India test fires the multi-layer Ballastic Missile Defence System –Advanced Air Defence Missile


 

India on Sunday test-fired its indigenously developed supersonic interceptor missile, capable of destroying any incoming ballistic missile.

The interceptor, known as Advanced Air Defence (AAD) missile, was engaged against an electronically prepared target which simulated the trajectory of a hostile ballistic missile.

The interceptor is a 7.5-meter long single stage solid rocket propelled guided missile equipped with a navigation system, a hi-tech computer and an electro-mechanical activator, the defence sources said.

India Successfully Launched the Geosynchronous Satellite Launch Vehicle GSLV-D5 from the Satish Dhawan Space Centre in Sriharikota today. It includes an indigenous cryogenic rocket stage.

India’s Mars Orbiter Mission (MOM) had a perfect lift off at 2:38 pm on Tuesday from the Sriharikota spaceport. The PSLV-C25 carrying five scientific payloads will travel for almost 300 days, cover 680 million kilometres and finally reach Mars on September 24, 2014.

RAILWAY TICKET BOOKING THROUGH SMS

 Indian Railways has continuously endeavored to improve the ease and access of ticketing. The e-ticketing initiative of Indian Railways has been one of the most passenger-friendly initiative of Indian Railways. In order to further expand the reach of ticketing, Hon’ble MR had made a Budget announcement regarding launch of ticketing through mobile phones. The objective was to tap the potential of mobile phone market in India and thereby facilitate the common man, by providing him any-where, any-time and hassle free booking option. In pursuance, a pilot project of ticketing through non-internet based mobile phones will be launched by IRCTC on 1st July, 2013. This will enable people using non- internet based mobile phones to easily access Railway ticketing services through SMS/IVRS/USSD. The scheme is user-friendly, secure and also eco-friendly, as no print out is required.

 

The salient features of this new scheme to be operationalised on 1st July, 2013 are :

 

There will be a dedicated number on which SMS can be sent

 

No need of internet at any stage viz, booking, payment, cancellation etc.

 

One has to register the mobile number with IRCTC as well as one’s bank. The Bank provides MMID (Mobile Money Identifier) and OTP (one time password) for authorization of payment.

The passenger has to type the train number, destination, journey date, class and passenger details like name, age and gender on the SMS box.

 

The sender will receive transaction ID and then make payment through sending another SMS by typing PAY followed by the transaction ID, MMID as received from the bank and password.

 

On successful booking of ticket, message will be sent to the user by IRCTC which will suffice as valid authority to travel along with photo ID card in original.

 

Cancellation of tickets can also be done through the cancellation option available

 

The scheme will be on pilot basis and will not be available during the 8am -12pm for booking ARP/Tatkal/General tickets.

IRCTC’s SMS-based ticketing service goes live

IRCTC’s ambitious SMS-based ticketing system is a reality now. Railways minister Mallikarjun Kharge launched this new system yesterday and said that the service aims to “empower the common man who does not have access to internet and cannot afford to buy smartphones.”

The SMS-based ticketing system, a pilot project by IRCTC, will also effectively eliminate the menace of touts fleecing unsuspecting travellers at the time of booking tickets. Kharge added that this new system will prove especially beneficial to labourers and workers when booking tickets to their native towns. Such a system is apt for them since it is quick and hassle-free.

This SMS-based ticket service can be availed through two numbers – 139 and 5676714. Those looking to book tickets by sending an SMS to 139 will have to first register their mobile numbers with IRCTC and their banks. Over 25 banks are offering this facility at the moment. Users will then receive an MMID or Mobile Money Identifier and OTP or one time password from the bank for payment authorisation. This SMS-based service is available to all mobile subscribers.

The SMS-based ticketing service through BSNL will require users to have a BSNL SIM card, a Java-enabled phone and an Andhra Bank Prepaid card. This system in particular is a menu-based one, meaning the user will have to enter details in a step-by-step process. To register, they will have to first install the application and select the “Register” option to get the Mpin. To book tickets through BSNL, users will have to first click the BSNL Prepaid Card icon and select Ticketing > Train (IRCTC). They have to provide details of their journey such as the name of their starting and destination stations, train number, date of their travel, class, quota, and passenger details.

Airtel subscribers can book their tickets through USSD (Unstructured Supplementary Service Data). Airtel subscribers will have to dial *400# to register for Airtel money. They will have to then load cash on this or recharge at any Airtel money outlet. Upon recharging their account, Airtel users will have to dial the same number and select the book tickets option. Once there, they will have to select the Reservation option and enter their IRCTC User ID. Upon logging in, users will have to enter their ticket details including name of the station, train number, date of travel, class etc., and then enter mPIN to authorise the payment. The user then receives a confirmation SMS, which he can produce on the day of his travel. Those keen on booking tickets this way will have to first get their mobile money account opened from their bank or RBI-approved agencies offering this facility.

While its fate will only be known eventually, the ability to book railway tickets on mobile is interesting in concept. What’s even more interesting is that this system works on the most basic phones and does not require an active Internet connection. The user will receive the ticket details via SMS upon booking. He can then produce the SMS and an original, valid ID proof on the day of his travel.

 

How To book the ticket, an SMS will have to be sent in the following format –

BOOK [TrainNo][FromStn.Code][ToStn.Code] [TravelDate (DDMM)][Class][Passenger-Name][Age][M/F]

Upon sending this SMS to 139 users will receive Transaction ID alongwith other details. To make the payment, they will have to send an SMS to 139 in the following format –

PAY [Transaction ID as received][IMPS][Your MMID as received from the bank][OTP ][IRCTCuserID]

Users can also book their tickets by sending an SMS to 5676714. They will have to first register their mobile number with IRCTC and m-wallet, and send an SMS to 5676714 in the following format –

START [irctc user Id]

To book the ticket, users will have to send an SMS to 5676714 in the following format –

BOOK[From stn.code],[to stn.code],[DDMMYY], [Trainno],[Class],[passenger name],[age],[M/F]

Once they have sent that SMS, users will receive the transaction number on their phones. A second SMS will have to be sent to make the payment. The format is as below –

“PAY [transaction no], MPAY, [m-PIN]” for authorizing payment through MPAY

Or

“PAY [mobileno],[mmid],[amount],[transaction Id],[OTP]” for authorizing payment through IMPS.

Once they’ve made the payment, users will receive a booking confirmation SMS on their phone.

Permanent Benches of Karnataka High Court at Dharwad and Gulbarga Districts in the State of Karnataka


The Union Cabinet today gave its approval for the establishment of permanent benches of the Karnataka High Court at Dharwad and Gulbarga Districts in the State of Karnataka. Establishment of Permanent Benches of the Karnataka High Court at Dharwad and Gulbarga would facilitate better access for justice to litigants of the Districts, covered under the jurisdiction of the Dharwad and Gulbarga Benches. It will also help in speedy disposal of cases with consequent reduction in pendency in the High Court.

The proposal to make the Circuit Benches permanent has been approved by both the State Government and Chief Justice of the High Court.

TDS ON THE SALE OF IMMOVABLE PROPERTIES – DETAILS IN A NUTSHELL


Tax Deduction at Source (TDS) on transfer of certain immovable properties (other than agricultural land) for value  Exceeding Rs.50 Lakh effective from 01-06-2013

The Finance Act 2013 had provided that purchaser of an immovable property (other than agricultural land) worth over Rs 50 lakh is required to pay withholding tax at the rate of 1% from the consideration payable to a resident transferor.  The rate at which tax is to be cut is 1%, but it would go up to as high as 20% if the seller does not disclose his permanent account number.  This amendment is effective from 1st June, 2013.

There is a statutory requirement under section 139A of the Income-tax Act read with rule 114B of the Income-tax Rules, 1962 to quote Permanent Account Number (PAN) in documents pertaining to purchase or sale of immovable property for value of Rs.5 lakh or more. However, the information furnished to the department in Annual Information Returns by the Registrar or Sub-Registrar indicate that a majority of the purchasers or sellers of immovable properties, valued at Rs.30 lakh or more, during the financial year 2011-12 did not quote or quoted invalid PAN in the documents relating to transfer of the property.

Under the existing provisions of the Income-tax Act, tax is required to be deducted at source on certain specified payments made to residents by way of salary, interest, commission, brokerage, professional services, etc. On transfer of immovable property by a non-resident, tax is required to be deducted at source by the transferee. However, there is no such requirement on transfer of immovable property by a resident except in the case of compulsory acquisition of certain immovable properties. In order to have a reporting mechanism of transactions in the real estate sector and also to collect tax at the earliest point of time, it is provided  to insert a new section 194-IAwef 01.06.2013  to provide that every transferee, at the time of making payment or crediting of any sum as consideration for transfer of immovable property (other than agricultural land) to a resident transferor, shall deduct tax, at the rate of 1% of such sum. In order to reduce the compliance burden on the small taxpayers, it was  further provided that no deduction of tax under this provision shall be made where the total amount of consideration for the transfer of an immovable property is less than fifty lakh rupees.

A simple one page challan for payment of TDS would be provided containing details (including PAN) of transferor and transferee and also certain details of the property.

The transferee would not be required to obtain any Tax Deduction and Collection Account Number (TAN) or to furnish any TDS statement as this would be mostly a one time transaction.  

The transferor would get credit of TDS like any other pre-paid taxes on the basis of information furnished by the transferee in the challan of payment of TDS.

The New Payment Challan for TDS requires the Property Purchaser to Furnish following details in the form for payment of TDS :-

  • Permanent Account No. (PAN) of Transferee(Payer/Buyer)
  • Permanent Account No. (PAN) of Transferor (Payee/Seller)
  • Category of PAN of Transferee
  • Category of PAN of Transferor
  • Full Name of the Transferee
  • Full Name of the Transferor
  • Complete Address of the Transferee
  • Complete Address of the Transferor
  • Complete Address of the Property Transferred
  • Details of amount paid/Credited
  • Tax Deposit Details

 

SUGGESTIONS INVITED BY THE LAW COMMISSION OF INDIA ON ELECTORAL REFORMS


The Law Commission of India Invites Suggestions on Electoral Reforms

The issue of ‘Electoral Reforms’ has been referred by the Central Government to the Law Commission of India for consideration and for suggesting comprehensive measures for changes in laws relating to elections. Acknowledging the importance of the subject, the Commission has prepared a Consultation Paper eliciting feedback from various stakeholders.

           The election system comprises a complex web of different nuances – legal, political, economic, social, religious, ethical and moral and this complexity makes the task of suggesting reforms quite challenging.  No single aspect of election process can be looked at in isolation from others.   Most, if not all areas of these aspects, are of the nature where law either interacts or need to interact more closely.  The focus of the Consultation Paper is, therefore, to identify those areas and aspects where law should play more prominent and engaging role.

          The Commission proposes to focus largely on issues such as: qualifications/disqualifications of  those seeking election, or disqualification of the persons already elected; modes, methods and quantum of funding of elections; transparency, accountability and sources of spending by political parties and their respective candidates during elections; regulations and ethical conduct of political parties or candidates participating in elections; filing of false affidavits – A ground for disqualification; electronic and print Media – impact of ‘paid news’; quantum of punishment for electoral offences; and adjudication of election disputes etc.

          The Commission, through the Consultation Paper, has solicited views/suggestions of political parties, states, civil society, and all other stakeholders, inter-alia, on the aforesaid issues.

         The Consultation Paper has been made available on the website of the Law Commission of India – http://lawcommissionofindia.nic.in and can be downloaded freely.

SERVICE TAX – Service tax Changes on Construction of a complex, building, civil structure

In exercise of the powers conferred by sub-section (1) of section 93 of the Finance Act, 1994 (32 of 1994), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendment in the notification of the Government of India in the Ministry of Finance (Department of Revenue), No.26/2012-Service Tax, dated the 20th June, 2012, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (i), vide number G.S.R. 468 (E), dated the 20th June, 2012, namely:-

In the said notification, in the TABLE, for serial number 12 and the entries relating thereto, the following serial number and the entries shall be substituted, namely:-

Construction of a complex, building, civil structure or a part thereof, intended for a sale to a buyer, wholly or partly, except where entire consideration is received after issuance of completion certificate by the competent authority,-

 

(i) CENVAT credit on inputs used for providing the taxable service has not been taken under the provisions of the CENVAT Credit Rules, 2004;

(a) for a residential unit satisfying both the following conditions, namely:–

(ii) The value of land is included in the amount charged from the service receiver.”.

(i) the carpet area of the unit is less than 2000 square feet; and

(ii) the amount charged for the unit is less than rupees one crore;

(b) for other than the (a) above.
