೇ ದಾಖಲೆಗಳು ಇಲ್ಲದಿರುವ ಕಾರಣ ಸರ್ಕಾರದ ವಶಕ್ಕೆ ಪಡೆಯಬೇಕು ಎಂದು ವಿಶೇಷ ಜಿಲ್ಲಾಧಿಕಾರಿ ಅವರು 2009ರ ಜುಲೈ 9ರಂದು ಆದೇಶಿಸಿದ್ದರು

ಇದನ್ನು ಪ್ರಶ್ನಿಸಿ ಬಿ.ಸಿ. ತಿಮ್ಮರಾಯಪ್ಪ, ಬಿ.ಸಿ. ಗುಂಡಪ್ಪ ಅವರ ಪುತ್ರ ಜಿ. ವೆಂಕಟೇಶಯ್ಯ ಹೈಕೋರ್ಟ್‌ ಮೊರೆ ಹೋಗಿದ್ದರು. ವಿಶೇಷ ಜಿಲ್ಲಾಧಿಕಾರಿ ಅವರ ಆದೇಶವನ್ನು ರದ್ದುಪಡಿಸಿದ್ದ ಹೈಕೋರ್ಟ್‌, ‘ಅರ್ಜಿದಾರರಿಗೆ ಮತ್ತೊಮ್ಮೆ ಅಹವಾಲು ಹೇಳಿಕೊಳ್ಳಲು ಅವಕಾಶ ನೀಡುವ ಸಲುವಾಗಿ ಪ್ರಕರಣದ ಮರು ವಿಚಾರಣೆ ನಡೆಸಬೇಕು’ ಎಂದು  ನಿರ್ದೇಶನ ನೀಡಿತ್ತು.

2010ರಲ್ಲಿ ವಿಶೇಷ ಜಿಲ್ಲಾಧಿಕಾರಿ ನ್ಯಾಯಾಲಯ ಮತ್ತೊಮ್ಮೆ ಪ್ರಕರಣದ ವಿಚಾರಣೆ ಆರಂಭಿಸಿತ್ತು. ತಮ್ಮನ್ನು ಪ್ರತಿವಾದಿಗಳನ್ನಾಗಿ ಸೇರಿಸಿಕೊಳ್ಳಬೇಕು ಎಂದು ಆದರ್ಶ ವಿದ್ಯಾಸಂಸ್ಥೆಯ ಕಾರ್ಯದರ್ಶಿ ಪ್ರೇಮರಾಜ ಜೈನ್‌, ಇನ್‌ಸ್ಟಿಟ್ಯೂಟ್‌ ಆಫ್‌ ಚಾರ್ಟರ್ಡ್‌ ಫೈನಾನ್ಸಿಯಲ್‌ ಅನಾಲಿಸ್ಟ್ಸ್‌ ಆಫ್‌ ಇಂಡಿಯಾದ (ಐಸಿಎಫ್‌ಐ) ಪರವಾಗಿ ಅದರ ರಿಜಿಸ್ಟ್ರಾರ್‌ ಇ.ಎನ್‌.ಮೂರ್ತಿ ಅರ್ಜಿ ಸಲ್ಲಿಸಿದ್ದರು.

‘ಸರ್ವೆ ಸಂಖ್ಯೆ 122/12ರ ಜಾಗವನ್ನು ಸುದರ್ಶನ್‌ ಜುನೇಜಾ ಅವರು 1961ರಲ್ಲಿ ಖರೀದಿ ಮಾಡಿದ್ದರು. ಅದಕ್ಕೆ ಸಂಬಂಧಿಸಿದ ಆರ್‌ಟಿಸಿ ಸೇರಿದಂತೆ ಅಗತ್ಯ ದಾಖಲೆಗಳು ಇವೆ. ಬಳಿಕ ಅದಕ್ಕೆ ಸರ್ವೆ ಸಂಖ್ಯೆ 276 ಎಂದು ನೀಡಲಾಗಿತ್ತು. 1980ರಲ್ಲಿ ಜಾಗವನ್ನು ಕೈಗಾರಿಕಾ ಉದ್ದೇಶಕ್ಕೆ ಭೂಪರಿವರ್ತನೆ ಮಾಡಲಾಗಿತ್ತು. 2003ರಲ್ಲಿ ಅವರು ಆದರ್ಶ ವಿದ್ಯಾ ಸಂಘದವರಿಗೆ ಮಾರಿದ್ದರು. ಈ ಜಾಗದಲ್ಲಿ ಸಂಘ ಹಲವಾರು ವಿದ್ಯಾಸಂಸ್ಥೆಗಳನ್ನು ಆರಂಭಿಸಿತ್ತು. ಸಂಘವು 2007ರಲ್ಲಿ ಜಾಗವನ್ನು  ಐಸಿಎಫ್‌ಐಗೆ ಮಾರಿತ್ತು. ಇಲ್ಲಿ ಕಟ್ಟಡ ನಿರ್ಮಾಣವಾಗುತ್ತಿದೆ’ ಎಂದು ಇ.ಎನ್‌. ಮೂರ್ತಿ ವಾದಿಸಿದ್ದರು.

ಮತ್ತೊಬ್ಬ ಅರ್ಜಿದಾರರ ವಾದವೇನು?
‘ಸರ್ವೆ ಸಂಖ್ಯೆ 122ರ 5 ಎಕರೆ ಶಾರದಾದೇವಿ ಎಂಬವರಿಗೆ ಮಂಜೂರು ಮಾಡಲಾಗಿತ್ತು. ಈ ಸರ್ವೆ ಸಂಖ್ಯೆಯ ಬ್ಲಾಕ್‌ 13 ಹಾಗೂ 14ರ ಜಮೀನು ಮುನಿಯಪ್ಪ ಎಂಬವರಿಗೆ 1934ರಲ್ಲಿ ಮಂಜೂರಾಗಿತ್ತು. 1934ರ ನವೆಂಬರ್‌ನಲ್ಲಿ ಸಾಗುವಳಿ ಚೀಟಿ ಕೊಡಲಾಗಿತ್ತು. ಮುನಿಯಪ್ಪ ಅವರು 1948ರಲ್ಲಿ ಸುನಂದಮ್ಮ ಎಂಬವರಿಗೆ ಜಾಗ ಮಾರಾಟ ಮಾಡಿದ್ದರು. ಸುನಂದಮ್ಮ ಅವರು 1962ರಲ್ಲಿ ಶಾರದಾ ದೇವಿ ಎಂಬವರಿಗೆ ಪರಭಾರೆ ಮಾಡಿದ್ದರು. ಅದನ್ನು 1985ರಲ್ಲಿ ನಾನು ಖರೀದಿಸಿದ್ದೆ’ ಎಂದು ಗೌತಮ್‌ ಕೃಷ್ಣನ್‌ ವಾದ ಮಂಡಿಸಿದ್ದರು.

‘ಇದು ಸ್ವಾತಂತ್ರ್ಯಪೂರ್ವದಲ್ಲಿ ಮಂಜೂರಾದ ಜಾಗ. 1964ರ ಭೂ ಕಂದಾಯ ಕಾಯ್ದೆಯ ಕಲಂ 136 (3)ರ  ಪ್ರಕಾರ ವಿಚಾರಣೆ ನಡೆಸುವಂತಿಲ್ಲ ಎಂದೂ ವಾದಿಸಿದ್ದರು. ಇದು ಅಧಿಕಾರ ದುರುಪಯೋಗದ ಪ್ರಕರಣ ಎಂದೂ ದೂರಿದ್ದರು.

‘50 ವರ್ಷಗಳಲ್ಲಿ ಈ ಜಾಗ ಹಲವಾರು ವ್ಯಕ್ತಿಗಳ ಕೈ ಬದಲಾಗಿದೆ. ಈ ವೇಳೆ ನಕಲಿ ದಾಖಲೆಗಳನ್ನು ಸೃಷ್ಟಿಸಲಾಗಿದೆ. ಕೈಬರಹದ ಪಹಣಿ ಮಾತ್ರ ಇದೆ. ಬರಹಗಳು ಹಳಗನ್ನಡದಲ್ಲಿದ್ದು, ಸ್ಪಷ್ಟವಾಗಿಲ್ಲ. ಸರ್ಕಾರಿ ಜಮೀನು ಮಂಜೂರಾದ ಕುರಿತು ಪ್ರತಿವಾದಿಗಳಲ್ಲಿ ಯಾವುದೇ ನಿರ್ದಿಷ್ಟ ದಾಖಲೆಗಳು ಇಲ್ಲ’ ಎಂದು ಬೆಂಗಳೂರು ದಕ್ಷಿಣ ತಾಲ್ಲೂಕು ತಹಶೀಲ್ದಾರ್‌ 2011ರಲ್ಲಿ ವರದಿ ನೀಡಿದ್ದರು. ಈ ಎಲ್ಲ ಅಂಶಗಳನ್ನು ಗಣನೆಗೆ ತೆಗೆದುಕೊಂಡು ಜಿಲ್ಲಾಧಿಕಾರಿ ವಿ.ಶಂಕರ್‌ ಆದೇಶ ಹೊರಡಿಸಿದ್ದಾರೆ.

CHEATING, FRAUD AND FORGED OR MANIPULATED DOCUMENTS IN THE REAL ESTATE BUSINESS


The sudden increase and demand for the properties in and around Bangalore has given rise to many fraudsters.  The modus operandi is that they create or fabricate or forge or prepare fake documents of properties and approvals (forged and without authority) to sell it to the buyers.

The buyers, are too eager to make quick profits or to buy at cheaper prices, fell prey for such fraudsters.  It is quite common that documents pertaining to titles,(gift deed-will-partition deed) DC Conversion, layout approval, building plan approval and above all the MOST NOTORIOUS IS THE A KATHA, are FAKE, FORGED, MANIPULATED AND FABRICATED with seal and signature(forged) by the officials.

In a bid to save the expenses or the fees payable for the scrutiny or the investigation, the buyers, drown themselves along with their friends and relatives in the NEVER ENDING litigation.

The Scrutiny and investigation must be conducted by an experienced team, which must include an advocate, town planner, surveyor, architect and an investigator, who have extensive knowledge about the titles, approvals and appropriate prevailing laws.

It is found out that the KATHA of the properties both in village or panchayat limits and the BBMP limits are not genuine.  The files of few properties regarding katha does not exist in the BBMP at all and the green colour village gram panchyat kathas does not even have an entry in the Gram Panchayat Offices.

PAYMENT OF TAXES DOES NOT CONFER ANY RIGHT, TITLE AND INTEREST.

KATHA MUST BE GENUINE AND REGULAR.

APARTMENT WITHOUT OCCUPANCY CERTIFICATE WITH A KATHA MUST BE THOROUGHLY EXAMINED.

There is NO CREDIBILITY for the BRAND NAME.

For.Example. Yesterday, the Revenue Minister has categorically informed the legislative assembly that a particular land/property has been seized AND will be seized by the district administration in Bangalore, but it had been sold for few hundred crores by the real estate company.

Many cases are pending against who is who of real estate business, regarding their projects in Bangalore South both civil and criminal.

Lake encroachment cases are pending before the NATIONAL GREEN TRIBUNAL and some in the local courts.

Raja Kaluve, kaalu daari, bandi daari, gundu thopu, gomala and kharab encroachments are common occurrence, when confronted with evidence, the HONEST SONS OF LORD HARISCHANDRA, approaches the court to prolong the case with the help of scam tainted officials to hoodwink the greedy buyers. Ultimately, the greedy buyers, saying that I have borrowed money or I have earned money with hard work and with all sorts of escapism or lies, approach the courts and the government to provide them the relief.

The projects which are in and around lakes, raja kaluve, bandi daari, kaalu daari etc which are existing without any hassles, may encounter serious trouble during re sale or during RE DEVELOPMENT.

BBMP – DECISION TO DEMOLISH ILLEGAL APARTMENTS


The BBMP has decided to demolish the apartments (4 ) in Uttarahally hobli, for having violated the building by-laws and for having produced fake documents, today.

Be careful about the details, brochures, names of the builders or the sellers, approvals, construction quality and finally the price.

80% of the apartment buyers cannot openly express their worry and anguish, as they had expected heaven on earth while buying the apartment, once bought, the hell drops down, without any notice or intimation.  Many property buyers are not aware of what they bought, till they get the court notice or the seepage in the building with bonus like charges and expenses.

I bought a site in 2004, never knew it was a panchayat or a revenue site. 2005 is a year, which saw the setback, as the High Court Of Karnataka has banned the sale of REVENUE SITES.  Till date, thousands of sites remain unsold or under developed like mine, but it is still being sold with fake or fabricated or forged or obtained through misrepresentation of facts and registered.

I work for 8 to 10 hours honestly and earn my bread and support my family.  In a bid to have my own little hut, I bought a site, But, due to my ignorance or foolishness, I am suffering, as I had bought an illegal property (as always published by ecopack). Whom to blame? The system, The seller ? Myself? The Subregister? The Agent? The Panchayat? What use to blame it?  I have lost money, no house, loans and free blood pressure and above all, chiding by friends and family members, make me angry.  What to do now?  Wait for Akrama Sakrama ? How long? Why not courts understand the plight of people like me?

Ever since, 2005, till date, people are buying the sites, braving the court orders, with fake E katha doing rounds.  In some cases, the DC Conversion orders are also fake and in some cases, specially on sarjapur road, the layout plan is also forged or manipulated.

Do not jump into buying without proper verification, even for the second sale or resale.

CHECK AND RE CHECK AND BUY.

BOUGHT A PROPERTY WITH DEFECTIVE TITLES OR DISCREPANCY OR VIOLATION OR DEVIATION OR FAKE DOCUMENTS ? DO NOT WORRY


Many properties with title defects and discrepancy, building plan violation, zonal violation, fake or manipulated licenses or approvals had been sold to innocent buyers.

Buyers, who had been cheated, can substantiate their case in the court of law and seek relief from the court and initiate appropriate proceedings against the offenders.  But, in our system, this process takes its own sweet time, due to such delays, the buyers are unwillingly compelled not to take or initiate any action against the cheats and frauds.  But, the buyers must take appropriate action at the right time, if not, legal relief might not be available.

Legal remedy is available to the affected and the buyers need to take swift and stern action against the seller.

        A complaint had been lodged with the Seshadripuram Police Station by the BDA against a first division assistant working with the Bangalore Development Authority (BDA) and three touts and an FIR filed against them for allegedly trying to gulp nine prime sites measuring 50×80 in HSR Layout.
       BDA’s deputy secretary-1 Shivaswami has filed an FIR with the Sheshadripuram police on the directions of the  BDA commissioner. The FIR has been filed against Suryanarayana, Yeshwanth and Guru, and BDA employee GL Madhusoodan, for forging an original file and creating a duplicate file to grab nine prime sites in HSR Layout. The incident came into light after Suryanarayana, Yeshwanth and Guru grabbed allotment letters pertaining to site No. 384, 385 and 386 in HSR IInd sector and site No 130/A, 131/A, 184/A1, 196/B, 1107/E and 1107/F in sector No III. Further, the accused obtained registered sale deeds of the site except site No 1107/E and 1107/F, to show sale transactions.

       According to the complaint filed by the deputy secretary, BDA found that sites No 384, 385 and 386 in HSR sector II and site No 196/B in sector III were registered in the names of M Munikrishna and were sold to PS Asha, Savitramma, Lalitha, Manjunath Shetty and Prabhakar Shetty, respectively.

The BDA Commissioner Sri.Sham Bhat cancelled the “sale” of the above seven sites after BDA’s legal advisor recommended the same on February 27, 2015. During the investigation, it was also found that the official, Madhusoodan, along with the touts had stolen the documents from the file belonging to one Lakshmidevi.

AN UNAUTHORISED LAYOUT AND ILLEGAL LAYOUT FORMED IN GREEN BELT WAS ORDERED TO BE DEMOLISHED BY THE THASILDAR, BANGALORE SOUTH WAS STAYED BY THE HIGH COURT OF KARNATAKA, BUT NOT FOR LONG.

A STAY WAS BROUGHT AND THE SITE OWNERS CAN HEAVE A SIGH OF RELIEF BUT THE GOVERNMENT CANNOT REGULARISE IT AND A LONG DRAWN LEGAL BATTLE ENSUE AND THE ILLEGAL SITE OWNERS CAN NEITHER SELL NOR CONSTRUCT NOR MORTGAGE THESE PROPERTIES.

IT IS SAID THAT THERE ARE OVER FEW HUNDRED SUCH ILLEGAL LAYOUTS IN THIS AREA, WHICH DOES NOT HAVE CLEAR TITLES. SOME SITES ARE FORMED IN GOVERNMENT LANDS, BUT THEY HAVE TO GO-GO.  THE LAND MAFIA/ROGUE BUILDERS ARE VERY STRONG IN THIS AREA.

THIS ROGUE BUILDERS AND DEVELOPERS ALSO PROMISE HOME LOANS FROM 00000000000000 FINANCIAL INSTITUTIONS AND ALSO REGISTER THESE PROPERTIES (TOTALLY ILLEGAL WITH FAKE DOCUMENTS AND MISREPRESENTATION OF FACTS) WITH THE CONNIVANCE OF THE REVENUE AUTHORITIES AND THE SUB – REGISTRARS.

ONE NOTORIOUS BUILDER HAS OBTAINED A KATHA IN BBMP BY PAYING BETTERMENT CHARGES FOR A NON – EXSISTANT(FAKE DOCUMENT) DOCUMENT AND SELLING THE PROPERTY. THIS BAD COMPANY HAS ALREADY SOLD FEW SITES.
