Government of India has enacted Real Estate (Regulation and
Development) Act, 2016 on 26/3/2016. Government of Karnataka has notified
Karnataka Real Estate (Regulation and Development) Rules-2017 in the State
Gazette on 11/7/2017.Karnataka Real Estate Regulatory Authority (RERA) has
been set up.

As per the notified rules, a web-portal http://www.rera.karnataka.gov.in
for registration of projects and agents as well as to file any complaints.

A complaint was received from Sri Sandeep Tol on 24/08/2017 against
the developer for claiming the refund of his booking amount. Despite large
number of visits, calls, e-mails the developer has not responded to Sri Sandeep
Tol. On receipt of the complaint, RERA has sent a notice to the registered developer
on 06/09/2017.

Subsequently, the matter was adjudicated.

On hearing both the parties and after adjudication, the complainant and
the developer have agreed to settle the dispute by giving booking amount of
Rs. 9,00,064 to the complainant. The complainant has filed an application for
withdrawal of his complaint on the ground that he has received the booking
amount from the developer.

Both the complainant and developer have entered
into a compromise and filed the compromise petition by settling their dispute. The
same was received by this Authority and closed the complaint in terms of the
compromise petition on 23/10/2017.

RERA is following up on complaints received against registered
developers and providing a solution to complainants. The complaint should have
complete and correct details and the developer should be preferably registered
with RERA for an early resolution.
